Detailed Rules for the Implementation of People's Republic of China (PRC) Flood Control Regulations in Heilongjiang Province

Chapter I General Provisions Article 1 These Detailed Rules are formulated in accordance with the Regulations on Flood Control in People's Republic of China (PRC) (hereinafter referred to as the Regulations) and in combination with the actual situation in our province. Article 2 These Regulations shall apply to flood control and flood fighting activities within the administrative area of this province. Article 3 Flood control work shall follow the principle of "safety first, constant vigilance, prevention first, and all-out rescue", and follow the principle of unity and cooperation and subordination of local interests to overall interests. Article 4 Flood control work shall be carried out under the responsibility system of the chief executives of the people's governments at all levels, with unified command and responsibility at different levels. All relevant departments shall implement the post responsibility system for flood control. Article 5 All units and individuals have the obligation to protect flood control facilities and participate in flood control and flood fighting.

China People's Liberation Army and Armed Police Force are important forces for flood control and fighting. Chapter II Flood Control Organizations Article 6 People's governments and administrative offices of provinces, cities and counties (districts) shall set up flood control headquarters, which shall be composed of heads of relevant departments, local garrison troops and people's armed forces departments, with heads of people's governments at various levels as the command. The flood control headquarters of the people's governments at all levels shall set up permanent offices in the water administrative departments at the same level.

The flood control headquarters of the people's governments at all levels, under the leadership of the flood control headquarters of the people's governments at higher levels and the people's governments at the same level, carry out the policies, regulations and instructions on flood control at higher levels, formulate various flood control measures, organize flood control inspections, issue flood warnings, organize flood control teams, prepare flood control materials, and uniformly deploy and direct flood control work in their own areas.

Large-scale water conservancy project management institutions across regions and cities under the provincial administrative department shall set up flood control offices to coordinate the daily work of flood control within the scope of water conservancy project management.

Urban flood control work is carried out under the unified command of the flood control headquarters of the local people's government. Seventh oil, electricity, posts and telecommunications, railways, highways, shipping, mining, forestry, state-owned farms, commerce, materials, grain and other departments and units with flood control tasks. During the flood season, a flood control agency shall be established to be responsible for the flood control work of the industry and the unit under the unified leadership of the flood control headquarters of the people's government with jurisdiction. Article 8 People's governments of counties (districts) and townships (towns) with flood control tasks shall organize mass flood control teams with militia as the backbone. Enterprises and institutions threatened by floods shall organize employees to set up flood prevention and rescue teams. Before the flood season, the relevant departments and units should register the members of the flood control team and clarify their respective tasks and responsibilities.

River management agencies and other flood control project management units can organize their own flood control teams as the backbone of emergency rescue in combination with peacetime management tasks. Chapter III Preparation for Flood Control Article 9 The people's governments at or above the county level shall, according to the comprehensive planning of river basins, the actual situation of flood control projects and the flood control standards stipulated by the state, and on the principle of ensuring key points and giving consideration to generality, formulate flood control plans for rivers within their jurisdiction (including measures to deal with catastrophic floods).

Flood prevention schemes for Songhua River, Nenjiang River and Lalin River shall be formulated by the provincial people's government, reviewed and approved by the Songliao Water Conservancy Commission of the Ministry of Water Resources, and implemented after being reported to the State Council or its authorized institution for approval; Flood prevention schemes for other rivers across regions and cities shall be compiled by the relevant administrative offices and the Municipal People's Government, audited by the provincial water administrative department, and implemented after being approved by the provincial people's government or its authorized institutions.

The people's government of a city with the task of flood control and flood fighting shall, according to the comprehensive river basin planning and the flood prevention plan of rivers, formulate the flood control plan of this city, and report it to the people's government at a higher level or its authorized institution for approval before implementation.

After the flood prevention plan is approved, the relevant administrative offices, relevant city, county (district) and township (town) people's governments and relevant departments and units must implement it. Article 10 The project management departments of reservoirs, hydropower stations, river dams and other projects shall, according to the project planning and design, flood control scheme and engineering practice, formulate operation plans in flood season on the premise of promoting profits and obeying flood control and ensuring safety, and report them to the flood control headquarters of the people's government with jurisdiction for the record after being examined and approved by the competent department at a higher level, and accept their supervision. Among them, large and key medium-sized projects determined by the flood control headquarters of the provincial people's government or projects involving more than two regions and municipal administrative regions must be reviewed and agreed by the provincial water administrative department.

For hydropower stations that have a significant impact on flood control as determined by the national flood control headquarters and the flood control headquarters of the provincial people's government, the flood control storage capacity in flood season shall be approved by the flood control headquarters of the people's government with jurisdiction after being audited by the superior competent department.

After the flood season operation plan is approved, the project management departments of reservoirs, hydropower stations, river dams and other projects shall be responsible for the implementation. It is strictly forbidden to raise the limited water level before flood season without authorization. For reservoirs with little benefit, unsafe projects and great harm, water storage should be restricted to prevent man-made disasters.

The discharge of water from rivers and upstream reservoirs with the task of preventing ice flood during ice flood must be approved by the flood control headquarters of the people's government with jurisdiction and subject to its supervision. Eleventh flood control headquarters at all levels shall, before the hearing, organize forces to inspect the safety status, flood discharge capacity, flood control scheme, flood control materials reserve and the formation of rescue teams of various flood control engineering facilities within their respective jurisdictions. When problems affecting flood control safety are found, the responsible units shall be instructed to solve them within a time limit, and the flood control and flood fighting work shall not be delayed.

All relevant departments and units shall, in accordance with the unified arrangements of the flood control headquarters, conduct pre-flood inspection of flood control engineering facilities under their jurisdiction, report the problems and treatment measures that affect flood control safety to the competent flood control headquarters and the higher authorities, and deal with them according to the requirements of the flood control headquarters.
