The Ministry of Natural Resources promotes the full implementation of the newly revised Land Management Law.

On March 20th, Lu Hao, Minister of Natural Resources, signed Ministerial Order No.6, releasing the Decision of the Ministry of Natural Resources on the Second Batch of Abolishing and Amending Departmental Regulations, abolishing four regulations and packaging and amending three regulations.

The purpose of this regulation cleaning work is to thoroughly implement the decision-making arrangements of the CPC Central Committee and the State Council on reforming the land management system, promote the full implementation of the newly revised land management law, and accelerate the implementation of the requirements of institutional function transformation and the reform of "simplifying administration and decentralizing power, strengthening supervision and improving services". Mainly concentrated in three aspects: first, clean up the contents inconsistent with the newly revised land management law. The newly revised land management law will be implemented from June 65438+ 10/0/day, 2020. The new law has greatly improved and adjusted the procedures for land expropriation, stipulating that local governments should complete procedures such as current situation investigation, social stability risk assessment, announcement, hearing, registration and signing compensation agreements before applying for land expropriation. Therefore, the original "Measures for Land Acquisition Announcement" stipulated "two announcements and one registration". The second is to implement the spirit of the reform of the examination and approval system for construction land. Since last year, the CPC Central Committee and the State Council have repeatedly asked for the reform of land planning and management mode. In order to implement the central decision-making and deployment, the Ministry of Natural Resources and relevant departments have reformed and improved the annual land use plan. The original management method of the annual land use plan has not met the requirements of the reform practice and needs to be abolished in time. Third, the administrative law enforcement and hearing departments and regulations have been integrated. Based on the work practice of the Ministry of Natural Resources since its establishment two years ago, the relevant rules and regulations formulated by the original "one department and two bureaus" were simplified, merged and revised, and the publicity system of administrative law enforcement and the record system of the whole process of law enforcement were added according to the Guiding Opinions on Comprehensively Implementing the Legality Review System of Major Law Enforcement Decisions (Guo Ban Fa [20 18] 18). Accordingly, Article 7 of Administrative Punishment Procedures for Surveying and Mapping and Interpretation of Administrative Punishment Measures for Land and Resources of the Ministry of Land and Resources is abolished, and Provisions for Hearing of Land and Resources, Administrative Punishment Measures for Land and Resources and Provisions for Law Enforcement Supervision of Land and Resources are revised into Provisions for Hearing of Natural Resources, Measures for Administrative Punishment of Natural Resources and Provisions for Law Enforcement Supervision of Natural Resources.

It is reported that after the establishment of the Ministry of Natural Resources, a comprehensive clean-up of departmental regulations is regarded as an important measure to implement the spirit of the reform of the party and state institutions and promote the "chemical reaction" of the reconstruction of natural resources management functions. Since July 2065438+2009, two batches of departmental regulations have been cleared. After two clean-ups, the total number of departmental regulations of the Ministry of Natural Resources was reduced from 52 to 40.

In the next step, the Ministry of Natural Resources will focus on the comprehensive revision of the Regulations on the Implementation of the Land Management Law and the reform of the examination and approval system for construction land, continue to do a good job in the revision and abolition of regulations, and constantly improve the level of legalization of natural resources.
