Yichang City Urban Building Facade Management Regulations

Article 1 In order to strengthen the facade management of urban buildings in Yichang City and create a clean and beautiful urban environment, according to the "Urban and Rural Planning Law of the People's Republic of China" and "Urban City Appearance and Environmental Sanitation" "Management Regulations", "Hubei Province Urban City Appearance and Environmental Sanitation Management Regulations" and other laws and regulations are formulated based on the actual situation of this city. Article 2 These Regulations shall apply to the maintenance, transformation, utilization and management of building facades within the urban area of ??this city. Article 3 The term “facade of buildings” as mentioned in these Regulations refers to the outer facades of buildings, structures and other facilities as well as the roofs of buildings. Article 4 The urban management departments of the municipal and district people's governments are responsible for the supervision and management of the facades of buildings within their respective jurisdictions.

The housing and urban-rural construction, planning, real estate management, land and resources, public security and other departments of the municipal and district people's governments shall, in accordance with their legal responsibilities, coordinate the supervision and management of the facades of buildings within their respective jurisdictions. Article 5: Focus on supervision and management of the facades of buildings on both sides of main streets in this city and the facades of buildings facing streets in key areas. The scope of main streets and key areas shall be delimited by the urban management department of the Municipal People's Government in conjunction with the people's governments of various districts, and shall be announced to the public after approval by the Municipal People's Government. Article 6 The urban management department of the Municipal People's Government shall, in conjunction with relevant departments, formulate the urban appearance planning and standards of this city in accordance with the "City Appearance Standards of the People's Republic of China" and the relevant urban planning of this city, and include the appearance of buildings. Facade appearance standards shall be reported to the Municipal People's Government for approval and then promulgated and implemented. Article 7 When decorating the exterior of a building and changing the original main color, shape and design style of the exterior of the building, a design plan shall be provided and the opinions of the planning department of the Municipal People's Government shall be sought. Article 8 If the exterior facades of buildings in urban areas of this city are to be renovated in an area-wide unified manner, the organization and implementation unit shall provide the planning department of the municipal people's government with a design plan that conforms to the city's relevant urban planning and urban appearance standards. Article 9: Any use of building facades to set up outdoor advertising facilities shall comply with the urban outdoor advertising facility installation plan of this city and be set up in accordance with the prescribed requirements.

Using the facade of a building to set up signs, signboards, plaques and other signs used to indicate the name of the unit, font size, business name, etc., shall comply with the city's urban appearance standards. Article 10: Using the facade of a building to set up night scene lights shall comply with this city’s urban night scene lighting planning and this city’s urban appearance standards, and coordinate with the overall landscape of the building’s facade. Article 11 The installation of anti-theft protection facilities, air-conditioning outdoor units, awnings, exhaust and smoke exhaust facilities, solar facilities, closed balconies and pipeline facilities on the exterior facades of buildings, as well as implementation of greening, etc., shall comply with this city's urban appearance standards, and Keep it intact and tidy. Article 12 The owners of buildings, structures and other facilities are the persons responsible for the maintenance and management of the building’s facade.

The persons responsible for the maintenance and management of building facades also include the following units:

(1) Property service companies in residential areas where buildings and structures are located where property management is implemented;

(2) Sub-district offices in residential areas where property management is not implemented where buildings and structures are located;

(3) Markets, shopping malls, hotels, restaurants and other commodity transactions where buildings and structures are used Or the operating or management unit of a service place;

(4) Agencies, groups, enterprises and institutions whose buildings and structures are in their office and production areas;

(5) Cities Operation and management units of public facilities and other facilities.

If the owners, managers and users of buildings, structures and other facilities agree on the responsibility for the maintenance and management of the building's exterior facades, such agreement may prevail.

According to the above provisions, if the person responsible for maintenance and management is still unclear, the city management department of the municipal or district people's government shall determine it. Article 13 The person responsible for the maintenance and management of building facades shall maintain and manage the building facades in accordance with this city’s urban appearance standards to keep the building facades clean and beautiful.

If the facades of buildings on both sides of main streets and the facades of buildings facing the streets in key areas are damaged, discolored, or have obvious stains, seriously affecting the appearance of the city, the person responsible for their maintenance and management should promptly repair and paint them ,clean.

Article 14 No unit or individual shall engage in the following acts:

(1) Hanging or stacking goods outside the balconies, windows and roofs of buildings on both sides of main streets in this city and buildings facing streets in key areas Items that hinder the appearance of the city;

(2) Damage or unauthorized removal of various facilities uniformly installed on the facade of the building or change their location, specifications, style and color;

( 3) Opening doors and windows on the exterior of the building without authorization;

(4) Setting up display screens and other light-emitting facilities on the exterior of the building without authorization;

(5) ) Graffiti, engraving, and posting on the facade of the building without authorization;

(6) Building buildings and structures on the facade of the building without authorization;

(7) Other violations of this provision City appearance standard behavior. Article 15: Any unit or individual shall keep the facade of a building clean and beautiful, and shall have the right to discourage and report violations of these regulations. Article 16 Anyone who commits any of the following acts shall be dealt with by the city management department or other administrative departments determined in accordance with the law in accordance with the following provisions:

(1) Violation of the provisions of Article 9, Paragraph 1 of these Regulations If it is not corrected within the time limit, it will be ordered to make corrections within a time limit, and a fine of not less than 5,000 yuan but not more than 20,000 yuan may be imposed. If it is not corrected within the time limit, it will be forcibly demolished in accordance with the law;

(2) Violation of Articles 11 and 14 of these Regulations Those who comply with the provisions of Paragraph 1 shall be ordered to make corrections within a time limit. If corrections are not made within the time limit, a fine of not less than 50 yuan but not more than 500 yuan shall be imposed;

(3) Anyone who violates the provisions of paragraph 2 of Article 13 of these Regulations shall be ordered to To perform within a time limit, a fine of not less than 1,000 yuan but not more than 10,000 yuan may be imposed;

(4) Anyone who violates the provisions of Items 2, 3 and 4 of Article 14 of these Regulations shall be ordered to make corrections within a time limit. If the violation is not corrected within the time limit, a fine of not less than 500 yuan but not more than 5,000 yuan will be imposed;

(5) Anyone who violates the provisions of Article 14, Item 5 of these Regulations shall be ordered to clear it within a time limit and may be fined 100 yuan. A fine of not more than 200 yuan shall be imposed;

(6) Anyone who violates the provisions of Article 14, Paragraph 6 of these Regulations shall be ordered to stop construction or demolish it within a time limit, and may be fined 100% of the project cost of the built building or structure. A fine of not more than ten percent; after a decision is made to order the construction to stop or to demolish within a time limit, if the party concerned does not stop the construction or does not demolish within the time limit, the municipal or district people's government may instruct the relevant departments to take measures such as sealing up the construction site and forcing demolition.
