Measures of Hefei Municipality on the Administration of Outdoor Advertisements and Signboards
The term "outdoor advertising" as mentioned in these Measures refers to the following advertisements that directly or indirectly introduce goods and services by using outdoor carriers:
(a) the use of buildings (structures), roads, outdoor venues, facilities and their spaces, in the form of exhibition boards, neon lights, electronic display boards (screens), electronic steering devices, light boxes, physical modeling, etc. ;
(two) the use of buildings (structures), floating objects on the water, lifting equipment, inflatable, model surface drawing, posting, hanging advertisements;
(three) the use of motor vehicles and other means of transportation set up advertising;
(four) other forms of outdoor advertising.
The signboard as mentioned in these Measures refers to the signs, signs, light boxes, neon lights and font symbols that indicate names and other identification marks set on buildings or facilities in business (office) places. Article 3 The setting of outdoor advertisements and signboards shall conform to the planning and technical specifications of outdoor advertisements, follow the principles of safety and beauty, adapt to the functions of urban regional planning, and coordinate with architectural style and surrounding environment. Article 4 The Municipal Outdoor Advertising Planning and Setting Management Committee (hereinafter referred to as the Municipal Radio, Film and Television Management Committee) is responsible for examining and approving outdoor advertising planning and auction schemes, and studying and deciding on major issues of outdoor advertising setting.
The municipal administrative department of urban management (hereinafter referred to as the municipal urban management department) is the competent department of outdoor advertising and signboard setting in this Municipality, and is responsible for the planning, management, supervision and comprehensive coordination of outdoor advertising and signboard setting.
The district urban management department is responsible for the management and supervision of outdoor advertisements and signs in this area in accordance with the provisions of these measures. The urban management organization of the Development Zone is entrusted by the municipal urban management department to be responsible for the management and supervision of outdoor advertisements and signs in this area.
Planning, construction, public security, transportation, highways, forestry and gardens, finance and other departments shall be responsible for the supervision and management of outdoor advertisements and signboards according to their respective responsibilities.
The administrative department for industry and commerce is responsible for the qualification examination of outdoor advertising, the examination and supervision of the registration content of outdoor advertising. Chapter II Setup Planning and Standardization Article 5 Outdoor advertising setup planning includes special planning and detailed planning.
The urban management department of the city shall, jointly with the planning department, formulate a special outdoor advertising plan for this city in accordance with the principles of unified planning, rational layout and total control, and report it to the municipal government for approval before promulgation and implementation.
District (Development Zone) urban management departments (institutions) shall, according to the special planning of outdoor advertising, prepare the detailed planning of outdoor advertising in this area, and report it to the Municipal Radio and Television Management Committee for approval before promulgation and implementation.
The preparation of outdoor advertising special planning shall conform to the overall urban planning and urban appearance standards, and delimit strictly restricted areas, moderately controlled areas and key display areas. The detailed planning of outdoor advertising should define the location, location, form and specifications of outdoor advertising, and plan an appropriate number of public service advertising spaces. Article 6 The municipal urban management department shall, in accordance with the national industry standards, the special planning of outdoor advertising in this Municipality and the standards of urban appearance, formulate the technical specifications of outdoor advertising and signboards in this Municipality in conjunction with the departments of planning, construction, public security and transportation, and promulgate and implement them. Seventh in any of the following circumstances, it is forbidden to set up outdoor advertising:
(a) the use of traffic safety facilities, traffic signs;
(two) affecting the use of municipal public facilities, traffic safety facilities and traffic signs;
(three) hinder the normal life of residents, damage the city appearance or architectural image;
(four) the use of building glass curtain wall;
(five) the use of footbridges, railway overpasses and highway overpasses;
(six) in the construction control zone of kindergartens, schools, state organs, cultural relics protection units and scenic spots;
(seven) endangering the safety of buildings or using illegal buildings or dangerous houses;
(eight) the use of street trees or damage to green space, green landscape;
(9) Other circumstances prohibited by laws and regulations.
It is forbidden to set up the following forms of outdoor advertising:
(a) high column advertising, street advertising;
(two) the use of the top of the building to set up physical advertisements;
(3) Hanging curtains or posting, scribbling or portraying advertisements on the facade of buildings along the street;
(four) the use of hand-held mobile advertising in major roads and key areas. Chapter III Administration of Outdoor Advertising Article 8 Where a public carrier (including space, the same below) is used to set up a commercial outdoor advertisement, the right to use the carrier shall be obtained by auction. After the auction scheme is approved by the Municipal Radio and Television Management Committee, the urban management department (institution) of the district (development zone) or the relevant administrative departments shall entrust the municipal public resource trading center to auction in accordance with the relevant provisions; If the auction fails, the transaction shall be conducted in other ways as stipulated by relevant laws and regulations on public resources transaction.
Using non-public carriers to set up commercial outdoor advertisements, with the consent of the owner of the carrier, the urban management department (institution) of the district (development zone) will purchase and store the right to use the carrier through agreement and bring it into the auction scope.
The buyer who has obtained the right to use commercial outdoor advertising carrier by auction shall sign a contract for the right to use outdoor advertising carrier with the urban management department (institution) of the district (development zone) or relevant administrative departments on the strength of the transaction confirmation, and the municipal urban management department shall issue a license for setting up outdoor advertising. If outdoor advertising facilities need to be built, the buyer shall build them in accordance with the requirements stipulated in the contract and go through relevant formalities according to law.
