Xi Prohibition of posting and scribbling (revised in 2020)

Article 1 In order to maintain a clean and tidy city appearance and environment, and effectively control illegal acts of posting and scribbling, these Provisions are formulated in accordance with the Regulations of the State Council Municipality on the Administration of City Appearance and Environmental Sanitation and the Regulations of Xi Municipality on the Administration of City Appearance and Environmental Sanitation, combined with the actual situation of this Municipality. Article 2 The term "disorderly posting and scribbling" as mentioned in these Provisions refers to posting publicity materials, portraying, scribbling and spraying all kinds of information on roads, buildings, structures, trees, telephone poles or other facilities. Article 3 These Provisions shall apply to the administrative areas of New Town, beilin district, Lianhu District, Yanta District, weiyang district and Baqiao District of this Municipality. Article 4 The District People's Government and the Development Zone Management Committee shall take overall responsibility for the governance of posting and scribbling behaviors of civil strife in their respective jurisdictions. The urban management department of the District People's Government and the urban management organization of the Development Zone Administrative Committee will specifically implement the work of controlling chaotic posting and scribbling.

Sub-district offices and neighborhood committees (communities) have the responsibility and obligation to control posting and graffiti in this area.

The municipal urban management department shall strengthen the supervision and guidance on the management of posting and scribbling in the whole city.

Market supervision, public security and other departments at all levels should cooperate closely and do a good job in controlling chaotic posting and graffiti. Article 5 Posting advertisements shall comply with the provisions of the Regulations on the Administration of City Appearance and Environmental Sanitation of Xi and the Regulations on the Administration of Outdoor Advertising of Xi, and shall be posted in the advertisement posting column of the public announcement as required. Article 6 It is forbidden to post publicity materials, portray, scribble or spray all kinds of information on roads, buildings, structures, trees, telephone poles or other facilities. Seventh to encourage and support the reporting of disorderly posting and scribbling.

The local urban management department shall reward those who report and catch posting or scribbling on the spot. Article 8 The urban management department of the place where the perpetrator is arrested for posting or scribbling indiscriminately shall find out the unit or employer where the perpetrator belongs and punish him according to the provisions of Article 10 of these Provisions. Article 9 Street-facing organs, organizations, military units, enterprises, institutions and individual industrial and commercial households have the right to stop posting and scribbling in their environmental sanitation "Three Guarantees" responsibility areas, and should clean up all kinds of information and publicity materials posted and scribbled in their environmental sanitation "Three Guarantees" responsibility areas within 24 hours and restore them to their original state. Article 10 Whoever, in violation of the provisions of these Regulations, scribbles, depicts or hangs on buildings, public facilities and tree trunks without authorization shall be given a warning by the local urban management department, ordered to make corrections, and imposed a fine of 65.438 million yuan or more from 500 yuan.

Tools used for posting or scribbling shall be disposed of according to law.

Posting, scribbling, damage to related facilities, shall be ordered to compensate for the losses. Eleventh in violation of the provisions of article ninth of this Ordinance, can not be cleaned up within 24 hours, the local urban management department shall order it to make corrections within a time limit, and may impose a fine of more than 200 500 yuan on the responsible unit. The directly responsible person in charge and other directly responsible personnel shall be fined below 50 yuan. Article 12 If there are communication numbers in all kinds of information posted or scribbled, the local urban management department will take photos and collect evidence and send them to the telecommunication service unit, which will handle them according to law. If the contents involve forged documents, seals, bills and other illegal acts, the public security organs shall investigate and deal with them in accordance with relevant laws and regulations; If a crime is constituted, criminal responsibility shall be investigated according to law. Thirteenth posting and scribbling advertising content is illegal, and shall be punished by the market supervision and management department according to the Advertising Law of People's Republic of China (PRC). Fourteenth insult, assault, refusal, obstruction of administrative law enforcement personnel to perform official duties according to law, the public security organs shall be punished in accordance with the "People's Republic of China (PRC) National Public Security Management Punishment Law" and other laws and regulations; If a crime is constituted, criminal responsibility shall be investigated according to law. Fifteenth administrative law enforcement personnel do not perform their duties, abuse their powers, neglect their duties, engage in malpractices for selfish ends, shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Sixteenth yanliang district, Lintong District, Chang 'an District, Gaoling District, Huyi District and municipal counties can refer to these regulations. Seventeenth the provisions shall come into force as of February 6, 2005.
