Interim Measures of Fushun Municipality on Eliminating Four Pests

Chapter I General Provisions Article 1 In order to control the harm of vectors such as rats, flies, mosquitoes and cockroaches (hereinafter referred to as "four pests") and ensure people's health, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Infectious Diseases and the Regulations of Liaoning Province on Patriotic Health Management. Article 2 Eliminating the four pests is the obligation of every citizen, and all units and individuals within the administrative area of this Municipality shall abide by these measures. Article 3 patriotic health campaign committee offices at all levels (hereinafter referred to as Ivy's offices) shall, under the leadership of the people's governments at the corresponding levels, uniformly manage and coordinate the work of eliminating the four pests within their respective administrative areas. Article 4 In the work of eliminating the four pests, the principle of giving priority to prevention and comprehensive treatment shall be implemented, and the principle of combining the construction of professional teams with the participation of the masses, the participation of everyone and the participation of the whole society shall be implemented. Chapter II Organization and Management Article 5 The work of eliminating the four pests shall be governed by the principle of territorial management, and all units and residents shall obey the organization and leadership of their districts (counties), sub-district offices (towns) and neighborhood committees (village committees) to ensure that the work of eliminating the four pests in their own units and households reaches the standards prescribed by the state. Article 6 In the work of eliminating the four pests, the main responsibilities of Ivy's offices at all levels are:

(a) in accordance with the relevant laws, regulations, rules and technical standards, unified planning and deployment of the work of eliminating the four pests within their respective administrative areas;

(two) to coordinate, guide, supervise and assess the work of eliminating the four pests within their respective administrative areas;

(three) to carry out publicity and education to mobilize the whole society to participate in the activities of eliminating the four pests;

(four) to supervise and inspect the business and service activities related to the four pests, and to ban illegal acts. Seventh health and epidemic prevention stations at all levels are responsible for the implementation of technical guidance, scientific experiments and density monitoring. Article 8 Enterprises and institutions shall provide services and materials on the principle of "whoever benefits pays" and implement paid services. Chapter III Measures and Requirements Article 9 All localities and departments shall regularly organize residential areas and units under their jurisdiction to carry out the work of eliminating the four pests, implement various prevention and control measures, and conduct supervision and inspection to make the units under their jurisdiction generally meet the requirements of national standards. Tenth urban construction departments should improve and strengthen the prevention and control measures of four pests in urban public facilities such as garbage, feces collection and transportation system and drainage system. Eleventh real estate maintenance management departments and heating and gas supply departments should take effective measures to prevent and control the four pests of housing facilities and public pipelines. Twelfth enterprises and institutions should fully implement the prevention and control measures of the four pests, effectively control the density of the four pests, and meet the requirements of national standards. After detection, omission or improper prevention and control measures, the number of points for actual detection shall not exceed 10%, and the number of points for finding evidence of the survival, reproduction or harm of the four pests shall not exceed 5%. Article 13 The omission and impropriety of prevention and control measures in catering service industry shall not exceed 5% after detection, and the number of points for finding evidence of the survival, reproduction or harm of the four pests shall not exceed 2%. Article 14 An enterprise that produces and deals in drugs and devices for eliminating the four pests, or engages in paid services for eliminating the four pests, must ensure safety and effectiveness, and meet the corresponding norms and requirements. Chapter IV Awards and Penalties Article 15 Units and individuals that have made remarkable achievements in the work of eliminating the four pests shall be rewarded. Sixteenth in violation of the provisions of the third chapter of these measures, in addition to being ordered to take remedial measures, the following penalties are given respectively:

(a) found that there are rat holes, rat droppings, rat bite marks, which exceed the density stipulated by the state, each case will be fined 50 to 500 yuan, and those who exceed the standard will be fined by multiples, with a maximum fine of 3,000 yuan;

(two) aquaculture for more than three years, a fine of 50 to 500 yuan per box;

(three) in the planning area, garbage is scattered, septic tanks are uncovered or damaged, and third-instar fly larvae or pupae are bred, and each case is fined 50 to 500 yuan;

(four) food business units without fly prevention measures, fly density exceeds the standard, each fined 500 to 1000 yuan;

(five) hotels, hotels, nightclubs, bathing places, hospitals and eating places found that cockroaches or cockroaches eggs and pods exceeded the standard, and each case was fined 50 to 500 yuan. If the index is exceeded, it shall be fined by multiple times, with a maximum fine of 2000 yuan;

(six) units and individuals that distribute fake and shoddy products with four pests shall, in addition to the confiscation of illegal income and products, impose a fine of 0 to 2 times the illegal income; If the damage is serious, a fine of 10000 yuan may be imposed; If the circumstances seriously violate the criminal law, they shall be transferred to judicial organs for criminal responsibility;

(7) Units and individuals who distribute and use drugs banned by the state shall be investigated and dealt with by Ivy's offices at all levels in conjunction with the industrial and commercial and public security departments, and a fine of 500 to 3000 yuan shall be imposed according to the seriousness of the case; If the circumstances seriously violate the criminal law, they shall be transferred to judicial organs for criminal responsibility;

(eight) units and individuals engaged in paid services in addition to the four pests, due to poor quality of work, resulting in adverse consequences, can be fined 500 to 3000 yuan; If serious consequences are caused, a fine of 5000 yuan may be imposed. Seventeenth patriotic health supervisors to punish the parties, should produce documents, the use of the financial sector unified printing of the fine receipt, confiscation of income turned over to the finance at the same level. Eighteenth patriotic health supervision personnel should enforce the law impartially. Abuse of power for personal gain, the competent department should give criticism and education; The competent department shall give administrative sanctions to those who engage in malpractices for selfish ends and frame retaliation; If the case constitutes a crime, it shall be transferred to judicial organs for criminal responsibility.
