Measures of Shanghai Municipality on the Administration of Inland Waterways

Article 1 In order to strengthen the management of inland waterways in this Municipality, improve navigation conditions, ensure smooth navigation and safety, and give full play to the role of inland navigation in national economic construction, these Measures are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on the Administration of Inland Waterways and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to inland waterways, waterway facilities and navigation-related facilities that have been navigable and planned to be navigable in this Municipality. Article 3 The inland waterway as mentioned in these Measures refers to the waters in Hanoi where ships and rafts can pass. The change of waterway grade or waterway planning shall be proposed by the municipal transportation department in conjunction with the municipal planning and water conservancy department and implemented after being approved by the Municipal People's government. Article 4 Shanghai Municipal Bureau of Transportation (hereinafter referred to as the Municipal Bureau of Transportation) is the competent department of inland waterway in this Municipality, and its municipal and county inland waterway management agencies (hereinafter referred to as the ATC agencies) are specifically responsible for the planning, management and maintenance of inland waterway. Article 5 Special navigation channels and their navigation facilities shall be managed and maintained by specialized units, and shall be subject to the operational guidance of air traffic control agencies.

The front waters of docks and loading and unloading points are dredged and maintained by their users. Enterprises discharge sewage and waste water by themselves, causing shallow siltation of navigation channels, and the discharging unit shall be responsible for dredging. Article 6 The inland river development plan of this Municipality shall be determined according to the requirements of the overall planning of Shanghai and the principle of overall planning and comprehensive utilization of water resources.

The inland river development plan of this Municipality shall be compiled by the Municipal Transportation Bureau, audited by the municipal planning department and implemented after being approved by the Municipal People's Government.

City Transportation Bureau in the preparation of waterway development planning, there must be water conservancy, aquatic products, planning, port, municipal engineering and other relevant departments to participate.

Water conservancy, aquatic products, planning, port, municipal engineering and other departments must have air traffic control institutions at the same level to participate in the preparation of their own inland waterway related planning. Article 7 The construction of navigation-related facilities on inland waterways, water surfaces, underwater and shoreline in this Municipality must conform to the navigation standards and technical requirements stipulated by the state, and submit topographic maps and relevant design data to the air traffic control agencies for review in advance, and go through the examination procedures. Its projects include:

(1) Building wharves, revetments, slopes, houses, wharves, slideways, pumping stations, hydrological stations and culverts along the waterway;

(2) Building bridges, shiplocks, sluices, tunnels, aqueducts and temporary dams, and laying or erecting pipelines and cables on navigation channels;

(three) the construction of ferry, trestle, anchorage, wood (bamboo) field, animal husbandry;

(four) set up barges, fishing nets and rafts to cultivate aquatic plants;

(five) the construction of other buildings or facilities along the waterway and across the waterway.

The above facilities, involving land, planning, water conservancy, aquatic products, environmental protection, municipal engineering, public security and fire control departments, must also obtain the consent of the relevant competent departments and go through the corresponding procedures. Article 8 Surveying, dredging, salvaging, drilling, piling, flow measurement, blasting and other operations on the inland waterway of this Municipality shall be approved by the air traffic control agency in advance, in addition to going through the examination and approval procedures with the relevant departments as required. When necessary, the port and shipping supervision institution shall issue navigational warnings or navigational notices. Article 9 Navigation aids, ports, navigation aids and other waterway facilities in inland waterways of this Municipality are protected by the state, and no unit or individual may occupy, destroy or obstruct them. The local people's governments, public security departments and shipping units shall assist air traffic control agencies in their protection work. Article 10 In order to ensure the smooth passage of navigation channels, the following acts of occupying navigation channels, affecting or destroying navigation conditions are prohibited:

(a) the beach filling occupies the waterway;

(two) dumping mud, sand, garbage and waste into the river;

(3) Pile up soil, dig pits and plant loose soil plants on the slopes and green ridges on both sides of the waterway, or pile up garbage and slippery goods on the shore.

The local people's governments and relevant units shall assist the air traffic control agencies to stop the above acts. Eleventh cities and counties prohibit the construction of new fixed nets and river fishing nets on the main waterways; Before the implementation of these measures, the waterway institution shall, in conjunction with the fishery administration institution, properly handle it under the principle of ensuring the smooth waterway. Fishing nets and sales erected on non-main channels shall not affect the normal navigation of ships.

The water outlet height of fishing net shall not be less than 0.2m above the standard clearance height of navigation channel. The net width of the fishing pin gate shall not be less than three times the maximum ship width allowed by the channel planning level, of which the six-level channel shall not be less than three and a half times. If the waterway planning level is inconsistent with the present situation, the net width of the fishing gate should be determined according to the present situation. Twelfth cities and counties prohibit the cultivation of aquatic plants in major waterways. When planting aquatic plants in non-main waterways, water areas must be set aside to ensure the safety of navigation. Its width: more than 30 meters for the six-stage channel; Eighteen meters above the seven-level waterway; The eighth-class waterway is more than thirteen meters. Thirteenth overhead cables crossing the waterway shall be provided with clearly marked protection lines 30 meters to 50 meters upstream and downstream.

According to the situation of navigable ships in the waterway, the clearance height of the protective line can be divided into three categories: the first type of protective line shall not be less than 23.5 meters (without the consent of the air traffic control agency); Two types of protection line shall not be less than fourteen meters; The third type of protection line shall not be less than eight meters.

The clearance height of the protection line refers to the vertical distance from the highest local water level to the lowest sag point of the protection line. The clearance height of the cable should be higher than the protection line, and there is a specified vertical safety spacing.
