Article 2 The drugs referred to in these regulations refer to opium, heroin, methamphetamine (methamphetamine), morphine, marijuana, cocaine and other narcotic drugs and psychotropic drugs controlled by the state that can cause humanoid addiction. Article 3: To punish drug-related crimes, we should adhere to the principle of comprehensive management and implement the principles of combining specialized agencies with the mass line, and combining punishment with education. Poison must be eliminated, drug trafficking must be punished, drug cultivation must be investigated, and drug use must be stopped. Article 4 People's governments at or above the county level are responsible for organizing and coordinating drug control work within their respective administrative regions; the public security organs are the competent departments for drug control work. Article 5: The People's Procuratorate, People's Court, and judicial administrative organs must strictly perform their respective statutory duties in anti-drug work.

Relevant units and departments such as medicine, health, civil affairs, industry and commerce, chemical industry, customs, civil aviation, railways, ports, transportation, publicity, education, as well as township (town) people's governments and street management offices are engaged in anti-drug work. Everyone should take their own responsibilities, implement prevention, management, education and other measures, and actively participate in anti-drug work.

State agencies, social groups, enterprises and institutions, as well as villagers’ committees and residents’ committees are responsible for drug control in their own jurisdictions, systems and units, carry out drug control publicity and education, and cooperate in drug control work.

Citizens have the obligation to report and expose drug-related crimes. Article 6 Anyone who commits smuggling, selling, transporting, manufacturing drugs, illegal possession of drugs, or other violations of anti-drug laws and regulations and constituting a crime shall be investigated for criminal liability in accordance with the law. Article 7 It is strictly prohibited to illegally cultivate opium poppy or other narcotic plants. Anyone who illegally grows less than 500 opium poppies or other narcotic raw plants in small quantities shall be detained by the public security organs for a period of not more than 15 days and may also be fined not more than 3,000 yuan; for illegally planted narcotic raw plants, the township (town) people's government and the public security bureau shall The authorities forcibly eradicated them. Growers who voluntarily eradicate illegally grown drug-producing plants before harvesting will be exempted from punishment. Article 8: No one is allowed to illegally possess drugs. Anyone who illegally possesses less than 200 grams of opium, less than 10 grams of heroin, or other small amounts of drugs shall be detained by the public security organs for not more than 15 days and may be fined not more than 2,000 yuan.

Those who commit the acts in the preceding paragraph and voluntarily hand over illegally held drugs to the public security organs may be given a lighter, reduced or exempted punishment. Article 9 It is prohibited to illegally transport, trade, store and use poppy shells. Violators will have their illegal poppy shells confiscated and be detained for not more than 15 days, and may also be fined not more than 3,000 yuan.

If poppy shells, poppy seeds and other drugs are mixed with food, drinks and other food for sale, the public security organs will impose a fine of not less than 10,000 yuan but not more than 10 yuan, and may be ordered to suspend business for one to three months. ; The person in charge and other responsible personnel directly responsible for the unit shall be fined not less than 5,000 yuan but not more than 10,000 yuan. If corrections are still not made after rectification, the landscape management personnel and other directly responsible personnel who are directly responsible for the owner and the unit may be subject to reeducation through labor. Article 10 Anyone who smokes or injects drugs shall be detained by the public security organs for not more than 15 days, and may be fined not more than 2,000 yuan by the unit or concurrently.

Those who are addicted to taking or injecting drugs shall, in addition to being punished in accordance with the provisions of the preceding paragraph, be sent to a drug rehabilitation center for compulsory detoxification, treatment, and education. Those who take or inject drugs after compulsory abstinence may be subject to reeducation through labor and forced abstinence during reeducation through labor. Compulsory drug detoxification measures are implemented in accordance with the "Compulsory Drug Detoxification Measures" of the State Council.

Those who take or inject drugs voluntarily register with the public security organs and voluntarily detoxify from drugs shall be exempted from punishment.

Article 11 Anyone who has one of the following circumstances that is not sufficient to pursue criminal responsibility or constitutes a crime but is not subject to criminal responsibility according to law shall be subject to reeducation through labor and shall be fined not less than RMB 2,000 but not more than RMB 10,000 by the public security organ:

(1) Illegal possession of drugs;

(2) Illegal cultivation of opium poppy and other drug raw plants;

(3) Providing others with drugs and equipment for smoking and injecting drugs

(4) Illegal trading and transportation of poppy husks, poppy seeds, poppy seedlings and other original drug plant seeds or seedlings;

(5) Forcing or inducing others to collect Giving or injecting state-controlled narcotic drugs and psychotropic drugs.
