Regulations of Shanxi Province on the Promotion of Charity

Chapter I General Provisions Article 1 In order to regulate charitable activities, protect the legitimate rights and interests of participants in charitable activities, promote charitable culture and promote the healthy development of charitable undertakings in our province, these Regulations are formulated in accordance with the Charity Law of the People's Republic of China and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to natural persons, legal persons and unincorporated organizations within the administrative area of this province to carry out charitable activities and charity-related activities. Article 3 People's governments at all levels and their relevant departments shall take measures to encourage and support natural persons, legal persons and unincorporated organizations to practice socialist core values and carry out charitable activities according to law. Article 4 Charity activities shall follow the principles of legality, voluntariness, honesty and non-profit, and shall not violate social morality, endanger national security, harm social public interests or the legitimate rights and interests of others. Article 5 The week of "China Charity Day" held on September 5th every year is "Shanxi Charity Publicity Week". Article 6 The civil affairs department of the people's government at or above the county level shall, jointly with relevant departments, formulate a work plan for charity publicity, and organize, guide and coordinate relevant units to carry out charity publicity activities.

Radio, television, newspapers, internet and other media should publicize charity activities, popularize charity knowledge, spread charity culture and carry forward the traditional virtues of the Chinese nation. Chapter II Safeguards Article 7 The people's governments at or above the county level shall incorporate the development of charity into the national economic and social development plan and include the funds for the development of charity in the fiscal budget at the same level. Eighth people's governments at or above the county level shall establish and improve the organization and coordination mechanism of charity work to solve the problems in the development of charity. Article 9 The civil affairs departments of the people's governments at or above the county level shall be in charge of charitable work within their respective administrative areas.

The relevant departments of the people's governments at or above the county level, trade unions, the Communist Youth League, women's federations, the Red Cross, the Federation of Industry and Commerce, the Federation of Disabled Persons and other organizations shall do a good job in relevant work within their respective functions and duties.

Township (town) people's government, street offices with the civil affairs departments and other relevant departments to do charity related work.

Villagers' committees and residents' committees shall cooperate with charity-related work. Article 10 Guidance institutions for spiritual civilization construction at or above the county level shall incorporate charitable culture construction into the socialist spiritual civilization construction plan, and incorporate charitable activities into the assessment content of mass spiritual civilization creation activities such as civilized cities, civilized villages and towns, and civilized units. Eleventh people's governments at all levels and their relevant departments shall support qualified charitable organizations to provide services to the society by purchasing services. Twelfth people's governments at or above the county level and their relevant departments can support the development of charitable organizations in the initial stage through personnel training, project guidance, provision of office space and financial support. Article 13 The civil affairs department of the people's government at or above the county level shall establish a linking mechanism between charity and social assistance, realize information sharing between the civil affairs department and other social assistance management departments and information exchange with charitable organizations, and promote the rational allocation of charitable resources. Fourteenth social assistance stations (points), community service centers, etc. shall provide convenient conditions for natural persons, legal persons and unincorporated organizations to carry out charitable activities and charity-related activities. Fifteenth schools and other educational institutions should incorporate charity culture into the content of education and teaching, spread charity knowledge, impart charity ideas, cultivate charity awareness, and encourage young people to participate in charity activities within their capabilities.

Support institutions of higher learning, scientific research institutions and charitable organizations to cooperate, carry out charitable theoretical research, establish charitable talent training bases and practical training bases, and train charitable professionals. Article 16 Charitable organizations that need land for charitable service facilities to carry out charitable activities such as helping the poor, helping the needy, helping the elderly, saving orphans, loving the sick, helping the disabled and giving special care to the disabled may apply for state-owned allocated land or rural collective construction land according to law.

Without legal procedures, the land for charitable service facilities shall not be changed. Seventeenth charitable organizations from the time of registration or recognition, can apply to the financial sector for public welfare donations with the registration certificate indicating the nature of charitable organizations. Article 18 The civil affairs department of the people's government at or above the county level shall, jointly with the financial department and the tax department, jointly confirm the pre-tax deduction qualification of charitable organizations' public welfare donations according to the results of daily supervision and inspection and the charitable activities and credit records of charitable organizations, and make an announcement to the public. Nineteenth civil affairs departments of people's governments at or above the county level shall support charitable organizations to set up trade organizations according to law.

Charity industry organizations should establish and improve industry norms, strengthen self-discipline of charity industry, improve the credibility of charity industry, and promote the standardized development of charity. Chapter III Awards Article 20 The Shanxi Charity Award established by the provincial people's government shall be commended once every two years.

The people's governments of cities and counties (cities, districts) with districts shall, in accordance with the relevant provisions of the state and the province, commend natural persons, legal persons and unincorporated organizations that have made outstanding contributions to the development of charity.

Individuals who have been commended and rewarded by the people's governments at or above the county level for charitable causes, and whose personal or family life is in difficulties, shall be given priority by the civil affairs departments or charitable organizations. Twenty-first non-profit schools run by charitable organizations and places that provide social services such as maintenance, rehabilitation and trusteeship for the elderly, disabled people and children in distress shall implement the living price of residents.
