The hospital said that 19 of them had symptoms of poisoning, and dozens of others requested hospitalization mainly because of psychological influence.

Case 1 (Traffic Accident)

In short, the school has no fault and no mistakes in its work in this injury incident, so it does not agree with the plaintiff's claim. In addition, the plaintiff has been compensated for most of the medical expenses in the insurance company through the defendant, and the actual expenditure of the plaintiff is less than 1, yuan.

Since then, the two sides failed to negotiate on the responsibility and compensation for the accident, and the plaintiff filed a lawsuit.

Analysis

Parents, grandparents and other parents of minor students are legal guardians of minor students, and the relationship between schools and minors is education, management and protection. After minors enter schools, schools should fulfill the obligation to protect the personal safety of minor students. In this case, during the free time after class, the plaintiff accidentally fell off the sports equipment with warning signs and no potential safety hazards, causing injuries. The school could not foresee and avoid the consequences, and the defendant provided safety education to students in various forms in the daily education and management process, and set up safety institutions and supervision posts to prevent accidents. Therefore, there is no causal relationship between the plaintiff's damage consequences and the school's management behavior. The plaintiff also had no favorable evidence to prove that the defendant was at fault in this injury incident, and the defendant sent the plaintiff to the hospital for treatment in time after the incident, which avoided the expansion of the loss and fulfilled the obligation of education, management and protection. Therefore, the plaintiff sued for compensation, which had no legal and factual basis and was not supported according to law. According to Article 17 of the General Principles of the People's Republic of China and the Civil Law of the People's Republic of China, the court ruled as follows:

The plaintiff's claim for compensation from a primary school in Lianhu District of Xi 'an was rejected. The legal costs of 733 yuan shall be borne by the plaintiff.

Cases of campus fire accidents
