Legal basis: Article 338 of the Criminal Law of the People's Republic of China and the People's Republic of China violates state regulations by discharging, dumping or disposing of radioactive waste, waste containing infectious disease pathogens, and toxic substances or other harmful substances, seriously polluting the environment, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall also or solely be fined; if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years, and shall also be fined; whoever falls under any of the following circumstances , shall be sentenced to fixed-term imprisonment of not less than seven years and shall also be fined: (1) Discharging, dumping, or disposing of radioactive waste or containing infectious disease pathogens in key protection areas determined by law such as drinking water source protection areas and core protection areas of nature reserves. Waste and toxic substances, if the circumstances are particularly serious; (2) Discharging, dumping, and disposing of radioactive waste, waste containing infectious disease pathogens, and toxic substances into important rivers and lakes designated by the state, and the circumstances are particularly serious; (3) Causing a large amount of permanent basic farmland to lose its basic functions or suffering permanent damage; (4) Causing multiple people to be seriously injured or seriously ill, or causing severe disability or death. If the conduct in the preceding paragraph is committed and constitutes other crimes at the same time, the offender shall be convicted and punished in accordance with the provisions on heavier penalties.
