Regulations of Hengyang Municipality on the Administration of City Appearance and Environmental Sanitation

Chapter I General Provisions Article 1 In order to strengthen the administration of city appearance and environmental sanitation and create a civilized, beautiful and livable city environment, these Regulations are formulated in accordance with the provisions of the Regulations on the Administration of City Appearance and Environmental Sanitation, the Regulations on the Comprehensive Administration of Cities in Hunan Province and the actual situation of this Municipality. Article 2 These Regulations shall apply to the urban built-up areas within the administrative area of this Municipality and the urbanization management areas delineated and announced by the people's governments of cities and counties (cities, districts). Third city appearance and environmental sanitation work adhere to the principles of unified leadership, hierarchical management, district responsibility, people-oriented, and public participation. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over the work of city appearance and environmental sanitation, incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan, include the necessary funds in the fiscal budget, strengthen the infrastructure construction of city appearance and environmental sanitation, and promote the grid, digital and refined management of city appearance and environmental sanitation. Article 5 The urban management department of the people's governments of cities and counties (cities, districts) shall be responsible for the management of city appearance and environmental sanitation within their respective administrative areas, exercise the power of administrative punishment as stipulated in these Regulations, and implement administrative compulsory measures related to the power of administrative punishment. In areas where comprehensive administrative law enforcement is implemented, the comprehensive administrative law enforcement department shall exercise the power of administrative punishment and implement administrative compulsory measures.

The urban management department of the city is responsible for guiding, coordinating, supervising and assessing the work of the urban management department of the county (city, district), investigating and dealing with trans-regional and major and complicated cases, and sending law enforcement agencies or personnel to the urbanization management areas designated by the industrial parks and the Municipal People's Government to carry out law enforcement work.

The urban management department of a county (city, district) may, according to needs, send law enforcement agencies or law enforcement personnel to the areas designated by the people's government of a township (town), the subdistrict office and the urbanization management department of the people's government of a county (city, district) to carry out law enforcement work.

City, county (city, district) people's governments and other relevant departments, as well as township (town) people's governments and sub-district offices shall, according to their respective responsibilities, do a good job in the management of city appearance and environmental sanitation. Article 6 Departments of urban management, education, culture, news, health and family planning, as well as management units of airports, stations, gymnasiums and other public places, should strengthen publicity and education on laws and regulations on city appearance and environmental sanitation, and enhance citizens' awareness of city appearance and environmental sanitation.

The people's governments of cities and counties (cities, districts) shall reward the units and individuals that have made remarkable achievements in the work of city appearance and environmental sanitation. Seventh any unit or individual shall respect the work of city appearance and environmental sanitation workers, and shall not hinder or obstruct them from performing their duties.

City and county (city, district) people's governments shall, in light of local conditions, take measures to gradually improve the wages and welfare benefits of environmental sanitation workers. Eighth any unit or individual has the right to discourage, complain and report acts that violate the regulations on the administration of city appearance and environmental sanitation and damage the city appearance and environmental sanitation.

Encourage units and individuals to participate in city appearance and environmental sanitation volunteer services and public welfare activities, and encourage and guide social capital to participate in city appearance and environmental sanitation.

Advocate community residents' committees, villagers' committees and owners' committees to formulate management conventions for maintaining city appearance and environmental sanitation, mobilize residents to participate in city appearance and environmental sanitation management, and implement autonomous management of city appearance and environmental sanitation. Chapter II System of City Appearance and Environmental Sanitation Responsibility Zone Article 9 The city appearance and environmental sanitation management adopts the system of responsibility zone, and the responsible person is responsible for the city appearance and environmental sanitation work within the responsibility zone, which is supervised and managed by the city management department. Tenth city appearance and environmental sanitation responsibility area and responsible person shall be determined in accordance with the following provisions:

(1) Public areas such as urban roads, bridges, streets, underpasses, public toilets, bus stops, pedestrian overpasses, squares, urban public green spaces, river waters and coastal scenic spots shall be managed by urban management departments;

(two) the implementation of property management in residential areas, responsible for the signing of property service contracts; Residential areas without property management shall be the responsibility of community residents' committees and villagers' committees;

(3) Shopping malls, supermarkets, bazaars, hotels, restaurants, newsstands, exhibition venues, parks, artificial lakes and other places, as well as airports, stations, docks, parking lots, highways, railways and other areas, shall be the responsibility of operators or managers;

(4) Areas under the administration of organs, organizations, enterprises and institutions. , responsible for the unit;

(five) the land to be built for which the land use right has been clearly defined shall be the responsibility of the land use right holder or manager; The construction unit is responsible for the construction site. Unable to determine the construction unit, the construction unit is responsible for;

If the responsible area or person is not clear, it shall be determined by the municipal or county (city, district) urban management department in conjunction with the township (town) people's government and street offices; The area of responsibility across administrative regions shall be determined by the city management department at the next higher level. Eleventh city appearance and environmental sanitation responsible person shall perform the following duties:

(a) to keep the city clean and tidy in the area of responsibility, without disorderly building, stacking, setting up stalls, parking, posting, scribbling, depicting and hanging;

(two) to keep the environment in the area of responsibility clean and tidy, without exposing garbage, feces, sewage, odor and other phenomena;

(three) in accordance with the provisions of the environmental sanitation facilities, keep clean and in good condition;

(four) the city appearance and environmental sanitation responsibilities agreed with the city management department;

(five) other city appearance and environmental sanitation responsibilities as stipulated by laws, regulations and rules.
