Safety Management Rules for Civil Aviation Air Traffic Management Operating Units (20 16)

Chapter I General Provisions Article 1 In order to standardize the safety supervision and management of operating units of civil aviation air traffic management (hereinafter referred to as civil aviation air traffic control), reduce air traffic safety risks, improve the safety level of air traffic operation, and ensure flight safety, in accordance with the People's Republic of China (PRC) Safety Production Law, the People's Republic of China (PRC) Civil Aviation Law, the Basic Flight Rules of the People's Republic of China and other laws and regulations. Article 2 Units and individuals engaged in civil aviation air traffic services, aviation information services, communication, navigation and monitoring services and aviation meteorological services within the territory of People's Republic of China (PRC) (hereinafter referred to as civil aviation air traffic control operation units) shall abide by these Rules.

The civil aviation air traffic control operation units mentioned in these Rules include the Air Traffic Management Bureau of the Civil Aviation Administration of China and its subordinate regional air traffic management bureaus, air traffic management sub-bureaus, air traffic management stations, airport management institutions and their subordinate civil aviation air traffic control operation departments. Article 3 The safety management of civil aviation air traffic control operation units shall adhere to the working principles of safety first, prevention first and comprehensive management. Article 4 The Civil Aviation Administration of China (hereinafter referred to as CAAC) is responsible for supervising and managing the safety management of civil aviation air traffic control throughout the country, and the Regional Administration of Civil Aviation (hereinafter referred to as Regional Administration) is responsible for supervising and managing the safety management of civil aviation air traffic control in its own region. Article 5 A civil aviation air traffic control operation unit shall be responsible for organizing and implementing the safety management of its own civil aviation air traffic control operation. Article 6 Civil aviation air traffic control safety management shall implement the system of accountability for safety accidents, and those responsible for safety accidents shall be held accountable in accordance with relevant laws, regulations and these Rules. Article 7 The CAAC encourages and supports the scientific and technological research, the popularization and application of advanced technologies and advanced management methods in the safety management of civil aviation air traffic control, and improves the safety management level of civil aviation air traffic control. Chapter II Institutions and Personnel Article 8 The Civil Aviation Administration is responsible for uniformly formulating policies, regulations and standards for the safety management of air traffic control, formulating safety work plans, determining safety management objectives, organizing the implementation of air traffic control safety audits, guiding and supervising the construction of air traffic control safety management system, and supervising, inspecting and guiding the implementation of air traffic control safety work and safety management measures. Article 9 The Regional Administration Bureau shall be responsible for supervising and inspecting the implementation of the policies, regulations, rules and standards of civil aviation air traffic control safety management by air traffic control operating units in the region; Supervise and inspect the implementation of safety work planning and safety management measures, the implementation of safety management objectives and the construction of safety management system, supervise and inspect the safety assessment of civil aviation air traffic control operation units, and undertake the safety audit of civil aviation air traffic control. Article 10 A civil aviation air traffic control operation unit shall implement the policies, regulations, rules and standards of air traffic control safety management, implement the safety work plan and safety management objectives, establish and improve the safety management system, regularly check the operation status of the unit, regularly evaluate the safety status, organize the implementation of safety management measures, and collect, count and analyze the safety information of the unit. Formulate and implement rectification measures for unsafe air traffic control incidents, formulate the safety training plan of the unit, and organize safety production education and training. Organize and implement the safety assessment of civil aviation air traffic control; Report the safety status and information of the unit as required. Article 11 A civil aviation air traffic control operation unit shall set up an operation safety management department or be equipped with safety management personnel according to the following requirements.

(1) If the number of employees exceeds 150 (inclusive), a special safety management department shall be established;

(2) If the number of employees is less than 150, full-time safety management personnel shall be set up according to the ratio of not less than 50 1;

(3) If there are less than 50 employees, there should be at least one full-time or part-time safety manager.

The safety management department or personnel of the air traffic control operation unit of civil aviation shall be responsible for the organization and implementation of the safety management system of the unit. Article 12 The principal responsible person of a civil aviation air traffic control operation unit shall be fully responsible for the operation safety management of the unit, and organize the implementation of the following safety management work:

(a) to establish and improve the responsibility system for production safety in this unit;

(two) to organize the formulation of rules and regulations and operating procedures for the safety management of the unit;

(three) to ensure the safety management investment of the unit;

(four) to supervise and inspect the safety management of the unit, and eliminate the hidden dangers of the operation of civil aviation air traffic control in a timely manner;

(five) to organize the formulation and implementation of the emergency plan of the unit;

(six) timely and truthfully report the unsafe incidents of civil aviation air traffic control. Article 13 A civil aviation air traffic control operation unit shall advocate a positive safety culture, strengthen the publicity of civil aviation air traffic control laws, regulations, rules, standards and safety knowledge in various forms, fully inform employees of safety risks, educate and urge employees to strictly abide by safety production rules and regulations, implement operating procedures, and improve employees' safety awareness. Fourteenth civil aviation air traffic controllers, aviation intelligence officers, aviation telecommunications personnel, aviation meteorologists and other professionals should obtain the corresponding professional licenses in accordance with the relevant provisions, and keep them valid.

When the employees listed in the preceding paragraph are physically unfit to perform their duties, they should take the initiative to report to their units, and the civil aviation air traffic control operation units should adjust their posts in time. Fifteenth employees of civil aviation air traffic control operation units should obey the safety management, strictly abide by the safety production rules and regulations and operating procedures of the unit, and have the right to refuse illegal operations.

Employees have the obligation to make suggestions on the safety management of civil aviation air traffic control, and report to the safety management department or safety management personnel immediately if they find potential safety hazards or other unsafe factors.
