1. The criminal evidence has not been mastered by the discipline inspection and supervision organs, or it has been mastered but has not been examined and investigated by the discipline inspection and supervision organs;

2. Take the initiative to surrender to the discipline inspection and supervision organ when the discipline inspection and supervision organ does not have evidence of the crime, or when it has not been questioned, examined, investigated or interrogated by the discipline inspection and supervision organ or has not taken lien measures.

Surrender as mentioned in these Provisions refers to:

(1) party member and the object under supervision are suspected of violating discipline, violating duty or committing duty crimes, and have not been mastered by the discipline inspection and supervision organs, or have not been examined and investigated by the discipline inspection and supervision organs, interrogated or taken lien measures, and voluntarily surrendered to the discipline inspection and supervision organs;

(2) The person involved in the case is suspected of accepting bribes, violating the same duty or the duty crime has not been mastered by the discipline inspection and supervision organ, or has not been inquired, examined or investigated by the discipline inspection and supervision organ, or has not taken lien measures and voluntarily surrendered himself to the discipline inspection and supervision organ.
