What does it mean to replace "two regulations" with lien?

The report of the 19th National Congress of the Communist Party of China, which replaced the "two regulations" with lien, put forward that a national supervision law should be formulated, and the supervisory committee should be given the responsibility, authority and investigation means according to law, and the "two regulations" should be replaced with lien.

Then what is a lien?

Lien is a severe measure to investigate and collect evidence of public officials' duty violations and duty crimes, which involves the personal freedom of the investigated person. The objects that can be used as lien measures are the investigated persons suspected of serious duty violations or duty crimes such as corruption and bribery, dereliction of duty and dereliction of duty, and the persons involved in bribery or duty crimes, which are essentially different from the "lien" in property law and police law. Its predecessor is "double regulations" and "double fingers" (concepts in 1997 Administrative Supervision Law). The "double regulations", that is, the "two regulations" mentioned in the title, refers to an investigation method in which China's discipline inspection organs order relevant personnel to explain and explain the problems involved in the case at a specified time and place.

Why use lien instead of "two rules"? It is an inevitable requirement to use the rule of law thinking and the rule of law to fight corruption. The national supervision law to be formulated soon will make strict legal provisions on the examination and approval procedures, applicable objects, applicable conditions, the time limit for taking measures, and even the safety and medical care in the investigation process, which is of great significance to further promote the standardization and legalization of anti-corruption work.

Relevant regulations: Article 22 of the Supervision Law of People's Republic of China (PRC) City, the investigated person is suspected of serious duty violations or duty crimes such as corruption, bribery and dereliction of duty, and the supervisory organ has mastered some facts and evidence of illegal crimes, but there are still important issues that need further investigation, and in any of the following circumstances, with the approval of the supervisory organ, he can be detained in a specific place according to law: (1) The investigated person is suspected of serious duty violations or duty crimes such as corruption, bribery and dereliction of duty;

Involving major and complicated cases;

(two) may escape or commit suicide;

(three) may collude or forge, conceal or destroy evidence;

(four) there may be other acts that hinder the investigation.

The supervisory organ may, in accordance with the provisions of the preceding paragraph, take lien measures against persons involved in bribery crimes or crimes with the same position.

The establishment, management and supervision of the lien place shall be implemented in accordance with the relevant provisions of the state.

In a word, lien replaces the "two regulations", ending the 23-year history of the "two regulations", realizing the docking of party discipline and state law, and marking the new realm of standardization and rule of law in the anti-corruption work led by the party.
