Provisions on internal structure and staffing

According to the institutional reform plan of the State Council approved by the first session of the 11th National People's Congress and the Notice of the State Council on Institutional Establishment (Guo Fa [2008]11No.), the Ministry of Railways was established as a component of the State Council.

I. Adjustment of responsibilities

(1) Actively promote the reform of the railway system. It should not only be conducive to railway development, maintain the integrity of the road network, maintain centralized and unified transportation command, ensure transportation safety, and improve transportation efficiency and benefit, but also realize the separation of government and enterprise, establish and improve the modern enterprise system, improve the corporate governance structure, and realize the diversification of investment subjects. Put forward the railway system reform plan and supporting policies during the term of this government, and actively promote it.

(two) to cancel the administrative examination and approval items that have been cancelled in the State Council.

(three) continue to separate social management responsibilities, and hand over the management responsibilities of railway secondary technical schools, primary and secondary schools, kindergartens and hospitals to local people's governments.

(4) Strengthen the supervision and management of railway operation guarantee, production safety, construction engineering quality, transportation service quality and emergency rescue responsibility, and continuously improve the service quality, efficiency and safety level of railway passenger and freight transportation.

Second, the main responsibilities

(a) to organize the formulation of railway industry development strategies and policies, formulate railway development plans, prepare the national annual railway plan, and participate in the preparation of comprehensive transportation system plans. To study and put forward the railway system reform plan and relevant supporting policy suggestions.

(two) to organize the drafting of railway industry laws and regulations, formulate departmental rules and supervise the implementation. To undertake relevant administrative licensing and law enforcement supervision according to law.

(three) to undertake the responsibility of supervision and management of railway safety production and transportation service quality. Unified management of railway transportation organization and centralized dispatching and command work, formulate industry standards for railway transportation service quality and supervise their implementation, standardize the railway transportation market, and coordinate and guide the work of joint-venture railways and local railways.

(four) according to the supervision and management of railway state-owned assets, management of state-owned railway enterprises performance evaluation.

(five) responsible for the national railway financial work. Manage railway construction funds and state railway funds according to regulations. To undertake the related work of railway freight rate management according to law.

(six) to undertake the responsibility of quality supervision and management of railway construction projects. According to the regulations, formulate relevant systems for railway engineering construction and organize their implementation, organize and manage the construction of large and medium-sized railway projects, and maintain the order of equal competition in the railway construction industry.

(seven) to study and put forward opinions on the scale and direction of national railway fixed assets investment and the arrangement of national financial funds, and to examine and approve fixed assets investment projects within the scale of national plans and annual plans in accordance with the authority prescribed by the State Council.

(eight) to formulate technical policies, standards and management regulations for the railway industry, organize the research and application promotion of major new technologies and new products, and organize scientific and technological cooperation and exchange, technology introduction and digestion and absorption. Responsible for railway technical supervision, environmental protection and energy conservation and emission reduction according to law.

(nine) responsible for railway special transportation, special transportation and public security work.

(ten) responsible for the railway industry statistics, information, emergency and national defense mobilization.

(eleven) responsible for the national railway health and epidemic prevention management, the implementation of railway health supervision according to law.

(twelve) responsible for railway foreign affairs, international economic exchanges and cooperation and international intermodal transport, and managing railways involving Hong Kong, Macao and Taiwan.

(thirteen) to undertake other tasks assigned by the State Council.

Third, internal institutions.

According to the above responsibilities, the Ministry of Railways has internal organs 1 1:

(1) general office.

Organize the drafting of important documents and reports; Responsible for messages, documents, information, confidentiality, letters and visits, duty, news release, emergency management, agency finance and other work; Responsible for the coordination of the daily work of the organ.

(2) Policy and Regulation Department.

Conduct comprehensive policy research on railway reform and development; Organizing the drafting of draft laws and regulations on the railway industry; To study and put forward the railway system reform plan and relevant supporting policy suggestions, and organize and guide the deepening reform of the railway; Undertake railway administrative law enforcement supervision, administrative reconsideration, administrative litigation and legal publicity and education; To undertake the related work of railway administrative licensing; Undertake the performance appraisal of national railway enterprises; To undertake the legality review of relevant normative documents of this organ.

(3) Development Planning Department.

To formulate the development plan of the railway industry; To study and put forward suggestions on the scale and direction of railway fixed assets investment, and formulate the annual national railway plan; To undertake the examination, approval and audit of fixed assets investment projects and foreign capital utilization of national railways within the scale of national plans and annual plans; Undertake railway national defense mobilization, environmental protection, energy conservation and emission reduction and other related work; Coordinate and guide the work of joint-venture railways and local railways.

(4) the finance department.

To undertake the supervision and management of national railway finance and railway state-owned assets; To formulate provisions on the management and liquidation of railway transportation income; To undertake the work related to railway construction fund and national railway fund management; To study and put forward suggestions on the financial arrangement of railway countries.

(5) Science and Technology Department.

To formulate railway science and technology development plans, policies, standards and management regulations; To undertake railway technical supervision according to law; Organize the research and application promotion of major new technologies and products; Organize scientific and technological cooperation and exchange, technology introduction and digestion and absorption.

(6) personnel department.

To undertake the personnel management of the national railway system; Manage the leading bodies and staff of subordinate units; Recommend relevant candidates representing the national railway to the joint venture railway company according to law.

(7) Ministry of Labor and Health.

Comprehensively manage the labor wages, organization establishment, staff education and health and epidemic prevention work of the national railway system; Prepare the total wage plan; Carry out railway health supervision according to law; Guide the employment of the national railway system.

(8) Construction Management Department.

To formulate railway engineering construction standards, cost standards, norms and regulations; To undertake the supervision and management of railway engineering construction bidding, contract performance, engineering quality and safety production; Organize and manage the construction of large and medium-sized railway projects.

Department of International Cooperation (Hong Kong, Macao and Taiwan Office).

To undertake railway foreign affairs, international economic exchanges and cooperation and international intermodal transport, and undertake cooperation and exchanges with Hong Kong, Macao and Taiwan.

(10) Safety Supervision Department.

Formulate rules and regulations for railway safety supervision and management. Supervise and manage railway transportation safety, labor safety, special equipment safety and labor protection; Participate in the investigation and handling of railway traffic accidents according to law; Manage railway transportation safety supervision and administrative law enforcement.

(1 1) Public Security Bureau.

To undertake the work in railway police and manage railway public security and criminal cases according to law. Organize and manage the safety and security work of special railway transportation and special transportation. Guide the comprehensive management of railway public security. The Public Security Bureau is listed in the sequence of the Ministry of Public Security and is under the dual leadership of the Ministry of Railways and the Ministry of Public Security. Party and government work is mainly led by the Ministry of Railways, and public security work is mainly led by the Ministry of Public Security.

The political department is responsible for the ideological and political work of the national railway system and the construction of the workforce. It consists of an office (with two brands for an institution of the General Office of the Ministry), an organization department (with two brands for an institution of the Personnel Department of the Ministry) and a propaganda department.

The Commission for Discipline Inspection is responsible for the discipline inspection of the national railway system.
