Regulations on banning disposable non-degradable plastic products in Hainan Special Economic Zone

Article 1: In order to prevent and control pollution from disposable non-degradable plastic products, protect and improve the environment, and promote the construction of the national ecological civilization pilot zone, these regulations are formulated in accordance with the provisions of relevant laws and regulations and in combination with the actual situation of this special economic zone. Article 2 The production, transportation, sale, storage and use of the following disposable non-degradable plastic bags, plastic tableware and other plastic products are prohibited within this special economic zone:

(1) Containing non-biodegradable polymer materials Disposable bags, including shopping bags, daily plastic bags, paper-plastic composite bags and other commodity packaging bags, and plastic bags used to contain garbage;

(2) Disposable bags containing non-biodegradable polymer materials Sex tableware, including boxes (including lids), bowls (including lids), plates, plates, drink cups (including lids), etc.;

(3) Other prohibitions determined by the Provincial People's Government based on actual needs of disposable non-degradable plastic products.

Specific types of single-use non-degradable plastic products that are prohibited are subject to list management. The formulation and adjustment of the prohibited list shall be proposed by the ecological environment department of the Provincial People's Government after review and evaluation, and shall be submitted to the Provincial People's Government for approval and announced to the public. Article 3 People's governments at or above the county level shall strengthen leadership on the ban on the production, transportation, sale, storage, and use of disposable non-degradable plastic products, formulate work plans, establish coordination mechanisms, organize, coordinate, and supervise relevant departments to perform supervision and management in accordance with the law. responsibilities and include the required funds into the financial budget of the same level. Article 4 The ecological and environmental competent departments of the people's governments at or above the county level are responsible for the unified supervision and management of prohibiting the production, transportation, sale, storage, and use of disposable non-degradable plastic products.

The market supervision and management departments of people's governments at or above the county level are responsible for the supervision and management of prohibiting the production, transportation, sale, storage, and use of disposable non-degradable plastic products in accordance with the responsibilities determined by the provincial people's government and the people's government at the same level.

The development and reform, industry and information technology, agriculture and rural areas, housing and urban and rural construction, environmental health, finance, commerce, transportation and other departments of the people's governments at or above the county level are responsible for prohibiting production, transportation, and sales in accordance with their respective duties Supervision and management work related to the storage and use of disposable non-degradable plastic products.

Township people's governments and sub-district offices should assist relevant departments such as the ecological environment and market supervision and management to prohibit the production, transportation, sale, storage and use of disposable non-degradable plastic products. Article 5: Trade unions, Communist Youth League, Women’s Federation and other groups as well as residents’ committees and village committees shall assist relevant departments in banning the production, transportation, sale, storage and use of disposable non-degradable plastic products.

Encourage and support various scientific research institutions, ecological and environmental protection organizations and other social groups to carry out various forms of activities prohibiting the production, transportation, sale, storage, and use of disposable non-degradable plastic products.

The public should reduce the use of disposable non-degradable plastic products that are not on the banned list. Article 6 People's governments at or above the county level and their relevant departments shall organize and carry out publicity activities to prohibit the production, transportation, sale, storage and use of disposable non-degradable plastic products, guide the public to enhance their awareness of environmental protection and resource conservation, and use fully biodegradable plastic products , paper products, cloth products and other substitutes, actively participate in the prevention and control of pollution from disposable non-degradable plastic products, and promote the formation of a green lifestyle.

Schools and kindergartens should carry out popular education on the prevention and control of pollution caused by disposable non-degradable plastic products to teenagers and children.

News media should carry out publicity on the prohibition of the production, transportation, sale, storage and use of disposable non-degradable plastic products, and publish and broadcast public service advertisements for free. Article 7: Operators shall set up a list of prohibited use of disposable non-degradable plastic products and warning signs in a conspicuous position of the business premises.

Operators shall not provide consumers with disposable non-degradable plastic products on the prohibited list.

Managers of business places such as markets and supermarkets should establish management systems to promptly stop the sale and use of disposable non-degradable plastic products on the prohibited list within the premises; if the stoppage is ineffective, they should Report to the ecological environment, market supervision and management and other competent authorities. Article 8 People's governments at or above the county level and their relevant departments shall encourage and support the scientific research, production, promotion and use of alternatives to disposable non-degradable plastic products and the recycling of disposable plastic products, and provide appropriate financial support.

Enterprises that produce disposable non-degradable plastic product substitutes and recycle disposable plastic products will be exempted from taxes or administrative fees in accordance with relevant regulations. Article 9 The industry and information technology department of the Provincial People's Government shall, in conjunction with relevant departments, formulate a development plan for the fully biodegradable plastics industry and submit it to the Provincial People's Government for approval before implementation.

People's governments at or above the county level should support and supervise the transformation of production projects of disposable non-degradable plastic products on the prohibited list. Article 10 Fully biodegradable plastic products must strictly comply with national standards, industry standards, and local standards.

The standardization department of the Provincial People's Government should organize the formulation of relevant local standards for fully biodegradable plastic products based on the actual situation.

Encourage social groups and enterprises to formulate and implement group standards and enterprise standards that are higher than the relevant technical requirements of national standards, industry standards and local standards.
