First of all, let's look at how the law stipulates. According to Article 8 of the Land Management Law, the land in rural and suburban areas belongs to farmers' collective ownership, except that it belongs to the state according to law. Then the wasteland reclaimed by farmers can be divided into two situations:

The first type: the relevant documents have been processed.

If a farmer has reclaimed a wasteland by himself, and has obtained the land use right certificate of this land, or signed a contract with the village, then during the contract period, the farmer will enjoy the right to use this wasteland without worrying about being taken away one day.

The second type: no relevant documents.

If the wasteland reclaimed by farmers has not gone through any formalities, there is neither a land use right certificate nor a contract signed with the village, in principle, the land use right belongs to the village collective, and the land reclaimed by farmers can be recovered by the village collective.

In addition, many farmers are concerned about whether crops planted on reclaimed wasteland can get subsidies. In this regard, the state also expressly stipulates that crops are planted on land that has not been approved for reclamation or land that is prohibited from reclamation without any subsidy. Moreover, in some places, village committees have to charge appropriate contracting fees for the wasteland reclaimed by farmers privately. Therefore, farmers' friends must first understand the local policies before reclaiming wasteland, so as to avoid the difficulty of reclaiming wasteland, but it cannot be used normally.
