Chapter I General Provisions
Article 1 In order to strengthen fire control management, prevent and reduce fire hazards, and protect social wealth and personal safety, these regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality.
article 2 these provisions shall apply to the administrative areas of this municipality.
article 3 the fire control work shall follow the principle of putting prevention first, combining prevention with elimination, and following the principle of socialization of fire control work.
article 4 the people's government will incorporate fire fighting into the national economic and social development plan to ensure that the development of fire fighting is coordinated with economic construction and social development.
Article 5 The Municipal People's Government shall exercise unified leadership over the city's fire control work. District (city) and Township People's governments are responsible for leading the fire control work within their respective administrative areas.
article 6 public security organs at all levels are the competent fire departments within their respective administrative areas. The public security fire department specifically performs the function of fire supervision.
the fire control work of military facilities shall be the responsibility of the competent military organ, with the assistance of the public security fire control department.

Article 7 The legal representatives of organs, organizations, enterprises, institutions and other organizations are the
first persons in charge of fire safety in this list, and are responsible for the fire safety of their own units according to law.
article 8 it is the common responsibility of the whole society and the obligation of every citizen to maintain public fire safety, prevent and put out fires.
any unit or individual has the right to report, accuse and stop acts that endanger public fire safety.
article 9 November 9 every year is the city's fire control activity day, and people's governments at all levels, units and citizens should actively organize or participate in fire control activities.
chapter ii organization and responsibilities of fire control
article 1 people's governments at all levels shall strengthen their leadership over fire control work, establish and improve the responsibility system for fire control safety in their respective administrative areas, study and solve major problems in fire control work, ensure investment in fire control, organize and direct fire fighting and emergency rescue, and commend advanced units and individuals in fire control.
people's governments at all levels shall set up fire safety committees to organize and coordinate fire control work within their respective administrative areas.
Article 11 The public security fire department shall perform the following fire supervision duties according to law:
(1) Supervise the implementation of fire laws, regulations and rules, and investigate and deal with violations of fire laws, regulations and rules;
(2) to participate in the preparation of urban fire protection planning and supervise its implementation;
(3) supervise and inspect the fire control work of each unit, review and determine the hidden dangers of fire, and supervise the implementation of fire control safety measures;
(4) supervise and inspect the construction and maintenance of urban fire protection projects and facilities, and conduct fire protection design audit and project completion acceptance for building projects;
(5) to examine the safety conditions for the production, operation, transportation, storage and use of inflammable, explosive and chemical dangerous goods;
(6) to supervise the quality of fire protection products;
(7) organize fire prevention publicity and education, fire prevention training and fire fighting and emergency drills, and guide the construction and training of various local fire prevention organizations;
(8) organizing and directing fire fighting, and participating in emergency rescue and social relief;
(9) Organize the investigation and appraisal of the causes of fire accidents, and put forward relevant treatment opinions;
(1) Organize the appraisal and popularization of fire-fighting scientific and technological achievements, and promote the research and development of fire-fighting science and technology;
(11) release fire information and count fire losses;
(12) other duties as stipulated by laws and regulations;
the main departments of forestry, ports and railways are responsible for the fire control supervision of their respective industries.
Article 12 State organs, enterprises, institutions and other organizations shall perform the following duties:
(1) To implement fire control laws, regulations and rules, formulate and implement fire control work plans and fire safety responsibility systems step by step;
(2) set up a fire safety organization, equipped with full-time (part-time) fire management personnel, and conduct regular fire safety inspections to eliminate fire hazards;
(3) Provide fire education and training for employees, formulate fire fighting and evacuation plans, and organize fire drills regularly;
(4) When contracting and leasing operations are carried out, the responsibilities for fire control safety shall be clearly defined in the contract;
(5) When developing and importing equipment and technology, corresponding fire safety facilities and technologies should be developed and imported at the same time;
(6) organize the fire fighting at the beginning, assist the public security fire department to put out the fire, protect the fire scene, and assist in investigating fire accidents.
Article 13 The following units shall establish full-time fire brigades:
(1) Large and medium-sized production enterprises with high fire risk or large and medium-sized enterprises far away from public security fire brigades;
(2) important ports, airports, stations and large state-owned and collective forest farms;
(3) large-scale special warehouses and oil or gas storage bases;
(4) other units that the public security fire department thinks should establish a full-time fire brigade.
a full-time fire brigade can be established by one unit or by several adjacent units.
the establishment or cancellation of full-time fire brigades in enterprises and institutions must be approved by the public security fire department.
fourteenth large-scale shops (venues), hotels, restaurants and other places where people are concentrated, full-time fire fighting classes should be established.
Full-time fire brigade can also serve as security guard.
Fifteenth towns and villages with an annual output exceeding 1 million yuan should set up fire stations. Its establishment and revocation must be approved by the local public security fire department.
article 16 state organs, enterprises, institutions, streets and villages shall set up voluntary fire brigades.
article 17 all kinds of full-time fire brigade (class) members and full-time (part-time) firefighters shall be trained by the public security fire department and take up their posts with certificates after passing the examination.
all kinds of full-time fire brigades (classes) should be equipped with corresponding types and quantities of fire-fighting vehicles, equipment or equipment, regularly learn fire-fighting knowledge and relevant technical training, and accept the inspection, guidance and assessment of the public security fire department.

Article 19 An insurance company shall conduct fire prevention publicity and education and fire safety inspection for the insured units and individuals.

chapter iii fire protection planning and construction
article 24 planning and construction departments shall, in accordance with national standards and urban fire protection requirements, jointly with public security fire departments, formulate professional plans for public fire protection facilities such as fire stations, fire water sources, fire communication and fire exits, and ensure that they are implemented simultaneously with urban construction.
the departments of urban construction, public utilities, posts and telecommunications are responsible for the construction and maintenance of public * * * fire facilities, and the public security fire department is responsible for the acceptance and use.
when building or rebuilding urban residential areas, the construction unit shall plan and build supporting small fire stations according to relevant regulations.
Article 25 Fire stations shall be set up in urban areas according to the principle that the protection area is 4 to 7 square kilometers or the fire truck can reach the edge of the responsibility area within 5 minutes after receiving the alarm.

Article 26 A building engineering design unit shall establish a fire prevention design responsibility system and a step-by-step audit system, and be responsible for the fire prevention design of the project. Engineering design shall conform to the requirements of relevant national fire protection technical specifications.
article 27 for new construction, renovation and expansion projects, projects that change the original design purpose of buildings and interior decoration projects, the construction unit shall submit the fire protection design drawings and materials of the projects to the public security fire department for examination and approval according to the regulations on fire control.
the planning department can only examine and issue the planning permit for the construction project after receiving the written opinions of the public security fire department for examination and approval of the fire protection design.
the project construction and construction unit must organize the construction according to the fire protection design drawings approved by the public security fire department. article 28 when new materials, new equipment and new technology with fire hazards are adopted in engineering construction, fire safety measures shall be implemented according to relevant technical specifications.
Article 29 The fire engineering installation and construction unit must set up an automatic alarm equipment operation laboratory and an automatic fire extinguishing equipment simulation fire extinguishing laboratory, and be equipped with corresponding operators; The adopted products can only be installed and used after operation test and sampling fire extinguishing test.
the installation and construction unit of fire protection project shall conduct routine inspection of the fire protection project undertaken by the construction unit in accordance with the contract signed with the user unit, conduct a comprehensive inspection and maintenance of the system operation every year, and report to the public security fire department.
Article 3 For new construction, renovation, expansion projects and interior decoration projects, the fees for fire-fighting facilities and equipment shall be collected according to regulations, which shall be used exclusively for the construction of urban public fire-fighting facilities and the purchase of fire-fighting equipment, facilities and equipment.
chapter iv fire prevention
article 31 urban and rural residents should learn fire control knowledge, fire control laws and regulations, and know how to use fire and electricity safely and other fire prevention and extinguishing knowledge.
Article 32 The personnel in charge of safety work and the personnel on duty of the unit shall conduct routine fire safety inspection every day; The person in charge of the unit shall conduct regular fire safety inspections.
article 33 the newly recruited employees of the unit must be educated on fire safety knowledge before taking up their posts.
fire safety management personnel of enterprises and institutions, design, construction and maintenance personnel of fire protection projects, operators of fixed fire protection facilities, managers of inflammable and explosive goods warehouses, inspection and maintenance personnel of fire protection products, etc., must undergo fire protection training and pass the examination by the public security fire department before taking up their posts.
article 34 units shall be equipped with corresponding quantity and types of fire-fighting facilities and equipment according to regulations, and shall not be used for other purposes. The automatic (fixed) fire alarm and automatic fire extinguishing facilities set by the unit shall not be stopped without the consent of the public security fire department.
before adding a fixed fire source or open flame operation, it shall be approved by the department in charge of fire safety of the unit; Those who meet the safety requirements will be issued with fire certificates. Fire equipment should be overhauled once a year.
article 35 the safety and maintenance of the electrical equipment of the unit shall strictly implement the relevant regulations and technical specifications. It is strictly forbidden to connect the wires in violation of regulations, increase the load at will or change the safety device.
Article 36 Units engaged in the production of fire-fighting products, installation and construction of fire-fighting facilities and fire-fighting intermediary services must be equipped with two or more full-time engineers and technicians with intermediate titles or above; Fire product maintenance and sales units must be equipped with more than one full-time engineering and technical personnel with intermediate titles.
units that produce, maintain and sell fire-fighting products shall set up product inspection rooms and quality analysis laboratories, equipped with corresponding equipment and operators, and all products produced, maintained and sold shall be inspected or sampled; Sampling, sampling rate of not less than 5% of all products.
article 37 units engaged in the production, maintenance and sales of fire-fighting products (including the production of building fire-fighting materials), fire-fighting intermediary services and the installation and construction of fire-fighting facilities shall apply for a business license only after being examined and approved by the municipal public security fire department and obtaining the prescribed fire-fighting license.

article 38 a unit with fixed fire control facilities shall accept the appraisal inspection by an intermediary agency recognized by the public security fire control department, and accept the regular inspection, cleaning, debugging and maintenance by the fire control project installation and construction unit according to regulations.
article 39 the production and operation of inflammable and explosive chemical dangerous goods must be examined and approved by the public security fire department. Transportation of inflammable and explosive chemical dangerous goods shall be handled by the local public security fire department.
Article 4 All kinds of warehouses storing flammable and combustible materials must implement the fire prevention regulations of warehouses, and it is strictly forbidden to overstock and block fire exits. Articles with different chemical properties and different fire disaster methods are strictly prohibited to be stored in the same warehouse.
article 41 the packaging of inflammable and explosive chemical dangerous goods must indicate the name, place of origin, date of production, performance, fire prevention signs and precautions for use.
Article 42 Safety facilities such as ventilation, dust prevention, anti-static, monitoring, alarm, lightning protection, fire prevention and explosion prevention shall be installed in places with explosion danger.
article 43 all kinds of gas stations and liquefied petroleum gas (LPG) substitute tanks can only be operated by the relevant departments after passing the fire safety audit by the public security fire department.
Article 44 It is strictly forbidden to use or store cylinders filled with liquefied gas in restaurants of catering service places.
Article 45 No unit or individual is allowed to occupy, block or close public safety evacuation passages and fire exits; It is forbidden to bury and occupy fire hydrants, and it is forbidden for any unit or individual to set up buildings on gas pipelines.
article 46 traffic ports such as stations, docks and airports should strengthen safety inspection, and it is strictly forbidden for passengers to carry inflammable and explosive chemical dangerous goods in mixed storage, loading and transportation with other goods.
Article 47 The following activities shall be approved by the public security and fire departments in advance, and corresponding safety measures shall be taken:
(1) Holding large-scale material exchange activities, trade fairs, folk gatherings, celebrations, etc.;
(2) maintenance of municipal fire water supply facilities, fire alarm lines and urban gas pipe network;
(3) overhaul of production and storage facilities for large inflammable and explosive articles;
(4) setting off fireworks;
(5) other acts that the local people's government shall apply for permission.
article 48 rural yards and firewood stacks should be located in safe areas far away from houses, fire sources and power overhead lines.
Article 49 Units and individuals are prohibited from the following acts:
(1) Dumping liquefied petroleum gas (LPG) cans, liquefied petroleum gas (LPG) residues and burning furnace ashes by themselves;
(2) pulling and connecting electrical lines in disorder, which leads to overload of electricity;
(3) Smoking and hot work in warehouses, stacks, yards, flammable building areas and other places where fire is prohibited;
(4) setting off fireworks and firecrackers in prohibited areas;
(5) Smoking in places where smoking is prohibited;
(6) burning paper and other articles in urban roads, squares and other public places;
(7) carrying inflammable and explosive chemical dangerous goods by car, boat or plane;
(8) making and filling hydrogen and other combustible and combustion-supporting gases without permission;
(9) using oxygen in aquatic products, transportation and management;
(1) Demolition, transformation, relocation and installation of pipeline gas equipment; Extracting pipeline gas;
(11) having a picnic, burning wasteland, burning paper, burning straw and hunting with firearms in green land, woodland and forest edge areas.
Article 5 Parents or other guardians shall strengthen supervision over minors and perform their duties.
