Opinions of the Ministry of Civil Affairs on implementing relevant policies for special care recipients and some retired soldiers

Provinces, autonomous regions, municipalities directly under the Central Government, civil affairs bureaus of cities with separate plans, and civil affairs bureaus of Xinjiang Production and Construction Corps: In order to implement the spirit of relevant documents of the central government and earnestly implement the relevant policies for special care recipients and some ex-servicemen, we hereby put forward the following implementation opinions:

First, the main responsibilities of the civil affairs department

(1) Local civil affairs departments take the lead in adjusting the standard of pensions and subsidies for some entitled groups, give living allowances to some retired people who participated in the war, the former 8023 troops and other retired soldiers who participated in nuclear tests, and implement three policies, such as the Measures for Medical Security for Special Groups. The civil affairs departments have four responsibilities:

1, the implementation of the martyr's family member (including the survivors of soldiers who died in the line of duty, the survivors of deceased soldiers), disabled soldiers (including disabled people's police, disabled state organs staff, disabled militia migrant workers), Red Army veterans who retired in the countryside, demobilized soldiers in the countryside, and veterans who returned home despite illness to improve the standard of pension subsidies.

2, to verify some retired personnel, data statistics, do a good job in rural and urban areas without work units and living difficulties of retired personnel living allowance.

3, the former 8023 army retired personnel do not meet the disability assessment and enjoy the living allowance conditions of sick veterans returning home, but sick or living in rural areas, cities and towns without work units, pay living allowance; Check and identify other retired military personnel who participated in the nuclear test, organize physical examination statistics, and implement relevant pension benefits.

4. The civil affairs departments of all provinces, autonomous regions and municipalities directly under the Central Government shall, jointly with the departments of finance, labor security and health, formulate specific measures for the implementation of medical security for special care recipients and implement relevant medical security policies.

(2) Make overall plans to study and do a good job in the rescue of demobilized military cadres with special difficulties from 1993 to 1999.

(3) Actively cooperate with the relevant departments to implement the two policies of 1993 to 1999, namely, the housing policy for demobilized military cadres and the labor security policy for some ex-servicemen, and provide the relevant departments with relevant information of demobilized veterans in their respective regions in a timely manner by taking districts (counties) as units.

Second, the verification of retired personnel who participated in the war and retired personnel who participated in the nuclear test shall be organized and implemented in accordance with the principle of territoriality, and the civil affairs departments of villages (neighborhood committees), townships (towns, streets) and counties (cities, districts) who participated in the war shall organize the investigation, declaration and audit in a unified way.

(A) the definition and scope of related objects

1, retirees. ? Retired personnel who participated in the war refer to retired personnel who served in the army and participated in the battle. Combat refers to the military action of the armed forces to attack or fight against the enemy, which is specifically defined as: the military action of our army to resist foreign aggression, complete the reunification of the motherland, defend the territorial and sovereign integrity of the country, and safeguard national security, mainly including: self-defense counterattack, defensive operation, fighting against Kuomintang troops fleeing from the mainland, going abroad to support operations, quelling regional armed rebellion operations, and other operations approved by the Central Military Commission and the headquarters. Retired personnel participating in the war include direct combatants, operational commanders and operational support personnel. ? Since 1 954165438+1October1,our main operations are:

2, the original 8023 troops and other retired personnel to participate in the nuclear test:

Unit 8023 was the code name of the former 2 1 experimental base of the Science, Technology and Industry Committee for National Defense in 1960s and 1970s. From 1964 to 1996, many nuclear test missions were carried out. Now it is the 2 1 base of the General Armament Department, and the base is in Malan, Xinjiang. Other retired military personnel who participated in nuclear tests: including those who participated in nuclear test effect tests, those who performed nuclear test support tasks, those who participated in military exercises under nuclear explosion conditions, those who were stationed in the same area as the original 8023 troops, and those who held posts related to nuclear missiles and nuclear submarines.

The civil affairs department shall organize investigation, declaration and examination and approval according to the information provided by the relevant departments. (2) Procedures for declaration, registration and preliminary examination.

Relevant personnel carry their ID card, household registration book, discharge certificate, meritorious service in the war, award-winning certificate and other relevant certification materials (all the certification materials obtained by individuals from the original unit will be invalid), apply to the village (neighborhood) Committee where the household registration is located, go through the registration formalities, and fill in the relevant registration audit form. The village (neighborhood) committee shall report to the township (town, street) after the preliminary examination. The township (town, street) should carefully verify the identity of the applicant and make a good registration on the basis of consulting the original records of my files and personal files by the departments and units where the applicant is located. After meeting the requirements and signing the opinions, submit the relevant registration review form, personnel roster and copies of relevant personal information, as well as my files and other materials to the county-level civil affairs department. For those who do not meet the requirements, explain the reasons in writing and inform me.

(3) Joint hearing and appraisal and establishment of archives.

The civil affairs departments at the county level shall organize special personnel to collectively review the submitted materials and review them one by one. Audited eligible, by the applicant's unit and the village (neighborhood) Committee for publicity. If there is any objection during and after the publicity, the civil affairs department at the county level shall organize investigation and verification. If it is verified that it does not meet the requirements, it shall notify me in writing and explain the reasons. If you have any questions after the investigation, you should consult the Provincial Civil Affairs Department. For the information of all the above applicants, the civil affairs departments at the county level should establish and improve files and databases, and conscientiously do a good job in daily management. The declaration, registration and verification shall be completed before the end of August. Forms that need to be filled in by relevant personnel in the process of declaration, registration, examination and approval shall be made by all localities according to their own wishes, but the contents of the forms shall include the items in the Information Collection Form for Some Retired Soldiers (Annex 1) issued by the Ministry of Civil Affairs. After the examination and approval, the provincial civil affairs department should fill in the qualified personnel information in the information collection form of some retired soldiers, and enter it into the system after upgrading the information management system of the special care recipients of the Ministry of Civil Affairs at the end of this year and early next year, forming an annual regular update mechanism like other key special care recipients.

Three. Statistics and payment of funds

After examination and approval, the civil affairs department at the county level shall timely make statistics and verify relevant data, summarize them step by step, and send a copy to the finance department at the same level for review. Provincial civil affairs departments should fill in the statistics of retired personnel who participated in the war, the former 6023 troops and other retired personnel who participated in the nuclear test in the Statistical Table of Retired Personnel in Some Troops (Annex 2) and the Statistical Table of Retired Personnel who Participated in the Nuclear Test (Annex 3) before September, 2007 15. The Ministry of Civil Affairs shall prepare the capital budget according to the actual number of approved personnel, submit relevant information to the Ministry of Finance in a timely manner, and request the Ministry of Finance to issue relevant subsidy funds. All localities should take effective measures, on the basis of careful examination, timely arrange the local pension subsidy funds, make overall arrangements for the allocation and use of the higher-level subsidy funds, distribute the pension subsidies to individuals in full and on time, establish a long-term mechanism for statistical examination of data step by step, and summarize and report them regularly.

Fourth, the job requirements

(1) Unify ideological understanding and strengthen organizational leadership.

Civil affairs departments at all levels should fully understand the importance and urgency of doing this work well from the height of building a harmonious socialist society, strengthening national defense and army building, and maintaining the overall situation of reform, development and stability, and effectively unify their thoughts and actions with the spirit of the central government. It is necessary to regard this work as an important political task at present, put it on the immediate agenda, carefully organize and arrange it, provide relevant information on its own initiative, coordinate and solve problems encountered in the work in time, and do related work together.

(two) to strengthen publicity and education, carry out inspection and supervision.

All localities should conscientiously publicize and explain policies through various forms to increase the transparency of their work.

It is necessary to publicize the care and love of the party and the government for this part of the staff, and publicize the policy content in place to make it a household name. At the same time, we should persist in combining solving practical problems with doing a good job in ideological work, educate and guide them to continue to maintain the excellent quality of revolutionary soldiers, strive to improve their adaptability and competitiveness under the conditions of socialist market economy, educate and guide them to enhance their legal concept and overall awareness, and consciously safeguard the overall situation of reform, development and stability with practical actions. It is necessary to strengthen supervision and inspection and solve the problems found in time.

(1) Personal handling: First write a document about my participation in the war, and then find two comrades for reference. Issue certification materials and promise to bear corresponding legal responsibilities for the certificates issued. Witnesses must be recognized combatants, and at the same time, they must have "four similarities" with the witnesses, that is, they participated in the war at the same time and place, the military code was the same, and they belonged to the same battalion unit. In practice, if only one witness who has been identified is completely "four-identical" with the person being proved, it can also be used as the basis for identification.

(II) If there is no record of participation in the war in personal files or files can not be found, and there is no proof of comrades-in-arms at the same time, which is relatively large and strongly reflected, the civil affairs departments at the county level shall send special personnel to the original troops to consult relevant original materials. As long as the troops have original records of participation in the war, the original troops' serial numbers are consistent with those in their personal files or veterans' certificates, as the basis for identification.

The Ministry of Civil Affairs of the People's Republic of China is an integral part of the State Council, which is in charge of social and administrative affairs. Main responsibilities of the Ministry of Civil Affairs

(a) to formulate plans and policies for the development of civil affairs, draft relevant laws and regulations, formulate departmental rules, and organize the implementation, supervision and inspection.

(two) to undertake the registration management and supervision of social organizations, foundations and private non-enterprise units according to law.

(3) Formulating preferential policies, standards and measures, formulating policies and plans for the resettlement of retired soldiers, demobilized cadres, retired military cadres and retired workers without military status, formulating methods for commending martyrs, organizing and guiding the work of supporting the army and giving preferential treatment to its dependents, and undertaking the specific work of the national leading group for supporting the army and giving preferential treatment to its dependents.

(4) Formulating disaster relief policies, organizing and coordinating disaster relief work, organizing the construction of an emergency system for natural disaster relief, organizing the verification and unified release of disasters, managing and allocating central disaster relief funds and materials and supervising their use, organizing and guiding disaster relief donations, and undertaking the specific work of the National Disaster Reduction Committee.

(five) take the lead in formulating social assistance plans, policies and standards, improve the urban and rural social assistance system, and be responsible for the minimum living security, medical assistance, temporary assistance and relief work for urban and rural residents.

(VI) To formulate policies and measures for the administration of administrative divisions and administrative boundaries, be responsible for reviewing the establishment, naming and change of administrative regions at or above the county level and the relocation of government stations, organize and guide the delineation and management of provincial and county-level administrative boundaries, and be responsible for reviewing the naming and renaming of important natural geographical entities and international public domain and astronomical geographical entities.

(seven) to formulate policies for the construction of urban and rural grassroots autonomy and community construction, guide the construction of community service system, put forward suggestions for strengthening and improving the construction of urban and rural grassroots political power, and promote the construction of grassroots democratic politics.

(8) Formulating development plans, policies and standards for social welfare undertakings, formulating measures for the administration of social welfare institutions and welfare lottery issuance, organizing and formulating policies for the development of charity undertakings, organizing and guiding social donations, and guiding the protection of the rights and interests of special groups such as the elderly, orphans and the disabled.

(nine) to formulate policies on marriage management, funeral management and adoption of children, to be responsible for promoting the reform of marriage customs and funeral, and to guide the management of marriage, funeral, adoption and rescue services.

(ten) in conjunction with the relevant departments in accordance with the provisions, formulate social work development plans, policies and professional norms, and promote the construction of social work talents and related volunteers.

(eleven) responsible for international exchanges and cooperation, to participate in the formulation of measures for the administration of international refugees in China, and to be responsible for the temporary resettlement and repatriation of international refugees in China in conjunction with relevant departments.

(twelve) to undertake other tasks assigned by the State Council.
