Provisions on the Protection and Management of the Ancient City of Xiong Yue

Article 1 In order to strengthen the protection and management of the ancient city of Xiong Yue, carry forward the history and culture, and promote urban construction and economic development, in accordance with the provisions of the Urban Planning Law of the People's Republic of China, the Law of the People's Republic of China on the Protection of Cultural Relics and other relevant laws and regulations, combined with the protection, development and utilization of the ancient city of Xiong Yue,

article 2 all planning, construction, protection and management of cultural relics and other related activities within the protection scope and control area of the ancient city of Xiong Yue (hereinafter referred to as the ancient city) shall abide by these provisions.

article 3 the protection of ancient cities adheres to the principles of overall planning, legal protection, rational utilization and scientific management.

article 4 the overall renovation and protection of cultural relics and historic sites in the block of Xiong Yue ancient city should reflect the historical context of Xiong Yue, and the architectural style must reflect the traditional culture of China, so that the style of the ancient city can be continued and inherited.

article 5 the people's government of xiongyue town shall organize the collection, collation, research, protection, development and utilization of historical events, traditional crafts, food culture, folk customs and other cultural heritages of ancient and modern buildings in xiongyue town. Land and resources, environmental protection, ethnic and religious, tourism and other relevant government agencies shall assist in the protection and management of the ancient city in accordance with the authority prescribed by relevant laws and regulations.

article 6 state organs, organizations, enterprises, institutions and citizens within the administrative area of xiongyue town have the obligation to protect the ancient city, and should actively participate in the publicity and education work of protecting the ancient city and enhance the awareness of protection of the whole society.

article 7 encourages all sectors of society, domestic and foreign organizations and individuals to invest in the protection, development and utilization of the ancient city in the form of investment and donation.

article 8 the protection and management of the ancient city shall be included in the national economic and social development plan of xiongyue town, and the protection and management funds shall be included in the financial budget of xiongyue town.

article 9 the protection of the ancient city should be based on the overall urban planning of xiongyue town, and the special planning for the protection of the ancient city should be compiled, and the regulatory detailed planning and the construction detailed planning in the control area should be controlled. Planning should listen to the opinions of all sectors of society, organize experts to demonstrate, and ensure the legitimacy, rationality and feasibility of planning.

Article 1 When drawing up a special plan for the protection of ancient cities, the complete pattern of the protection of ancient cities should be highlighted, and the following requirements should be met:

(1) Adhere to the connection with the national economic and social development plan, the overall urban planning and the overall land use planning;

(2) Pay attention to protecting the historical features and spatial environment of the ancient city and reflect its characteristics;

(3) strictly control the height, color and style of buildings;

(4) It meets the general requirements for the protection of the ancient city and adapts to the living and working environment of the residents around the ancient city.

Article 11 Special planning for the protection of ancient cities, detailed planning for control and detailed planning for construction shall be implemented after being approved in accordance with relevant regulations and procedures, and announced to the public. If it is necessary to make local changes and adjustments, it shall be submitted for approval and announced according to the original approval procedures.

Article 12 No other construction projects shall be carried out within the protection scope of the ancient city. Due to special needs, other construction projects within the protection scope of the ancient city shall be reported to the government for approval, and the approval shall be obtained from the administrative department of cultural relics of the government at the next higher level before approval. Do not meet the requirements of the ancient city protection planning, not for planning and construction land approval procedures, the construction unit shall not be construction.

article 13 the protection of an ancient city should reflect its historical features and maintain its original road network pattern, street features and names.

article 14 all units and individuals should consciously protect the environment of the ancient city. Advocate the use of clean fuels such as liquefied petroleum gas and natural gas to reduce air pollution.

article 15 in the construction of the project within the protection scope of the ancient city, the special planning for the protection of the ancient city should be strictly implemented, and the housing construction of the organs, units and urban residents in the ancient city should be strictly controlled. The renovation and reconstruction of the original building must adopt traditional techniques, and the architectural form should highlight the local characteristics of the buildings in southern Liaoning.

Article 16 No facilities that pollute cultural relics protection units and their environment shall be built within the protection scope of ancient cities, and no activities that may affect the safety of cultural relics protection units and their environment shall be carried out. Existing facilities that pollute cultural relics protection units and their environment shall be treated or relocated within a time limit.

article 17 traditional buildings and houses shall be protected by classification, and files shall be established for typical houses, and signs shall be hung. Maintenance, alteration and renovation of traditional buildings, structures, traditional houses and shops should be repaired as old as before and keep the original appearance.

article 19 all relevant departments shall, according to their respective responsibilities, take effective protective measures to do a good job in fire prevention, theft prevention, flood control and earthquake prevention of the ancient city, so as to ensure the safety of the ancient city.

Article 2 Buildings, structures and other facilities within the protection scope of the ancient city that are not in conformity with the special planning, regulatory detailed planning and construction detailed planning of the ancient city and should be relocated and demolished belong to historical formation or approved construction, and shall be organized and implemented by Xiongyue Town People's Government in stages and in batches, and shall be resettled and compensated according to regulations; Belong to illegal construction, demolition by the relevant departments.

article 21 houses and shops of cultural relics protection units and key traditional buildings shall be maintained and repaired by property owners or users.

Article 22 No unit or individual within the protection scope of the ancient city may occupy roads, set up stalls, pile up sundries and conduct other acts that hinder road traffic, visit and visit without authorization.

article 23 ultra-high, overweight and super-large motor vehicles are prohibited from entering the protection scope of the ancient city.

Article 24 Within the protection scope of the ancient city, outdoor plaques set upon examination and approval should be simple and elegant, in harmony with the overall style of the ancient city buildings, and floor-to-ceiling plaques are not allowed. Banners and advertisements are strictly prohibited. The existing above-ground communication and overhead lines within the protection scope of the ancient city should be gradually transferred to underground settings.

Article 25 Whoever, in violation of the provisions of these Measures, commits one of the following acts, which does not constitute a crime, shall be ordered by the cultural relics administrative department of the people's government at or above the county level to make corrections, and if serious consequences are caused, he shall be fined between 5, yuan and 5, yuan. If the circumstances are serious, the original license-issuing organ shall revoke his qualification certificate:

(1) Carrying out construction projects or blasting, drilling, excavation and other operations within the protection scope of cultural relics protection units without authorization;

(2) if a construction project is carried out in the construction control zone of a cultural relics protection unit, and its engineering design scheme is not approved by the cultural relics administrative department and approved by the planning administrative department, it will damage the historical features of the cultural relics protection unit;

(3) moving or dismantling immovable cultural relics without authorization;

(4) repairing immovable cultural relics without authorization and changing their original state;

(5) Rebuilding immobile cultural relics that have been completely destroyed in the original site without authorization, thus causing cultural relics damage;

(6) the construction unit engages in the repair, relocation and reconstruction of cultural relics without obtaining the qualification certificate of cultural relics protection project.

article 26 if the depiction, smearing or damage of cultural relics are not serious, or the signs of legally established cultural relics protection units are damaged, the public security organ or the unit where the cultural relics belong shall give a warning and may also impose a fine.

article 27 if materials and inflammable and explosive articles are piled up within the protection scope of cultural relics protection units, harmful gases are discharged to pollute the environment, damage fire control facilities, move cultural relics protection signs, and endanger the safety of cultural relics, the cultural relics management department shall, jointly with the public security and environmental protection departments, give a warning or impose a fine, and order it to be rectified within a time limit.

article 28 other acts in violation of these measures shall be punished by the administrative departments of planning, land resources, tourism and environmental protection in accordance with the provisions of relevant laws and regulations.

Article 29 If a state functionary who implements the planning, protection and management of an ancient city neglects his duty, abuses his power, engages in malpractices for personal gain, demands bribes, delays or refuses to perform his statutory duties, thus causing damage to the object of protection of the ancient city, he shall be given administrative sanctions against the person directly responsible; If a crime is constituted, criminal responsibility shall be investigated according to law.
