Article 2 The term "taxi" as mentioned in these Measures refers to a passenger car that has obtained the right to operate a taxi according to law, provides irregular and irregular transportation services according to the wishes of passengers, and charges according to mileage and time.

Article 3 All units and individuals engaged in taxi passenger transport business activities within the administrative area of Wenzhou (hereinafter referred to as taxi passenger transport operators), taxi drivers, passengers and units and individuals engaged in taxi passenger transport related activities shall abide by these measures.

Article 4 The municipal and county (city) traffic administrative departments shall be responsible for organizing and leading the taxi passenger transport management within their respective administrative areas.

City, county (city) road transport management institution is responsible for the specific implementation of taxi passenger management.

Public security, industry and commerce, urban management and law enforcement, finance, taxation, price, labor and social security, quality supervision, environmental protection, land and resources, planning, municipal gardens and other relevant administrative departments shall perform their respective duties and conscientiously do a good job in taxi passenger transport management.

Article 5 Taxi operators and drivers shall operate according to law, be honest and trustworthy, compete fairly, operate safely and standardize their services.

Encourage and guide taxi operators to implement large-scale operation and standardized management.

Encourage and promote the scientific and technological progress of the taxi industry, promote the use of environmental protection and energy-saving technologies and equipment, and gradually establish and improve advanced command and dispatch and supervision and management systems.

Article 6 The people's governments of cities and counties (cities) shall guarantee the management funds of the taxi industry and incorporate them into the government budget.

Article 7 Any unit or individual who finds that taxi operators and drivers violate these measures has the right to report and complain to the relevant departments. After receiving reports and complaints, the relevant departments shall promptly investigate and deal with them according to law. business license

Article 8 The municipal and county (city) traffic administrative departments shall, jointly with relevant departments, formulate the taxi industry development plan and taxi delivery plan in their respective administrative areas according to the actual urban economic and social development and urban traffic planning, and report them to the people's government at the same level for approval before implementation.

The right to operate a taxi should follow the principles of openness, fairness and impartiality, and adopt a bidding method based on service quality. The specific measures for the right to operate a taxi shall be formulated by the traffic administrative department and implemented after being approved by the people's government at the same level.

Article 9 After the implementation of these Measures, the term of Wenzhou taxi operation right is 5 years, and counties (cities) can determine the term according to the actual situation, but the longest term shall not exceed 8 years. After the taxi franchise expires, the government will take back the franchise for free.

Tenth taxi business license shall not be transferred without authorization. If the right to operate a taxi can be transferred in accordance with the contract, both parties to the transfer shall provide relevant legal documents, and the road transport management institution can handle the formalities for the transfer of the right to operate a taxi only after being certified by the taxi service rights protection center.

Eleventh engaged in taxi passenger transport business, shall meet the following conditions:

(a) "taxi passenger business application form";

(2) Safety production system and operation management system;

(3) Taxi driver's license, vehicle technical grade certificate and their photocopies, or a letter of commitment to put the vehicle into use;

(four) the driver's license and taxi driver's passenger qualification certificate of the driver who has been hired or intends to be hired and their copies;

(five) proof materials of the ability to bear responsibility.

Thirteenth road transport management agencies to accept the taxi passenger business application, it shall issue a "traffic administrative license application acceptance notice"; Complete the examination within 20 working days from the date of accepting the application and make a decision on approval or disapproval. In line with the conditions, it shall issue a "decision on traffic administrative license" and a "road transport business license" to the applicant, and handle the business license according to the regulations; Do not meet the conditions, it shall issue a "decision not to grant traffic administrative license" to the applicant, and explain the reasons.

Fourteenth taxi operators need to change the "road transport business license" registered items, it should be within the validity period of the administrative license, the original license to the road transport management agencies to submit a written application. The road transport management institution shall conduct a review within 20 working days from the date of accepting the application for change. If the owner of the taxi business license (hereinafter referred to as the taxi business owner) re-chooses the taxi passenger transport business enterprise, it shall go through the relevant license change registration formalities at the road transport management institution and the traffic management department of the public security organ.

Fifteenth taxi drivers should meet the following conditions:

(a) the age is not more than 60 years old;

(two) to obtain the corresponding motor vehicle driving license, and there is no record of major traffic accidents within 3 years;

(3) Holding a driver's license issued by the traffic administrative department of the public security organ of this Municipality (if holding a foreign driver's license, the driver's license shall be transferred to this Municipality);

(four) by the city and county (city) road transport management institutions training and examination.

In accordance with the provisions of the preceding paragraph, the city and county (city) road transport management institution shall issue the "Taxi Driver Passenger Qualification Certificate". Sixteenth taxi drivers who have obtained the qualification certificate of taxi passenger transport shall sign employment contracts with taxi passenger transport operators and be certified by the taxi service rights protection center before they can engage in taxi passenger transport business. operation management

Article 17 A taxi shall meet the following requirements:

(a) in line with national and local environmental protection standards and technical standards;

(2) Having a valid motor vehicle driver's license and driving license issued by the traffic administrative department of the public security organ;

Eighteenth taxi operators and taxi operators shall exercise their rights, perform their obligations and bear legal responsibilities in accordance with the entrusted management contract.

Taxi operators should strengthen the management of taxi drivers and entrusted vehicles and improve the quality of taxi service.

Nineteenth taxi operators and operators shall abide by the following provisions:

(a) strictly abide by the laws, regulations and rules of the state, and accept the management, supervision, inspection and business guidance of the road transport management agencies and relevant departments;

(two) according to the provisions of the organization to carry out safety production, law-abiding, professional ethics education and training, and make safety training records;

(three) the implementation of the government and industry management departments issued emergency tasks such as combat readiness, disaster relief, Spring Festival travel rush traffic and foreign affairs;

(four) according to the requirements of timely reporting industry statements and related information;

(five) timely payment of taxes and fees according to regulations;

(6) Each taxi shall be equipped with no more than 4 drivers;

(eleven) insured passenger accident insurance and other compulsory insurance provisions of laws and regulations;

(12) establish a safety management ledger, traffic safety files and safety reporting system, regularly report the road transport safety situation, and timely report serious traffic accidents, and shall not conceal, omit or delay the report;

(thirteen) shall not be employed without the "taxi driver passenger qualification certificate" of the driver;

(fourteen) the taxi shall not be subcontracted to any unit or individual without the "taxi road transport business license".

Article 20 The traffic administrative department of the public security organ shall set up taxi temporary parking waiting points with obvious signs on the main roads and busy commercial streets of the city.

Taxis should stop at temporary taxi stops to pick up and drop off passengers. In other urban roads without temporary stops, taxis can choose safe roadside locations to temporarily stop and get on and off passengers according to the principle of not affecting traffic and facilitating passengers.

Twenty-first airports, railway stations, docks, hospitals, tourist attractions, theaters, entertainment places and other public places should set up taxi waiting points where parking conditions permit.

Taxi waiting points should be open to all taxis. No unit or individual may collect parking fees from taxi operators and drivers or hinder their normal operation in any form, and may not take measures to disturb the normal operation order to attract passengers for taxis.

Twenty-second public security, urban management and law enforcement departments should cooperate with road transport management agencies to set up taxi management stations in airports, stations, docks and other public places where passengers are concentrated, and implement on-site management.

Twenty-third taxi fare standards shall be examined and approved by the competent price department in conjunction with the traffic administrative department. Drivers and passengers

Twenty-fourth taxi drivers must abide by the following provisions when operating services:

(a) to abide by the laws, regulations and rules of the state on public security and traffic management, as well as the taxi passenger service standards and other relevant provisions;

(2) Carrying the Road Transport Certificate, Taxi Driver Passenger Transport Qualification Certificate and other documents, and obtaining the Taxi Driver Passenger Transport Qualification Certificate in accordance with the provisions;

(three) dignified appearance, neat clothes, warm service, polite hospitality, civilized language, to provide passengers with convenient, safe and high-quality services;

(four) shall not blackmail, blackmail and make things difficult for passengers, and shall not use taxis for illegal and criminal activities;

(5) It is forbidden to use counterfeit money, arbitrage, exchange and ask passengers for foreign currency;

(six) to ensure the accuracy and reliability of the meter value, and shall not intentionally destroy the accuracy of the meter, and shall be regularly verified by the quality supervision department;

(seven) charge according to the amount displayed by the meter and provide the special invoice for taxi, charge the waiting fee, parking fee, toll and bridge toll, and explain it to the passengers in advance;

(eight) choose the best driving route according to the destination designated by the passengers, and do not deliberately detour, throw passengers halfway or forcibly load them;

(9) When there are no passengers in the car, an empty taxi sign must be displayed. When there are passengers in the carriage, the empty taxi sign shall not be displayed. After the empty sign for rent is displayed, passengers shall not be refused or carried.

(10) Observe the traffic order and queue up in public places such as airports, stations and docks. Obey the scheduling of management personnel, do not get off the bus to attract customers or dominate the market;

(eleven) in addition to carrying passengers in different places, taxis shall not operate across operating areas or in different places, and shall not stay in different places to attract passengers;

(12) The items forgotten by passengers shall be returned in time and shall not be kept for themselves. Reasonable expenses, such as empty driving fees, arising from the return of passengers to forgetting things shall be borne by passengers;

(thirteen) other relevant provisions stipulated by laws, regulations and rules.

Twenty-fifth in any of the following circumstances, the taxi driver may refuse to carry passengers or terminate passengers halfway:

(a) passengers carrying controlled equipment, flammable, explosive, toxic, radioactive, corrosive and other items;

(2) People who can't identify or control their behavior, such as mental patients and drunkards, ride unsupervised;

(3) The articles carried by passengers exceed the volume and load of the carriage and trunk;

(four) when going to other provinces, cities, counties (cities) or remote areas, passengers do not cooperate with the driver to register at the nearest taxi registration point or the public security organ;

(5) Other illegal or unreasonable demands made by passengers.

Twenty-sixth passengers should ride in a civilized manner and abide by the following provisions:

(a) shall not carry control devices, flammable, explosive, toxic, radioactive and corrosive substances;

(two) shall not carry overweight, super wide, super long items;

(three) do not litter, do not carry articles that defile the health of the car, and passengers who defile the facilities in the car shall pay compensation;

(four) shall not tamper with the meter, damage the car facilities;

(five) shall not put forward illegal or unreasonable requirements to the driver.

Twenty-seventh passengers have the right to refuse to pay the fare under any of the following circumstances:

(a) the taxi does not have a meter, does not use a meter or the meter shows an unclear amount;

(two) the driver does not charge in accordance with the prescribed charging standards, does not issue special invoices, or the special invoices issued are incomplete and unclear;

(three) the taxi has a traffic accident or failure within the mileage of the starting price, and it is unable to complete the delivery service;

(four) the driver forcibly loaded without the permission of the passengers.

Twenty-eighth passengers have the right to complain to the road transport management institution and the relevant departments about the taxi driver's violation of these measures, and shall cooperate with the investigation and provide the following materials:

(1) The name, mailing address and telephone number of the complainant;

(2) The invoice, license plate number, driver's passenger certificate number or the name of the taxi passenger transport operator and other relevant evidence of the complained taxi;

(3) the facts and requirements of the complaint.

Twenty-ninth road transport management institutions and relevant departments shall make a decision within 05 working days from the date of accepting passenger complaints and reply to the complainant; If the situation is complicated, a decision shall be made within 30 working days.

The complained taxi drivers and operators shall actively cooperate with the investigation of the road transport management institution and relevant departments. credit rating

Thirtieth road transport management institutions shall conduct credit assessment of taxi operators, taxis and taxi drivers, and the credit rating shall be divided into four grades according to the credit score: excellent, qualified, basically qualified and unqualified. Measures for credit assessment shall be formulated by the road transport management institution.

Thirty-first road transport management institutions shall commend and support taxi operators with excellent assessment grades; Taxi operators who fail to pass the examination shall be ordered to make rectification within a time limit, be notified and implement key supervision.

The road transport management institution shall award the title of credit taxi to the taxi with excellent bicycle assessment grade; For taxis that fail to pass the bicycle examination, the taxi passenger transport operator or management right holder shall be ordered to make rectification within a time limit, be notified and blacklisted, and implement key supervision.

The road transport management institution shall conduct continuing education and training for taxi drivers who fail to pass the examination; If a taxi driver has one of the circumstances specified in Article 28 of the Measures for Credit Assessment of Road Transport Drivers (Trial) (No.280 [2008] of Jiaogong Road), his taxi driver's passenger qualification certificate shall be revoked according to law.
