Measures of Guiyang Municipality on the Administration of Road Traffic Safety

Chapter I General Provisions Article 1 In order to strengthen the management of road traffic safety, these Measures are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China and combined with the actual situation of this Municipality. Article 2 Vehicle drivers, pedestrians, passengers and units and individuals related to road traffic activities within the administrative area of this Municipality shall abide by these Measures. Article 3 The traffic administrative department of the public security organ of the Municipal People's Government shall be responsible for the management of road traffic safety within the administrative area of this Municipality. The traffic administrative department of the public security organ of the people's government at the county level shall be responsible for the management of road traffic safety within their respective administrative areas.

Traffic, construction, urban management, civil air defense, planning and other administrative departments are responsible for the relevant road traffic work in accordance with their duties. Fourth traffic safety management equipment, traffic safety facilities construction, maintenance, update funds and traffic safety publicity funds should be included in the financial budget of the people's governments at all levels. Chapter II Vehicle Registration Article 5 Motor vehicles and non-motor vehicles that should be registered according to law are not allowed to drive on the road without being registered by the traffic administrative department of the public security organ.

The following vehicles will not be registered:

(a) unicycle, pulley, bicycle by more than 2 people riding;

(two) illegal assembly and modification of vehicles;

(3) Vehicles produced without state permission;

(4) Other vehicles whose registration is prohibited by laws and regulations. Article 6 Where an unregistered motor vehicle needs to travel on the road temporarily, it shall submit the following documents and vouchers and apply to the traffic management department of the municipal public security organ for temporary passage:

(a) the identity certificate of the owner, manager or agent of the motor vehicle;

(2) Proof of the origin of the motor vehicle;

(three) the certificate of conformity or import certificate of the imported motor vehicle.

The traffic administrative department of the public security organ shall complete the temporary motor vehicle license within 1 working days from the date of accepting the application. Meet the conditions, issued a temporary pass; If it does not meet the requirements, it shall explain in writing to the applicant the reasons for not issuing the certificate.

The temporary traffic license plate shall indicate the valid date and driving interval according to the driving needs, but the valid date shall not exceed 30 days at the longest. Article 7 A special motor vehicle used for driving training shall apply to the traffic administrative department of the public security organ for a coach number plate.

The coach car shall run according to the time and route specified by the traffic management department of the public security organ. Chapter III Drivers, Pedestrians and Passengers Article 8 A driver shall not commit any of the following acts:

(1) Vehicles with incomplete driving license, license plate and signs;

(2) Driving a motor vehicle or using a hand-held mobile phone;

(3) Smoking or eating while driving a motor vehicle;

(four) driving a motor vehicle to watch TV, read newspapers and use headphones;

(five) driving a motor vehicle that has not been inspected or failed to pass the inspection within the prescribed time limit;

(six) on the road where parking is prohibited, parking and reverse parking outside the temporary parking berth line of urban roads;

(seven) operating passenger cars on the road with stops, and parking unit traffic vehicles outside the prescribed sites;

(eight) driving a motor vehicle to turn around or turn left on a road section, viaduct or overpass with a solid center line;

(9) Driving motor vehicles to chase each other. Ninth pedestrians shall have the following acts:

(-) disobeying traffic signals, signs and traffic police instructions;

(2) Walking on viaducts and overpasses where pedestrians are prohibited;

(3) When crossing roads with crosswalks, underpasses and overpasses, do not walk crosswalks, underpasses and overpasses;

(four) using skateboards and roller skates to slide on the road;

(5) Crossing and leaning against road isolation facilities. Tenth passengers shall not have the following acts:

(1) Driving on a motor vehicle lane;

(2) Getting on and off from the left side of the motor vehicle on the roadway;

(three) sitting on the side or riding a two-wheeled or three-wheeled motorcycle with his back to the driver;

(4) transporting the body out of the motor vehicle. Eleventh driving a non-motor vehicle, shall not have the following acts:

(1) Driving at the time, section or lane where traffic is prohibited;

(2) Driving in the reverse direction;

(three) do not follow the signal instructions;

(4) Exercise on the sidewalk. Twelfth driving low-speed trucks and tricycles on the road, shall not have the following acts:

(1) Driving on a road section and within a time limit prohibited from passing;

(2) Driving an outdoor manned vehicle; Thirteenth prohibit the following acts:

(a) using motorcycles and wheelchairs for the disabled to engage in business activities;

(2) Non-lower limb disabled people drive disabled motorized wheelchairs;

(three) two-wheeled motorcycle drivers and passengers do not wear special safety helmets according to the regulations;

(four) a car illegally owns more than two license plates;

(5) Multiple vehicles use the same number plate. Chapter IV Road Traffic Safety Article 14 The traffic administrative department of the public security organ may take the following measures according to the road traffic safety situation:

(1) Controlling the number of motorcycles in urban areas;

(2) Delineating the time, area and vehicle types that restrict or prohibit the passage of motor vehicles;

(3) setting up a one-way street;

(4) Issuing temporary motor vehicle passes;

(five) other measures conducive to road traffic safety.

Before the implementation of the above measures, the opinions of all parties shall be solicited by means of seminars, demonstration meetings and hearings according to the situation, and shall be announced to the public 3 days before the implementation.
