Jiangsu province anti-drug regulations

Article 1 In order to crack down on drug crimes, protect citizens' physical and mental health and maintain social order, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province. Article 2 The term "drugs" as mentioned in these Regulations refers to opium, heroin, methamphetamine (ice), morphine, marijuana, cocaine and other narcotic drugs and psychotropic substances that can make people addicted as stipulated by the state. Article 3 Anti-drug work should be comprehensively managed, with prevention first, and the principle of combining specialized organs with the mass line and combining education with punishment should be adhered to, so that drug control must be banned, the source blocked, law enforcement must be strict, and both the symptoms and root causes should be addressed. Article 4 Local people's governments at various levels shall organize and lead the drug control work in their respective administrative areas. Drug control funds are included in financial budgets at all levels.

The public security organ is the competent department for drug control.

The people's courts and people's procuratorates shall perform their respective duties and punish drug crimes according to law.

Judicial, civil affairs, industry and commerce, health, medicine, chemical industry, customs and other relevant departments shall perform their respective duties in drug control work. Fifth radio, television, newspapers and other mass media should use various forms to carry out anti-drug propaganda work to enhance citizens' anti-drug awareness. Article 6 State organs, social organizations, enterprises and institutions, villagers' committees and residents' committees shall be responsible for drug control work in their own systems and units, establish and improve the responsibility system and implement various drug control measures.

The education department should educate students about drug prevention. Article 7 Local people's governments at all levels and relevant departments shall establish a drug crime reporting system, and any unit or individual shall have the obligation to report and expose drug crimes.

Local people's governments at all levels and relevant departments shall protect those who report and expose drug-related illegal and criminal activities according to law, and commend and reward those who have rendered meritorious service. Article 8 Public security organs shall carry out drug investigation, establish registration files of drug-related personnel and crack down on drug trading activities. Ninth public security organs should strengthen the investigation and punishment of drug illegal and criminal activities in key industries and places such as hotels, restaurants, entertainment, transportation and housing rental. Article 10 Illegal cultivation of opium poppy, cannabis and other original drug plants is prohibited, and all illegal cultivation shall be forcibly eradicated. Article 11 It is forbidden to take or inject drugs.

Those who take or inject drugs shall be forced to give up drugs or ordered to give up drugs within a time limit.

Persons who have not given up drug addiction shall not participate in the business activities of hotels, entertainment and other industries, and shall not engage in education, medical care, medicine, driving and other work.

Hotels, entertainment, transportation and other industries and education, medical care, medicine and other units shall not employ persons who have not given up drug addiction. Article 12 Anyone who takes or injects drugs after being forced to give up drugs by the public security organ or ordered to give up drugs within a time limit shall be given reeducation through labor in accordance with the relevant provisions of the state.

For drug addicts, their units, villagers' committees, residents' committees, guardians and families shall, in conjunction with the police station, set up assistance and education groups to prevent them from taking or injecting drugs again.

The local public security organ shall conduct urine tests on drug addicts regularly or irregularly. Thirteenth relevant departments and units shall, in accordance with the division of responsibilities, strengthen the management of the production, operation, use, storage, transportation, import and export of narcotic drugs, psychotropic drugs, drug rehabilitation equipment and precursor chemicals.

The public security organ shall strengthen the supervision and inspection of narcotic drugs, psychotropic drugs and precursor chemicals entering and leaving the main roads in this province. Article 14 Whoever produces, deals in, stores, transports, imports, exports or uses precursor chemicals shall, in accordance with the relevant provisions of the state, implement a licensing and transportation permit system. Fifteenth prohibit any unit or individual from engaging in the following acts:

(1) illegal possession of drugs;

(2) illegally transporting, selling, storing and using poppy shells;

(3) illegally buying, selling, transporting, carrying or holding seeds or seedlings of original plants of drugs that have not been inactivated;

(4) adding poppy shells (seeds) to foods and drinks;

(5) luring, instigating, cheating or allowing others to take or inject drugs;

(6) illegally providing narcotic drugs and psychotropic drugs under state control to drug addicts and injecting drug users;

(7) coercing or inducing others to sell or issue prescriptions or certificates to defraud narcotic drugs and psychotropic drugs under state control.

(eight) illegal production, management, storage, transportation, import and export and use of precursor chemicals;

(nine) without the approval of the state drug supervision and administration department, the production or operation of drug rehabilitation drugs;

(ten) engaged in drug rehabilitation and drug rehabilitation equipment advertising;

(eleven) illegal drug treatment business;

(12) harboring, transferring or hiding drugs or property obtained from illegal crimes for drug criminals. Article 16 If a drug crime constitutes a crime, criminal responsibility shall be investigated according to law.

Smuggling, trafficking, transporting and manufacturing drugs, regardless of the quantity, should be investigated for criminal responsibility and punished. Article 17 Anyone who violates the provisions of Item (3) to Item (8) and Item (12) of Article 15 and does not constitute a crime or the circumstances of the crime are minor, so there is no need to impose a penalty, and the public security organ at or above the county level shall impose a fine of not less than 3,000 yuan but not more than 50,000 yuan.

If a unit violates the provisions of Item (1) to Item (8) and Item (12) of Article 15 of this Ordinance, the public security organ at or above the county level shall impose a fine of not less than 10,000 yuan but not more than 100,000 yuan, and the directly responsible person in charge and other responsible personnel shall impose a fine of not less than 3,000 yuan but not more than 10,000 yuan.
