Sample introduction

When a sample is displayed as a representative of the quality of goods, it represents the general quality of similar goods, including physical characteristics, chemical composition, mechanical properties, appearance, structural characteristics, color, size, taste and so on.

(1) When the sample is displayed as a product promotion, the buyer can have a very clear concept and understanding of the overall characteristics of the product. Usually, when using a sample expression, it will be accompanied by a text or graphic description.

At the same time, the quality of the samples used for display may be different from the quality of the goods actually traded, and the buyer cannot ask the manufacturer or seller to bear the responsibility according to the sample quality.

(2) If the quality of the sample is regarded as the delivery standard of the goods in the transaction, the seller shall bear the responsibility that the delivery quality must be consistent with the sample. If the quality of the delivered goods is different from the sample, the buyer may ask the seller to bear the responsibility according to the sample standard.

Sample-based trading is a simple agreement reached when the quality of goods is complex and the description is very difficult: sample-based trading is really easy, so this model is often used in reality.

However, it is not common to deliver the goods completely according to the sample standard. All the standards of the agreed goods are exactly the same as the samples, so it is very difficult to operate in practice.

Usually, the payment is based on the sample standard, and only the sample standard can be used as the quality basis of a certain aspect of the goods, such as color and style. If the quality of the goods produced by the manufacturers is not exactly the same, for the sake of simplicity, this payment method should not be adopted.

In practice, if payment is made by sample, it should be indicated in the contract that "the quality is roughly the same as the sample".

The sale of samples is only applicable to the sale of subject matter varieties. In order to ensure product quality and reduce transaction risk, sample trading helps buyers find the most reliable source of goods by looking at and taking samples. In order to test whether the subject matter sold is the same quality as the sample, the parties concerned shall seal up the sample for verification. At the same time, the seller shall explain the quality of the samples. The quality of the subject matter delivered by the seller should be the same as that of the sample, which is the basic obligation of the seller in the sales contract by sample.
