Second, prison and detention center personnel cannot live together. Detention center personnel can only be transferred to prison if they are sentenced by the court. People who live in detention centers don't stay long, so people in detention centers don't need to work. Only in prisons are prisoners strictly required to reform their minds or develop skills through labor.

According to Article 2, Chapter 1 of the Regulations of People's Republic of China (PRC) Detention Center, the detention center is an organ for holding criminals who have been arrested and detained according to law. A criminal sentenced to fixed-term imprisonment of not more than one year, or a criminal whose remaining sentence is not more than one year, may also be supervised by a detention center. According to Article 2 of the General Provisions of Chapter 1 of the Prison Law of People's Republic of China (PRC), the prison is the penalty executing organ of the state.

According to the provisions of the Criminal Law and the Criminal Procedure Law, criminals sentenced to death with a two-year suspension, life imprisonment or fixed-term imprisonment shall execute their sentences in prison.
