Measures for the Shantou Special Economic Zone Free Trade Zone Management Committee to exercise municipal-level management authority

Article 1 In order to further accelerate the construction and development of the Shantou Special Economic Zone Bonded Area (hereinafter referred to as the Bonded Area), expand opening up, and create a good investment environment, in accordance with the basic principles of relevant laws and administrative regulations, combined with the Shantou Special Economic Zone Based on the actual situation, these measures are formulated. Article 2 These Measures shall apply to anyone engaged in economic and administrative work in the bonded zone and its supporting construction areas. Article 3 The Shantou Special Economic Zone Bonded Area Management Committee (hereinafter referred to as the Bonded Area Management Committee) is an agency dispatched by the Municipal People's Government. It exercises municipal-level management authority on behalf of the Municipal People's Government and implements unified management of various administrative and economic affairs in the Bonded Area. Article 4 The functional departments established by the Free Trade Zone Management Committee with the approval of the Municipal People's Government are responsible for exercising the management authority of the relevant municipal functional departments and accept the guidance of the corresponding functional departments of the Municipal People's Government in terms of business. Article 5 The Bonded Zone Management Committee and its functional departments shall exercise the municipal-level management authority conferred by these Measures and handle it in the following manner:

(1) Matters within the scope of its authority and functions shall be handled by the Management Committee or the approval of its functional departments, and report it to the Municipal People's Government or the relevant functional departments of the Municipal People's Government for record;

(2) Matters that need to be reported to higher authorities shall be given priority by the relevant departments of the Municipal People's Government, or by the Free Trade Zone The Administrative Committee shall report directly;

(3) The issuance of certificates by the Municipal People's Government and its relevant functional departments will be transferred to the Bonded Zone Administrative Committee and the corresponding functional departments to be responsible for direct issuance. Article 6 The Free Trade Zone Management Committee and its functional departments shall abide by the following regulations when exercising municipal-level management authority:

(1) Strictly implement the provisions of relevant laws, regulations and rules;

(2) Exercise powers within the scope of authority stipulated in these Measures;

(3) When issuing relevant certificates at the municipal level, use certificates with complete seals, unified formats, and unified numbers provided by the relevant municipal functional departments , report to the relevant functional departments of the Municipal People's Government for filing. Article 7 The Free Trade Zone Management Committee may formulate administrative regulations in accordance with the law, pilot free zone policies in accordance with international practice, and conduct economic system reform experiments. Article 8 The Free Trade Zone Management Committee shall prepare the economic and social development plan of the Free Trade Zone based on the functions of the Free Trade Zone and organize its implementation. Article 9 The Free Trade Zone Management Committee shall exercise the following planning management and enterprise management authority:

(1) Responsible for issuing annual plans for infrastructure projects and technological transformation;

(2) Examining and approving municipal-level plans For fixed asset investment projects within the quota, a fixed asset investment license will be issued;

(3) Examine and approve social public welfare projects such as industry, agriculture, commerce, transportation, energy, real estate, culture, education, health, and sports, etc. Business projects;

(4) Examine and approve industrial technology transformation projects and handle project establishment procedures in accordance with regulations;

(5) Review and issue enterprise industrial product production and operation licenses;

Article 10 The Free Trade Zone Management Committee is responsible for organizing the preparation of the overall plan for the Free Trade Zone and submitting it to the municipal government for approval and implementation. Article 11 The Bonded Zone Management Committee shall exercise the following planning and construction management authority:

(1) Based on the overall plan of the Bonded Zone, prepare a detailed plan for the Bonded Zone and submit it to the Municipal People's Government for approval before organizing its implementation;

< p>(2) Examine and approve the planning and design of various projects;

(3) Review the qualifications of architectural design, construction, supervision, and real estate development enterprises entering the bonded zone;

(4) Organize construction project bidding in accordance with the law (investment by direct government investment, government equity investment and government-guaranteed investment using foreign loans for on-lending, as well as construction projects invested by state-owned enterprises and public institutions, collective enterprises and enterprises with dominant public property rights) (Except construction projects);

(5) Manage the construction projects of various construction projects and organize quality acceptance in accordance with relevant national, provincial and municipal regulations;

(6) Approval and approval of construction projects Preliminary project site selection letter, construction land planning permit, construction project planning permit, construction project construction permit and other certificates.

Article 12 The Bonded Zone Management Committee shall exercise the following land and real estate management authority:

(1) Handle land acquisition procedures in accordance with relevant national, provincial and municipal regulations;

(6) Issue certificates such as state-owned land use certificates, non-agricultural construction land licenses, real estate rights certificates, commercial housing pre-sale licenses, and commercial housing export licenses. Article 13 The Bonded Zone Management Committee shall exercise the following environmental protection management authority:

(1) Prepare the bonded zone environmental protection plan and incorporate it into the bonded zone overall plan;

(2) According to the environmental protection plan Plan and rationally arrange industrial projects;

(3) Examine and approve environmental protection design and construction projects;

(4) Collect sewage discharge fees and excessive sewage discharge fees and carry out environmental protection law enforcement;

(5) Issue environmental protection construction licenses, environmental protection facility acceptance certificates, pollutant discharge licenses and other certificates. Article 14 The Bonded Area Management Committee is responsible for the construction, maintenance, and management of the bonded area’s municipal administration, greening, water supply, power supply, environmental sanitation, and public facilities.
