The term "inter-regional operation intermediary service organization" as mentioned in these Measures refers to the unit that organizes combine harvester to go out to work or introduce combine harvester to work. Article 3 Drivers and auxiliary operators of combine harvesters engaged in trans-regional operations, as well as units and individuals related to trans-regional operations, shall abide by these Measures. Article 6 The administrative departments of agricultural machinery at all levels shall, under the unified leadership of the people's governments at the corresponding levels, take effective measures in accordance with the law in conjunction with the relevant departments of public security, transportation, prices, industry and commerce to ensure the smooth operation of cross-regional operations. Chapter II Intermediary Service Organizations Article 7 Encourage and support agricultural machinery extension stations, township agricultural machinery stations, agricultural machinery operation service companies, agricultural machinery cooperatives and large agricultural machinery enterprises. Establish cross-regional intermediary service organizations and carry out cross-regional intermediary service activities.
Cross-regional operation intermediary service organizations can engage in cross-regional operation intermediary services only after they have obtained the qualification of cross-regional operation intermediary after being examined and determined by the agricultural machinery management department at or above the county level. Article 8 A trans-regional intermediary service institution shall meet the following conditions:
(1) Abide by and implement national and local laws, regulations and policies on cross-regional operation;
(2) Being able to bear civil liability independently;
(three) with the corresponding transportation, communication and other service equipment and technical service personnel. Article 9 Inter-regional operation intermediary service organizations may, according to market demand, set up a number of inter-regional operation teams to organize combine harvesters and drivers to engage in inter-regional operations.
Inter-regional operation intermediary service organizations are responsible for unified contact with operation tasks, ensuring the safe transfer of combine harvesters, coordinating and solving operation disputes in time, and assisting in the maintenance and oil supply of combine harvesters.
Combine harvesters and drivers participating in cross-regional operation teams shall obey the management and scheduling of cross-regional operation intermediary service organizations. Article 10 Inter-regional operation intermediary service organizations shall sign intermediary service contracts with the drivers of combine harvesters to clarify the rights and obligations of both parties.
The service fees charged by the inter-regional intermediary service institutions shall be implemented in accordance with the provisions of the local provincial price departments. If the service fee standard is not formulated, it shall be agreed by the inter-regional intermediary service agency and the combine driver on the principle of fairness and voluntariness. It is strictly forbidden to charge only for no service or to charge more for less service. Eleventh cross-regional operation of the supply and demand sides should sign a cross-regional operation contract, reasonably determine the number and task of introducing or going out combine harvester. After the signing of the trans-regional operation contract, it shall be reported to the local agricultural machinery management department for the record.
Cross-regional operation contracts generally include the following contents: number and model of combine harvester, operation place, operation area, operation price, operation time, rights and obligations of both parties, liability for breach of contract, etc. Chapter III Management of Cross-regional Operation Article 12 The owner of a combine engaged in cross-regional operation shall apply to the local agricultural machinery management department at or above the county level for the cross-regional harvesting operation certificate of the combine (hereinafter referred to as the operation certificate). "Work permit" is issued free of charge and registered with the Ministry of Agriculture step by step. Thirteenth to apply for the "work permit" of the combine harvester shall meet the following conditions:
(a) holding a valid license plate and driving license issued by the agricultural machinery supervision institution;
(2) Participating in cross-regional operation teams;
(three) other conditions stipulated by the provincial agricultural machinery management department.
No work permit shall be issued to combine harvesters that have not participated in cross-regional operation teams, and no work permit shall be issued to those that cross administrative regions. Fourteenth "work permit" by the Ministry of agriculture unified production, universal, effective in that year. The work permit should be carried at random, with one card for each machine. It is strictly prohibited to alter, lend, forge or resell. When both parties have objections to the quality of work, they may apply to the agricultural machinery management department at or above the county level for coordination and settlement. Eighteenth combine harvesters and drivers, auxiliary workers should be strictly in accordance with the requirements of the "Regulations on Safety Supervision of Combine Harvesters and Drivers", to prevent agricultural machinery accidents and achieve safe production. Accidents of agricultural machinery operating across regions shall be reported to the local agricultural machinery management department in a timely manner and accepted for investigation and handling.
