Regulations of Shanghai Municipality on the Administration of Domestic Waste

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Law of the People's Republic of China on the Promotion of Circular Economy, the Regulations on the Administration of City Appearance and Environmental Sanitation, and in light of the actual situation of this Municipality. In order to strengthen the management of domestic waste in this city, improve the living environment, promote the fine management of the city, maintain ecological security and ensure the sustainable development of economy and society. Article 2 These Regulations shall apply to activities such as source reduction, release, collection, transportation, disposal, resource utilization, supervision and management of domestic garbage within the administrative area of this Municipality.

The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life and the solid waste identified as domestic waste by laws and administrative regulations. Article 3 This Municipality aims to realize the reduction, recycling and innocuity of domestic garbage, establish and improve the whole process classification system of classified delivery, classified collection, classified transportation and classified disposal of domestic garbage, and actively promote the reduction and recycling of domestic garbage.

The management of domestic waste in this city follows the principles of government promotion, participation of the whole people, market operation, overall planning of urban and rural areas, systematic promotion and gradual progress. Article 4 Domestic garbage in this Municipality shall be classified according to the following standards:

(1) Recyclable materials refer to domestic wastes such as waste paper, waste plastics, waste glass products, waste metal and waste fabrics. Suitable for recycling;

(2) Hazardous wastes refer to domestic wastes such as waste batteries, waste lamps, waste medicines, waste paints and their containers that cause direct or potential harm to human health or the natural environment;

(3) Wet garbage, that is, perishable garbage, refers to the domestic garbage of perishable substances such as kitchen garbage, leftovers, expired foods, melons, skins and stones, flowers and plants, and Chinese medicine residues;

(4) Dry garbage, that is, other garbage, refers to other domestic garbage except recyclables, harmful waste and wet garbage.

The specific classification standards of domestic waste can be adjusted according to the level of economic and social development, the characteristics of domestic waste and the needs of disposal and utilization. Article 5 The Municipal People's Government shall strengthen its leadership over the management of domestic waste in this Municipality, establish a comprehensive coordination mechanism for domestic waste management, and make overall plans for the management of domestic waste.

The municipal greening department is the competent department of municipal solid waste management, and is responsible for the organization, coordination, guidance and supervision of municipal solid waste management.

The municipal development and reform department is responsible for formulating policies to promote the source reduction, resource utilization and harmless disposal of domestic waste, coordinating the implementation of the extended producer responsibility system, and studying and improving the charging mechanism for domestic waste treatment.

City housing management department is responsible for urging property service enterprises to fulfill the obligations of the person responsible for the classified management of domestic waste.

The municipal ecological environment department is responsible for the guidance and supervision of pollution prevention and control of domestic garbage disposal.

The municipal urban management law enforcement department is responsible for guiding and supervising the investigation and punishment of violations of the provisions on the classification and management of domestic waste.

The departments of urban and rural housing construction, commerce, finance, planning, economic informatization, education, civil affairs, agriculture and rural areas, science and technology, health and wellness, cultural tourism, market supervision, postal services, and government administration of this Municipality shall, in accordance with their respective functions and duties, cooperate in the implementation of these Regulations. Article 6 The District People's Government shall be responsible for the management of domestic waste within its jurisdiction, and establish corresponding comprehensive coordination mechanism.

The district greening and city appearance department is responsible for the specific organization, coordination, guidance and supervision of domestic waste management within its jurisdiction. District development and reform, housing management, ecological environment, urban management and law enforcement departments shall, in accordance with their respective responsibilities, work together to promote the management of domestic waste within their respective jurisdictions.

Township people's governments and sub-district offices shall be responsible for the specific implementation of daily management work such as classified delivery, classified lightering and related classified collection of domestic garbage within their respective jurisdictions. Seventh units and individuals should actively participate in the green life action, reduce the generation of domestic waste, fulfill the obligation of domestic waste classification, and bear the responsibility of domestic waste producers.

In accordance with the principle of "whoever produces pays", this Municipality has gradually established a metering and charging system and classified pricing system for domestic garbage disposal. The specific measures shall be formulated separately by the Municipal People's Government. Article 8 This Municipality implements the system of controlling the total amount of regional domestic garbage disposal. The Municipal People's Government shall, in accordance with the requirements of the whole process of classified management of domestic waste in this Municipality, and in combination with the population size and economic and social development level of each district, formulate the total amount control plan for domestic waste disposal in each district. The district people's governments shall, according to the total amount control plan of domestic waste disposal in this district, implement the measures of reducing and recycling domestic waste. Article 9 The people's governments at all levels in this Municipality and their relevant departments shall take effective measures to strengthen the publicity and education on source reduction, whole-process classified management and resource utilization of domestic waste, raise citizens' awareness of domestic waste classification, popularize the knowledge of domestic waste classification, and promote the formation of a good atmosphere for the participation of the whole society. Article 10 This Municipality supports government departments, enterprises, institutions and social organizations to use scientific and technological means to gradually improve the intelligent level of classified delivery, collection, transportation, disposal, management and operation of domestic garbage.

This Municipality supports the research and development and application of new technologies, new processes, new materials and new equipment in the aspects of source reduction, classified delivery, on-site disposal and resource utilization of domestic waste.
