A, land compensation fees, resettlement fees and other expenses.
On the basis of strictly implementing the Provisions on Compensation and Resettlement for Land Expropriation in Shuangliu County (Han [20065438+0] No.65) and the Trial Opinions on Several Policies for Coordinating Urban and Rural Economic and Social Development and Accelerating Urbanization (Shuangweifa [2003] No.74), the land compensation fee, resettlement subsidy, relocation transition fee, relocation fee and reward are determined.
(a) the land compensation fee for the expropriation of cultivated land shall be implemented according to the current regulations, that is, the compensation standard shall be 6 to 10 times of the average annual output value of the cultivated land in the three years before the expropriation. The standard of resettlement subsidy for each agricultural population who needs to be resettled in the expropriation of cultivated land is 4 to 6 times of the average annual output value in the three years before the expropriation of cultivated land. Farmland resettlement subsidy is calculated according to the number of agricultural population to be resettled. The number of agricultural population to be resettled shall be calculated according to the number of cultivated land expropriated divided by the average number of cultivated land occupied by each expropriated unit before land expropriation. The sum of land compensation fees and resettlement subsidies paid in accordance with the above provisions shall not exceed 30 times the average annual output value of the land in the three years before expropriation.
(2) The compensation for ground attachments and young crops shall be implemented in accordance with the Measures for Compensation and Resettlement for Land Requisition in Shuangliu County, and towns (streets) shall be responsible for formulating detailed implementation rules according to the different positions, types and quantities of attachments. Town (street) compensation and demolition of attachments and young crops on the ground shall not exceed 5000 yuan.
(three) the categories and methods of housing placement shall be implemented with reference to the following standards.
1. The object of housing resettlement refers to the rural villagers whose permanent population enjoys the right to use rural homestead within the scope of land acquisition. The object of population resettlement refers to those whose cultivated land has been completely expropriated by collective economic organizations, those whose land has been expropriated, users whose land has been expropriated, servicemen with household registration within the scope of land expropriation, students in school, prisoners or reeducation-through-labor personnel, five-guarantee providers and other personnel who should be resettled according to policies and regulations. If the house placement of the demolition resettlement object is implemented by changing houses into houses, it shall be calculated at 35 square meters per capita, and the part of the original main house of the relocated household that exceeds 35 square meters per capita shall be given monetary compensation in accordance with the relevant provisions; The original housing area of the relocated households is less than 35 square meters per capita, and the insufficient part will not be paid.
2. The object of demolition and resettlement shall be resettled according to the per capita housing of 35 square meters, and then a set of resettlement houses shall be purchased, each person shall not exceed 15 square meters, and the price shall be calculated according to the comprehensive construction cost. The comprehensive cost price consists of the direct construction of resettlement housing project cost and supporting services such as roads, greening and squares that need to be shared by the public. Unified construction, the per capita resettlement area shall not exceed 50 square meters. Towns (streets) shall formulate specific resettlement plans for the housing resettlement of people who have houses but no houses and households without houses.
(4) Because the relocated households have no existing houses for resettlement, and the relocation involves housing transition, subsidies will be given according to the resettlement population in the household registration area per person per month 120 yuan, with a maximum of 12 months. If the resettlement house is not implemented within the time limit, the transition fee will be subsidized by 50% every year according to the above standards.
(5) Expropriation of land involves relocation subsidies for relocated households. According to the distribution of people resettled at home, each person will receive a one-time subsidy of 100 yuan.
(six) actively cooperate with the land acquisition and demolition work, and complete the demolition ahead of time or on time, and reward them according to the standard of no more than 2000 yuan per household.
(7) working expenses. Due to the organization and implementation of land acquisition, the towns (streets) involved are subsidized by 3000 yuan per mu. The departments, towns (streets), villages, groups and county governments with heavy workload, outstanding achievements, few petitions and rapid progress shall be commended and rewarded, and the incentive measures shall be formulated by the county government jointly with relevant departments.
(eight) the relevant incentives and compensation funds involved in the demolition, and the employment training funds for the farmers who have been demolished are allocated by the county finance in the land revenue.
(9) Time of execution. From the date when this notice is officially issued, all newly requisitioned land and project land for which the demolition compensation scheme has not been determined shall be implemented according to this standard. The related compensation involved in the second batch of "hospital demolition and hospital merger" in our county shall be implemented with reference to the above standards.
Second, do a good job in the basic work of land acquisition compensation.
Basic information such as location, area, compensation object, standard and demolition involved in land acquisition projects shall be registered by towns (streets), submitted to the County Bureau of Land and Resources for examination and approval, and an audit opinion shall be issued. After the examination and approval, towns (streets) should organize the publicity of land acquisition compensation standards and accept supervision from all sides. Publicity shall be carried out in communities (groups) according to procedures, and the contents of compensation publicity shall include the number of relocated households per household, compensation standards, total demolition price, etc. Involving house demolition, towns (streets) should provide the demolition parties with the basic information of the houses of the relocated households, demarcation documents, agreements (contracts), pictures and video confirmation.
The audit, allocation, management and use of land acquisition compensation and resettlement funds shall be carried out in strict accordance with the Notice on Printing and Distributing the Management Opinions on Land Acquisition Compensation and Resettlement Funds in Shuangliu County (Shuang Fu Letter [2007] No.43).
Three, earnestly do a good job in social security and employment security for new land acquisition targets.
Employment subsidies and social insurance for land-expropriated farmers shall be governed by the Social Insurance Measures for Land-expropriated Farmers in Shuangliu County (No.68 [2005] of Shuangfufa) and its supporting documents, which shall be organized and implemented by the town (street) in conjunction with the county labor and social security department. County labor, land and finance departments should seriously study the new problems in the social security work of newly-acquired farmers, and take further measures to effectively do a good job in the social security and employment security work of newly-acquired farmers. At the same time, further strengthen the employment training for landless peasants to ensure their long-term livelihood.
Fourth, further improve the land acquisition management system.
Land requisition compensation and resettlement must adhere to the centralized and unified management of land resources by county governments and further rationalize the land requisition management system. The town government (street office) related to the implementation of land acquisition is responsible for carrying out specific transactional work, and the county land and resources bureau is responsible for guidance. County Finance Bureau is responsible for timely and full allocation of compensation fees related to land acquisition to towns (streets) in accordance with the law, and strengthen supervision over the use of funds, and towns (streets) are responsible for distributing them to the collective economic organizations and farmers whose land has been expropriated. The relevant administrative departments shall, in accordance with their respective responsibilities, cooperate in land acquisition related work. Townships (streets) and villages (groups) whose land has been expropriated should fully cooperate with the compensation and resettlement work for land expropriation.
Five, strengthen the organization and leadership of land acquisition compensation and resettlement work.
Relevant departments of towns (streets) and county governments should attach great importance to compensation and resettlement for land acquisition and demolition, and earnestly strengthen organizational leadership. The "top leaders" should personally take overall responsibility, and the leaders in charge and relevant departments should earnestly perform their duties and do a good job in guidance and service. It is necessary to further implement the responsibility system for land acquisition compensation and resettlement, establish posts and responsibilities, and strictly investigate the responsibilities. For those who neglect their duties, abuse their powers, engage in malpractices for selfish ends and damage the legitimate rights and interests of the masses, enterprises and rural collective economic organizations in land acquisition, the person directly responsible shall be held accountable and the relevant leaders shall be held accountable. If the case constitutes a crime, criminal responsibility shall be investigated according to law; If it does not constitute a crime, it shall be given administrative sanctions and disciplinary sanctions in accordance with relevant regulations.
Six, improve the unified land acquisition work organization.
