Decision of the Standing Committee of Hunan Provincial People's Congress on Promoting and Safeguarding Fishing Prohibition in the Yangtze River Basin

First, our province fully implements the national regulations on strengthening the protection of aquatic organisms in the Yangtze River and doing a good job in the work related to the ban on fishing in the Yangtze River, and regards the ban on fishing in the Yangtze River as a major task at present and in the future to ensure that the ban on fishing and related work are effective. Two, the following waters are closed to fishing:

(a) the Yangtze River Basin Aquatic Biological Reserve;

(2) Hunan section of the Yangtze River and Dongting Lake;

(3) Xiangjiang, Zijiang, Yuanjiang and Lishui;

(four) other fishing areas determined by the people's governments at or above the county level and announced by the provincial agricultural and rural authorities.

No fishing period shall be implemented in accordance with the relevant provisions of the state and this province. 3. Productive fishing is completely prohibited in aquatic biological reserves, and productive fishing of natural fishery resources is prohibited in other fishing areas during the fishing ban period. Fishing due to special needs such as breeding, scientific research and monitoring shall be carried out in accordance with relevant national and provincial regulations.

It is forbidden for ships (boats and rafts) without ship name number, ship certificate and port of registry to sail or berth in the no-fishing area. Four, aquatic biological protection areas, drinking water source protection areas prohibit fishing. Other fishing areas can be used for recreational fishing, but the following provisions shall be observed:

(a) not one person, multi-pole, multi-hook, multi-line and multi-hook fishing;

(two) shall not use video AIDS, fishing gear fishing;

(three) shall not use boats, rafts and other floating objects for fishing;

(four) shall not use the bait, nest and additives containing toxic and harmful substances and the bait of aquatic organisms such as fish and shrimp for fishing.

In violation of the provisions of the preceding paragraph, the competent agricultural and rural departments of the people's governments at or above the county level shall order them to stop the illegal acts and confiscate fishing gear; If there are illegal gains, the illegal gains shall be confiscated. Where laws and regulations provide otherwise, such provisions shall prevail. Five, the people's governments at or above the county level shall strengthen the leadership of the fishing ban, the fishing ban will be included in the scope of the river length system, standardize the construction of law enforcement teams, ensure the funds for the fishing ban, and the fishing ban will be included in the scope of target management performance appraisal.

The competent agricultural and rural departments of the people's governments at or above the county level take the lead in carrying out the ban on fishing, and the departments of development and reform, public security, finance, human resources and social security, transportation, water conservancy, forestry, market supervision and management shall do a good job in the ban on fishing according to their respective duties.

Township (town) people's governments and subdistrict offices shall carry out daily patrols in the no-fishing areas, strengthen the registration management of township boats, and urge ship owners and users to abide by the relevant provisions of the no-fishing areas. Six, the competent departments of agriculture and rural areas of the people's governments at or above the county level shall, jointly with the departments of public security, transportation, market supervision and management, water conservancy, etc., improve the linkage mechanism of fishing ban law enforcement and close departmental cooperation.

The people's governments at or above the county level shall establish and improve the cross-regional cooperation mechanism for the prohibition of fishing in the Yangtze River Basin. The provincial people's government should strengthen information sharing and administrative law enforcement cooperation with neighboring provinces and cities. Seven, human resources and social security, agriculture and rural areas, civil affairs, medical insurance and other departments of the people's governments at or above the county level shall implement supporting policies, strengthen employment guidance and vocational skills training for retired fishermen, broaden the channels for changing jobs, and do a good job in the minimum living security, temporary assistance and medical security for eligible retired fishermen.

The people's governments at or above the county level shall make overall arrangements for relevant funds to support the fund demand for resettlement and social security of retired fishermen. Eight, units and individuals should enhance the awareness of the protection of aquatic organisms, have the right to stop and report violations of fishing regulations.

Encourage mass media such as radio, television, newspapers, and the Internet to publicize laws, regulations, and policies prohibiting fishing, increase the content of prohibiting fishing in public service advertisements, and create an atmosphere of consciously observing the prohibition of fishing and protecting the ecology.

Fishing industry associations should strengthen publicity and self-discipline management, and guide anglers to abide by laws, regulations and relevant provisions and fish in a civilized manner. Nine, this decision shall come into force as of June 2022 1 day.
