Chapter I General Provisions Article 1 In order to promote the development of urban greening in this Municipality, protect and improve the ecological environment, and build an ecologically livable green city, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Urban Greening Regulations of the State Council and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, protection and management of urban greening in the urban planning area of this Municipality and the planning area where the county (city) people's government is located. Article 3 The administrative department in charge of urban greening shall be responsible for urban greening.

County (city) and district urban greening administrative departments shall be responsible for urban greening work within their respective administrative areas under the guidance of the municipal urban greening administrative departments.

Urban and rural planning, natural resources, development and reform, finance, civil air defense, urban management, real estate registration and trading, transportation, highways, water conservancy, canal management, market supervision and management, tourism, public security, cultural relics management and other relevant departments shall, in accordance with their respective responsibilities, do a good job in urban greening.

Township people's governments and sub-district offices shall, in accordance with their duties, do a good job in urban greening within their respective jurisdictions.

The greening work managed by the forestry administrative department as stipulated by relevant laws and regulations shall be implemented in accordance with its provisions. Article 4 The municipal and county (city) people's governments shall incorporate the urban greening construction into the national economic and social development plan, determine the development goals of urban greening in their respective administrative areas, implement the urban greening target responsibility system, ensure the land and funds needed for public greening construction, and ensure the implementation of public greening maintenance management funds.

City, county (city) people's government should guide social funds to participate in urban greening construction and maintenance management.

Encourage units and individuals to use their own space to carry out greening. Fifth urban greening should adhere to the principles of ecological priority, scientific development, equal emphasis on quantity and quality, perfect functions, local conditions, resource conservation, government-led and social participation. Pay attention to the protection of biodiversity and the application of native plants, pay attention to the selection and improvement of tree species, strengthen the cultivation and planting of urban flowers and trees, promote the construction of ecological civilization with the concept of green development, and promote the sustainable development of nature and human settlements.

The administrative department in charge of urban greening should strengthen scientific research on urban greening, popularize new materials, new technologies and new achievements, encourage and popularize the construction of sponge garden green space, encourage and implement three-dimensional greening, and build a conservation-oriented garden green city. Article 6 Any unit or individual with the ability to work shall fulfill the obligation of planting trees or other urban greening in accordance with the relevant provisions of the state, provinces and cities.

All units and individuals have the right to enjoy the fruits of urban greening, have the obligation to care for the fruits of urban greening and greening facilities, and have the right to dissuade, complain and report acts that damage urban greening and its facilities. Seventh urban greening administrative departments shall, jointly with relevant departments, organize the popularization of urban greening scientific knowledge, and enhance the awareness of the whole society to fulfill its greening obligations and care for greening achievements and greening facilities. Eighth city and county (city) people's government shall commend and reward the units and individuals that have made remarkable achievements in urban greening. Chapter II Planning and Construction Article 9 The urban green space system planning shall be jointly prepared by the municipal, county (city) administrative department of urban and rural planning and the administrative department of urban greening according to the overall urban planning, implemented after being approved by the people's government at the same level, and reported to the Standing Committee of the people's congress at the same level for the record.

Before the urban green space system planning is submitted for examination and approval, the organization organ shall solicit the opinions of relevant units, experts and scholars and the public through demonstration meetings, hearings or other means, and publish the draft plan according to law for not less than 30 days.

If it is really necessary to change the urban green space system planning in the implementation, it shall be re-examined and filed in accordance with the original examination and approval procedures. Tenth the preparation of urban green space system planning should be based on the characteristics of cities and counties (cities), determine the goal and layout of urban greening, and rationally arrange the green space area that is suitable for the urban population and urban area; Using the existing natural and human conditions such as topography, landforms, water bodies, vegetation and historical and cultural sites, and taking the principle of protecting the original ecology and facilitating the public as the principle, scientifically set up all kinds of green spaces. Eleventh city and county (city) people's government shall, according to the urban green space system planning, prepare the annual construction plan, and organize the implementation. Article 12 The administrative department in charge of urban and rural planning of the city and county (city) shall, jointly with the administrative department in charge of urban greening, delimit the urban green line according to the overall urban planning, urban green space system planning, regulatory detailed planning, constructive detailed planning and the present situation of urban green space, and implement it after being approved by the people's government at the same level, and announce it to the public and accept public supervision.

After the green line is determined, no unit or individual may change it without authorization. If it is really necessary to adjust due to urban construction, the competent administrative department of urban and rural planning of the city and county (city) shall, jointly with the competent administrative department of urban greening, re-plan the green space in similar areas without reducing the total amount of planned green space, and report it to the original examination and approval authority for approval in accordance with the planning examination and approval authority.

Where the adjustment of urban green line involves the revision of overall urban planning, urban green space system planning, regulatory detailed planning and construction detailed planning, it shall be implemented in accordance with the relevant provisions of urban and rural planning laws, regulations and these Regulations. Thirteenth city planning and construction should leave enough green land. The green rate of the following construction projects shall be implemented in accordance with the following provisions:

(a) the green rate of residential areas is not less than thirty percent;

(two) the unit courtyard green rate is not less than thirty percent, of which, the green rate of education and scientific research, medical and health, nursing homes, government organizations, public cultural facilities and other units is not less than thirty-five percent; Greening rate of transportation hub, warehouse, business center, etc. Not less than 20%;

(three) the green rate of landscape roads is not less than forty percent; The green rate of roads with a red line width greater than fifty meters shall not be less than thirty percent; The green rate of roads with a red line width of more than forty meters and less than fifty meters shall not be less than twenty-five percent; The green rate of roads with a red line width of less than forty meters shall not be less than twenty percent;

(four) the rate of green space around urban rivers, lakes and other water bodies and the width of green belts of railways and highways shall conform to the urban green space system planning and relevant technical standards.

If the construction projects listed in the first, second and third items of the preceding paragraph belong to the old city reconstruction project, the green rate can be reduced by five percentage points.
