Chapter 1 Functions and Tasks

Article 3: Assist the government in managing and serving the non-public economy.

Article 5: Participate in the coordination of labor relations, coordinate with social management, and promote social harmony and stability.

Article 7 Strengthen the management and protection of association property in accordance with the law.

Chapter 2 Membership

Article 8 Any enterprise, group or individual that recognizes this charter, voluntarily joins an organization of the Federation of Industry and Commerce, and promises to fulfill its membership obligations may apply for membership.

(1) All types of enterprises will become enterprise members after their application for membership is approved.

The main body of corporate members are non-public enterprises, mainly including private enterprises, limited liability companies and joint-stock companies controlled by non-public economic components, Hong Kong and Macao investment enterprises, etc.

(2) Industry associations, industry chambers of commerce, non-local chambers of commerce, private enterprise associations, self-employed workers associations and other industrial and commercial associations and other relevant social organizations with legal person status shall become group members after their application for membership is approved;

The chamber of commerce affiliated to the Federation of Industry and Commerce is a group member.

(3) Major investors and operators of non-public enterprises, individual industrial and commercial households, etc., shall become individual members after their application for membership is approved;

Relevant persons related to the work of the Federation of Industry and Commerce Individuals and business people from Hong Kong and Macao who invest in the Mainland can apply to become individual members;

Representatives of units that have established working relationships with the Federation of Industry and Commerce can be invited to join as individual members after negotiation;

Former industrial and commercial persons are all individual members.

Article 9: Implement the principle of voluntary membership and freedom of membership.

The federations of industry and commerce at all levels can formulate specific membership conditions and procedures for joining and withdrawing members based on the provisions of this charter and the actual situation, and report them to the higher-level federation of industry and commerce for record.

Article 10 If a member violates this charter or violates criminal laws, his or her membership shall be suspended or cancelled.

Article 11 Members of local federations of industry and commerce at all levels are also members of higher-level federations of industry and commerce.

Article 12 Members have the following rights:

(1) The right to elect, be elected and vote;

(2) To report opinions and demands to the Federation of Industry and Commerce and suggestions;

(3) Participate in visits, study and training activities organized by the Federation of Industry and Commerce;

(4) Accept services provided by the Federation of Industry and Commerce;

(5) Require the Federation of Industry and Commerce to safeguard its legitimate rights and interests;

(6) Supervise the work of the Federation of Industry and Commerce.

Article 13 Members have the following obligations:

(1) Comply with this Articles of Association;

(2) Implement organizational resolutions;

(3) Pay membership dues as required;

(4) Care and support the work of the Federation of Industry and Commerce;

(5) Accept organizational supervision;

(6) Handle Matters delegated by the organization.

Chapter 3 Organization

Article 14 The Federation of Industry and Commerce shall establish national organizations and local organizations according to national administrative divisions: the All-China Federation of Industry and Commerce is the national organization, referred to as the All-China Federation of Industry and Commerce; provincial , Federation of Industry and Commerce of Autonomous Regions, Municipalities directly under the Central Government and Xinjiang Production and Construction Corps Federation of Industry and Commerce, and Federation of Industry and Commerce of cities (regions, autonomous prefectures, leagues, and districts of municipalities directly under the Central Government) are local organizations. Article 16 The organizational principle of the Federation of Industry and Commerce is democratic centralism. The higher-level federation of industry and commerce has a guiding relationship with the lower-level federation of industry and commerce.

Article 17 The highest authority of the Federation of Industry and Commerce is the Congress (General Assembly of Members). Its powers are:

(1) Hear and review the report of the Executive Committee;

(2) Elect the Executive Committee;

(3) Discuss and decide on the Federation of Industry and Commerce important matters.

The National Congress of the China Federation of Industry and Commerce is responsible for amending the charter.

Article 18 The Federation of Industry and Commerce Representative Conference (Member Conference) shall be held every five years. The meeting can be held in advance or postponed if necessary.

The Congress (General Assembly) is convened by the Executive Committee. During the conference, the elected presidium presides over the meeting.

Article 19: Delegates to the Federation of Industry and Commerce Congress shall be selected through consultation and selection, and some representatives may be specially invited as needed.

The number of representatives and distribution methods for the congress shall be determined by the Executive Committee or the authorized Standing Committee.

Article 20: The Executive Committee of the Federation of Industry and Commerce is the highest leadership body of the Federation of Industry and Commerce during the intersessions of the Congress (membership conference). Its functions and powers are:

(2) Listen to and review the reports of the Standing Committee;

The allocation and selection method of members of the next executive committee shall be determined by the previous executive committee or the authorized standing committee.

Article 21 Responsibilities and obligations of Executive Committee members:

(2) Give full play to the role of participating in and discussing politics, and make suggestions on important issues in economic and social development;

(3) Love the work of the Federation of Industry and Commerce and participate in organized conference activities;

(5) Contact members extensively to reflect their opinions and requirements;

(6) Provide opinions and suggestions on the work of the Federation of Industry and Commerce.

Article 22 The Standing Committee is composed of the Chairman, Vice Chairman, Secretary-General and Standing Committee members. Each term is the same as that of the Executive Committee. It exercises the powers of the Executive Committee when the Executive Committee is not in session:

(1) Implement the resolutions of the Executive Committee;

(2) Discuss research tasks;

(3) Be responsible to the Executive Committee and report on its work.

Standing committee meetings are held twice a year.

The allocation and selection method of members of the next standing committee shall be determined by the previous executive committee or the authorized standing committee.

The county-level Federation of Industry and Commerce will decide whether to set up a standing committee depending on the situation.

Article 23 The chairman shall preside over the affairs of the meeting, and the vice-chairman shall assist the chairman in his work. The chairman and vice-chairmen form a chairman's meeting to study and decide on important matters.

Vice-chairmen are divided into full-time vice-chairmen and part-time vice-chairmen. In principle, the full-time vice chairman shall not serve more than two consecutive terms. In principle, part-time vice-chairmen of the All-China Federation of Industry and Commerce shall not serve consecutively, and part-time vice-chairmen of local federations of industry and commerce shall in principle serve no more than two consecutive terms.

The All-China Federation of Industry and Commerce and provincial-level federations of industry and commerce have standing vice-chairmen, who are elected by the executive committees at the same level.

The secretary-general of the local federation of industry and commerce is elected by the executive committee at the same level and is a member of the chairman's meeting.

The leadership bodies and leaders produced by each executive committee will continue to preside over the regular work during the next session of the Congress (Member Conference) until the next executive committee produces new leadership bodies and leaders.

Article 24: Executive Committee meetings, Standing Committee meetings, and Chairman meetings may be held by communication under special circumstances.

Article 25 If an executive member fails to attend the meetings of the Executive Committee three times without approval, he shall be removed from his position as an executive member; if a standing member fails to attend three meetings of the Standing Committee, he shall be removed from his position as a standing member.

Article 26 The members of the Executive Committee and Standing Committee of the Federation of Industry and Commerce can be adjusted during the term. The adjusted personnel shall be approved by the Executive Committee or by the Standing Committee and submitted to the Executive Committee for confirmation.

When the local federation of industry and commerce changes, the preparation status shall be reported to the higher-level federation of industry and commerce, and the election results shall be reported to the higher-level federation of industry and commerce for record.

Article 27 The Federation of Industry and Commerce shall establish working departments and special committees according to work needs.

Article 28 The establishment or dissolution of a local federation of industry and commerce shall be submitted to the party committee at the same level for approval and reported to the superior federation of industry and commerce for filing.

Article 29 The All-China Federation of Industry and Commerce is also called the Chinese Private Chamber of Commerce, and the local federations of industry and commerce are local chambers of commerce.

The president is concurrently served by the chairman of the Federation of Industry and Commerce. In principle, the vice president is concurrently served by the full-time vice chairman of the federation of industry and commerce and a representative of the non-public economy. The president and vice president are elected by the executive committee of the federation of industry and commerce. produce.

In principle, representatives of the non-public sector of the economy who are vice presidents of the China Private Chamber of Commerce shall not serve consecutively.
