Do you need the owner's consent to replace the access control system?

Legal analysis: Owner's consent is required. It is not enough to just post a notice to change the access control of the community. Property companies must go door-to-door to solicit the opinions of community owners and get the support of most owners. The property management company only signed a management contract with the owner to manage the community, but it needs the owner's consent before making a major decision.

Legal basis: Article 281 of the Civil Code of People's Republic of China (PRC) stipulates that the maintenance fund of buildings and their ancillary facilities belongs to the owners. With the consent of the owner, it can be used for local maintenance, renewal and transformation of elevators, roofs, external walls and barrier-free facilities. The raising and use of maintenance funds for buildings and their ancillary facilities shall be announced regularly. In case of emergency, if the building and its ancillary facilities need to be repaired, the owners' assembly or owners' committee may apply for the maintenance funds of the building and its ancillary facilities according to law.
