Hubei province civil airport clearance safety protection regulations
The safety production supervision and management department of the people's government at or above the county level where the civil airport is located shall implement comprehensive supervision and management on the safety protection of civil airport clearance, and guide, coordinate, supervise and inspect the safety protection of civil airport clearance of relevant departments and people's governments at lower levels.
The planning, housing and urban-rural construction, public security, agriculture, environmental protection, forestry, land and resources, meteorology, radio management, industrial and commercial administration and other relevant departments of the people's government at or above the county level where the civil airport is located shall, according to their respective functions and duties, do a good job in the clearance safety protection of civil airports.
Civil airport management agencies are specifically responsible for the clearance safety protection of their airports. China civil aviation Hubei air traffic management department (hereinafter referred to as the air traffic control department) shall participate in the clearance safety management of civil airports according to its responsibilities. China Civil Aviation Hubei Safety Supervision and Administration Department (hereinafter referred to as the Civil Aviation Administration Department) implements industry supervision and administration on the clearance safety protection of civil airports. Article 4 Civil airport management institutions shall adhere to safety first and prevention first, establish and improve the responsibility system for production safety, formulate and improve relevant emergency plans for production safety, establish joint prevention and control mechanisms with the people's governments where civil airports are located, and do a good job in the clearance safety protection of civil airports. Article 5 All units and individuals shall protect the clearance safety of civil airports and have the right to report potential safety hazards or acts endangering the clearance safety of civil airports to the safety production supervision and management departments or other relevant departments.
The department responsible for the supervision and management of civil airport clearance safety protection shall formulate and implement a supervision and inspection plan, establish a reporting system, accept reports on civil airport clearance safety, organize investigation and verification, and deal with them according to law; Matters reported on major issues concerning the clearance safety of civil airports shall be reported to the people's government at the same level for coordination and settlement. Article 6 The competent civil aviation authorities, civil airport management agencies and people's governments at all levels where civil airports are located and their relevant departments shall strengthen the publicity and education work on the safety protection of civil airports and raise citizens' awareness of the safety protection of civil airports.
The Township People's Government, sub-district offices and village (neighborhood) committees where the civil airport is located shall cooperate with the publicity, education and other related work on the clearance safety protection of civil airports within their respective jurisdictions. Chapter II Clearance Protection Article 7 The clearance protection area of a civil airport refers to a certain space range defined according to the requirements of the clearance obstacle restriction map of a civil airport in order to ensure the safe take-off and landing of airport aircraft. Article 8 The civil airport management institution shall, in accordance with state regulations and technical standards, prepare a civil airport clearance map, submit it to the competent civil aviation authority in the State Council for approval, and send it to the planning and land resources administrative department of the people's government at or above the county level where the civil airport is located for the record. Article 9 The competent civil aviation authority and the people's government at or above the county level where the civil airport is located shall, in accordance with the relevant provisions of the state, delimit the clearance protection area of the civil airport, incorporate it into the local urban and rural construction planning and overall land use planning and management, and make it public.
Before building or expanding a civil airport, the people's government at or above the county level where the airport is located shall make an announcement six months before the project starts, and publish and post it in the local major media and surrounding areas. For buildings and facilities, trees, lights or other obstacles that may affect the clearance safety of civil airports, the people's governments at or above the county level where civil airports are located or the relevant departments entrusted by them shall organize the owners of obstacles to clear and deal with them within the prescribed time limit. The losses thus caused shall be compensated according to law or other remedial measures shall be taken.
After the announcement of the construction and expansion of civil airports is issued, no unit or individual may build, plant or set up obstacles that affect the clearance safety of civil airports in the clearance protection area. Article 10 When examining and approving buildings or facilities in the clearance protection area of a civil airport, the planning administrative department shall solicit the opinions of the civil aviation administrative department in writing. The civil aviation administrative department shall make a written reply within 05 days from the date of receiving the comments. Eleventh in the civil airport clearance protection area, the following acts are prohibited:
(1) Building buildings or facilities that exceed the clearance height limit of civil airports;
(two) the construction of shooting ranges, explosives warehouses and other buildings or facilities that affect flight safety;
(3) Discharge a large amount of smoke, flames, dust, waste gas and other substances that affect flight safety;
(four) the installation of lights, signs or objects that affect the use of visual AIDS in civil airports;
(five) planting plants that affect flight safety or affect the use of navigation AIDS in civil airports;
(six) within 5 meters outside the airport boundary, building buildings or engaging in activities that affect the operation safety of the airport, such as digging and accumulating objects;
(seven) unmanned free balloons, tethered balloons and airships, hot air balloons, gliders, powered parachutes and other flight activities;
(eight) flying birds and animals that affect the safety of civil aviation, flying kites, lanterns and other objects;
(nine) storage of explosives, fireworks, firecrackers, fireworks, etc. ;
(ten) blasting or exceeding the requirements of clearance protection height;
(eleven) burning crop straw, industrial waste, domestic garbage and other substances that produce a lot of smoke and dust;
(twelve) set up open dumps, slaughterhouses, farms and other places that are easy to attract birds and other animals;
(thirteen) other activities that affect the safety of civil airport clearance.
