Measures of Suzhou Municipality on the Administration of the New Bianhe Scenic Area

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Water Law of People's Republic of China (PRC), the Tourism Law of the People's Republic of China, the Tourism Regulations of Anhui Province and other relevant laws and regulations, combined with the actual situation of this Municipality, in order to strengthen the management of the new Bianhe scenic spot and effectively protect and rationally utilize the scenic spot resources. Article 2 These Measures shall apply to the planning, construction, protection, utilization and management of the new Bianhe Scenic Area and its protected areas.

The new Bianhe scenic spot (hereinafter referred to as the scenic spot) includes the new Bianhe river from Jingtai Expressway in the west to Suzhou Gate in the east, and its dikes and berms on both sides. The specific scope is delineated according to the scenic spot planning, and landmarks are set. Article 3 The management of scenic spots should follow the principles of scientific planning, unified management, orderly development, protection according to law and serving people's livelihood, so as to achieve the unity of ecological benefits, social benefits and economic benefits. Article 4 The administrative organs of scenic spots established by the Municipal People's Government shall be responsible for the construction, protection, utilization and management of scenic spots.

The administrative departments in charge of urban management, urban and rural planning, housing and urban and rural construction, water conservancy, land, tourism, transportation, public security, forestry, agriculture, environmental protection, industry and commerce of the Municipal People's Government shall, according to their respective functions and duties, do a good job in the supervision and management of scenic spots. Article 5 The Municipal People's Government shall establish a coordination mechanism for the protection and management of scenic spots, strengthen the construction of infrastructure and tourist facilities, and ensure the investment in the planning, construction, protection and management of scenic spots. Sixth all units and individuals have the obligation to protect the scenic resources and facilities, and have the right to stop and report the destruction of scenic resources and facilities. Chapter II Planning and Construction Article 7 The planning of scenic spots is divided into overall planning and detailed planning.

The planning of scenic spots shall be organized by the Municipal People's Government and implemented after approval in accordance with relevant regulations. The planning of scenic spots shall be announced to the public after approval.

The approved planning of scenic spots is the basis for the construction, protection, utilization and management of scenic spots, and no unit or individual may modify it without authorization. If it is really necessary to modify it, it shall be submitted for approval in accordance with the original examination and approval procedures.

With the approval of the Municipal People's Government, a planning control area can be designated as a scenic spot protection area in the adjacent area outside the planning scope of the scenic spot, and boundary markers can be set up. Article 8 The overall planning of scenic spots shall include the evaluation of scenic spots' resources, development objectives and scope, functional structure and spatial layout, analysis of environmental carrying capacity, protection of water resources and ecological environment, planning and design of tourism projects, investment and benefit analysis, etc.

The overall planning of scenic spots should be incorporated into the overall urban planning, and coordinated with the national economic and social development planning, land use planning, water conservancy planning and environmental protection planning. Article 9 The detailed planning of scenic spots shall conform to the flood control standards and relevant technical requirements stipulated by the state, be compiled according to the different requirements of core scenic spots and other scenic spots, determine the requirements for site selection, layout and scale control of construction projects such as infrastructure, tourism facilities, cultural facilities and supporting commercial outlets, and clarify the scope of construction land and planning and design conditions.

Where the preparation of relevant special plans involves scenic spots and their protected areas, it shall inform and solicit the opinions of the scenic spot management agencies. Tenth scenic area management agencies should be based on the planning of scenic spots, the preparation of infrastructure, tourism facilities, cultural facilities and supporting commercial outlets of the annual construction plan, after the approval of the Municipal People's government to organize the implementation. Eleventh new construction, renovation and expansion projects in scenic spots, the location, layout, height, scale, shape, style and color should be coordinated with the scenic spots and ecological environment.

Buildings built in scenic spots, except water conservancy projects and supporting buildings, should be transformed or gradually moved out according to the planning of scenic spots.

New construction, renovation and expansion projects in scenic spots protection areas shall not destroy scenic spots or pollute the scenic environment; The relevant administrative departments shall inform and solicit the opinions of the scenic area management agencies when handling the procedures for examination and approval of land use and planning. Twelfth construction units engaged in construction activities in scenic spots should protect the ecological environment of the construction site and take the following pollution prevention measures:

(1) The construction site shall be provided with a continuous and closed hard enclosure of not less than 1.8m and an overflow-proof open caisson;

(2) Take hardening treatment measures for entrances and exits, main roads and processing zones of the construction site;

(3) Dust prevention measures such as sprinkling, covering, paving and greening shall be taken at the construction site;

(4) Building materials on the construction site are piled up in a centralized and classified way;

(five) it is forbidden to burn asphalt, linoleum, rubber, garbage and other substances that are easy to produce toxic and harmful smoke and malodorous gases at the construction site;

(six) construction waste and engineering muck timely removal, can not be timely removal, take effective coverage measures; After the demolition of the building, if the site is idle for more than three months, the land-using unit shall take greening and other dust-proof measures on the bare ground after the demolition;

(seven) other measures stipulated by laws and regulations. Chapter III Management Article 13 Scenic spot management institutions shall establish a safety management system, formulate emergency plans for safety accidents and emergencies, and set up safety facilities and warning signs in dangerous areas and waters.

Sightseeing and entertainment facilities built in the scenic area, vehicles and ships engaged in sightseeing and other business services shall be approved by the relevant departments and inspected before they can be put into use, and regular inspection and maintenance shall be carried out.
