Article 4 The administrative organs of scenic spots established by the Municipal People's Government shall be responsible for the construction, protection, utilization and management of scenic spots.
The administrative departments in charge of urban management, urban and rural planning, housing and urban and rural construction, water conservancy, land, tourism, transportation, public security, forestry, agriculture, environmental protection, industry and commerce of the Municipal People's Government shall, according to their respective functions and duties, do a good job in the supervision and management of scenic spots. The overall planning of scenic spots should be incorporated into the overall urban planning, and coordinated with the national economic and social development planning, land use planning, water conservancy planning and environmental protection planning. Article 9 The detailed planning of scenic spots shall conform to the flood control standards and relevant technical requirements stipulated by the state, be compiled according to the different requirements of core scenic spots and other scenic spots, determine the requirements for site selection, layout and scale control of construction projects such as infrastructure, tourism facilities, cultural facilities and supporting commercial outlets, and clarify the scope of construction land and planning and design conditions.
Where the preparation of relevant special plans involves scenic spots and their protected areas, it shall inform and solicit the opinions of the scenic spot management agencies. Tenth scenic area management agencies should be based on the planning of scenic spots, the preparation of infrastructure, tourism facilities, cultural facilities and supporting commercial outlets of the annual construction plan, after the approval of the Municipal People's government to organize the implementation. Eleventh new construction, renovation and expansion projects in scenic spots, the location, layout, height, scale, shape, style and color should be coordinated with the scenic spots and ecological environment.
Buildings built in scenic spots, except water conservancy projects and supporting buildings, should be transformed or gradually moved out according to the planning of scenic spots.
New construction, renovation and expansion projects in scenic spots protection areas shall not destroy scenic spots or pollute the scenic environment; The relevant administrative departments shall inform and solicit the opinions of the scenic area management agencies when handling the procedures for examination and approval of land use and planning. Twelfth construction units engaged in construction activities in scenic spots should protect the ecological environment of the construction site and take the following pollution prevention measures:
(1) The construction site shall be provided with a continuous and closed hard enclosure of not less than 1.8m and an overflow-proof open caisson;
(2) Take hardening treatment measures for entrances and exits, main roads and processing zones of the construction site;
(3) Dust prevention measures such as sprinkling, covering, paving and greening shall be taken at the construction site;
(4) Building materials on the construction site are piled up in a centralized and classified way;
(five) it is forbidden to burn asphalt, linoleum, rubber, garbage and other substances that are easy to produce toxic and harmful smoke and malodorous gases at the construction site;
(six) construction waste and engineering muck timely removal, can not be timely removal, take effective coverage measures; After the demolition of the building, if the site is idle for more than three months, the land-using unit shall take greening and other dust-proof measures on the bare ground after the demolition;
(seven) other measures stipulated by laws and regulations.
