Lhasa City Appearance and Environmental Sanitation Management Regulations

Chapter 1 General Provisions Article 1 In order to strengthen the management of city appearance and environmental sanitation, create a clean and beautiful urban environment, and protect people's health, in accordance with the "Regulations on the Management of City Appearance and Environmental Sanitation" of the State Council and combined with the actual situation of this city , formulate these regulations. Article 2 These Regulations apply to urban built-up areas of this city, towns where county (district) people’s governments are located, and other areas where urbanization management is implemented. Article 3: City appearance and environmental sanitation work shall implement the principles of combining unified leadership, hierarchical responsibility, departmental management, public participation, and social supervision. Article 4 The Municipal People's Government shall provide unified leadership for the city's city appearance and environmental sanitation work.

The municipal administrative department in charge of city appearance is responsible for the city’s city appearance and environmental sanitation management and organizes the implementation of these regulations.

The county (district) people's government leads the city appearance and environmental sanitation work within its own administrative region.

The county (district) municipal and city appearance department is responsible for the city appearance and environmental sanitation management of the county (district).

The township (town) people's governments and sub-district offices are specifically responsible for the supervision and management of city appearance and environmental sanitation within their respective jurisdictions. Article 5: City, county (district) urban management law enforcement departments shall, in accordance with their duties and in accordance with these regulations, implement administrative penalties for violations of city appearance and environmental sanitation. Article 6: Public security, housing and urban-rural development, land and resources planning, environmental protection, health, industry and commerce, forestry and greening and other departments shall do a good job in the management of city appearance and environmental sanitation in accordance with their respective responsibilities. Article 7 Municipal city appearance, radio and television, education, culture, health and other departments shall strengthen publicity and education on city appearance and environmental sanitation, and continuously improve citizens’ awareness of city appearance and environmental sanitation. Article 8 The municipal and county (district) people's governments encourage scientific and technological research and innovation in the field of city appearance and environmental sanitation, and promote the application of advanced technologies.

Encourage social funds to enter the field of city appearance and environmental sanitation, and gradually realize the marketization and socialization of environmental sanitation facility construction and professional operation services. Article 9: Any unit or individual has the obligation to maintain city appearance and environmental sanitation, and shall not hinder or obstruct city appearance and environmental sanitation staff from performing their duties, and has the right to dissuade and report any behavior that damages or destroys city appearance and environmental sanitation. Article 10 The urban management and law enforcement departments of the people's governments at or above the county level and their staff shall perform supervision and management duties in accordance with the law, enforce the law strictly, fairly and civilly, and shall not abuse their powers and damage the legitimate rights and interests of the management counterparties.

The supervisory organs of the people's governments at or above the county level conduct administrative supervision over urban management and law enforcement departments and their staff in accordance with the law. Article 11 The urban management and law enforcement departments of the people's governments at or above the county level shall implement a law enforcement responsibility system and a fault investigation system.

For complaints about urban management law enforcement violations or urban management law enforcement behaviors, the municipal city appearance department shall investigate within three working days and notify the complainant of the investigation results and handling results. Article 12 Units and individuals that have made outstanding contributions to city appearance and environmental sanitation shall be commended and rewarded by the municipal, county (district) people's government or the municipal city appearance department. Chapter 2 City Appearance and Environmental Sanitation Responsibilities Article 13 The municipal city appearance competent department shall perform the following responsibilities:

(1) Prepare the city appearance and environmental sanitation plan within its administrative region;

(2) ) Develop environmental sanitation professional operating standards and specifications;

(3) Organize and implement specific work on city appearance and environmental sanitation;

(4) Carry out city appearance and environmental sanitation work within the administrative region Supervision and inspection;

(5) Other duties prescribed by law. Article 14: A responsibility system shall be implemented for city appearance and environmental sanitation work. Units and individuals living within the jurisdiction shall do a good job in city appearance and environmental sanitation work within the city appearance and environmental sanitation responsibility area.

(2) The streets and alleys in residential areas are the responsibility of the street office or the township (town) people's government;

(3) The property management unit shall be responsible for the implementation of property management in residential areas;

(4) The management unit shall be responsible for trade markets, exhibitions and other places;

(5) Rivers, canals, reservoirs and ancillary areas shall be the responsibility of their management units;

(6) The construction site of the construction site shall be the responsibility of the construction unit; if the construction has not yet been completed, the construction unit or The construction unit is responsible;

(7) Urban green space is the responsibility of the management and maintenance unit;

(8) Tourist attractions and parks are the responsibility of the operating unit or management unit;

(9) The area of ??responsibility of agencies, groups, troops, schools and enterprises and institutions is bounded by adjacent intersection lines and is within the area from the front wall to the edge of the sidewalk, and is the responsibility of the unit.

Businesses facing the street are responsible for the sanitation of the city appearance and environment in front of their doors in accordance with the three guarantees in front of their doors.

If the person responsible for city appearance and environmental sanitation is unclear, the person responsible for city appearance and environmental sanitation shall be determined by the local municipal city appearance department.
