Regulations of Maoming Municipality on the Administration of Village Planning and Construction

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Land Administration Law of the People's Republic of China, the Urban and Rural Planning Law of People's Republic of China (PRC) and the Regulations of Guangdong Province on Urban and Rural Planning in order to strengthen the management of village planning and construction, improve rural living environment, build beautiful countryside and promote rural revitalization. Article 2 These Regulations shall apply to the planning, construction and management activities of villages outside the urban development boundary within the administrative area of this Municipality.

Where laws and regulations provide otherwise for the management of village planning and construction, such provisions shall prevail. Third village planning and construction management, should be in accordance with the deployment of rural revitalization strategy, adhere to the principle of planning first, rational layout, local conditions, intensive development. Article 4 The Municipal People's Government shall be responsible for coordinating the management of village planning and construction, and supervising and inspecting the management of village planning and construction of the people's governments at lower levels and the relevant competent departments of the people's governments at the corresponding levels.

The municipal people's government at the county level is responsible for the management of village planning and construction within its jurisdiction, including the funds for village planning and management into the fiscal budget at the corresponding level, formulating village planning guidelines, village design guidelines, architectural style control and construction guidelines, actively building public service platforms for village planning and construction and Industry-University-Research cooperation platforms, guiding and supporting urban and rural planners, architects and engineers to serve in rural areas, and improving the level of village planning and construction.

Maonan District, Dianbai District People's Government and Economic Function Zone Management Committee shall be responsible for the management of village planning and construction within their respective jurisdictions. Article 5 The competent department of natural resources shall be responsible for the management of village planning, agricultural land conversion and real estate registration within their respective administrative areas.

The competent agricultural and rural departments shall be responsible for the reform and management of rural residential sites within their respective administrative areas.

The competent department of housing and urban and rural construction is responsible for the safety of rural residential construction and the management of rural construction craftsmen within their respective administrative areas.

Development and reform, finance, ecological environment, human resources and social security departments should do a good job in village planning and construction management according to their respective responsibilities. Article 6 The Town People's Government shall be responsible for the management of village planning and construction within its administrative area and perform the following duties:

(a) the organization, implementation, modification and management of village planning;

(two) the daily supervision and management of village construction inspections;

(three) village resources and environmental protection, folk culture protection, public service facilities and infrastructure protection;

(four) the establishment of village planning, village construction files;

(five) to carry out other work of village planning and construction management as stipulated by laws and regulations.

The town people's government can do a good job in village planning and construction management by recruiting engineering and technical personnel, coordinators or purchasing public services.

Street offices with homestead management tasks are implemented with reference to the responsibilities of the Town People's Government. Article 7 The Municipal People's Government may, according to the decision of the provincial people's government, in the field of comprehensive administrative law enforcement, determine that the power of administrative punishment and the related power of administrative inspection and administrative compulsory measures exercised by the county-level administrative law enforcement departments as stipulated in these Regulations shall be exercised by the eligible Town People's Government (street offices). Article 8 Villagers' committees shall assist in the management of village planning and construction, and organize and guide villagers to formulate village rules and regulations on specific matters of village planning and construction, such as the overall pattern of villages, architectural style, building height and neighborhood influence.

The villagers' committee shall assist the town people's government and the relevant competent departments to carry out village construction inspections.

Encourage the establishment of village-level planning and construction administrator system, be responsible for the publicity of laws, regulations and policies and the popularization and application of general atlas of rural residential design, and cooperate with villagers' committees to do relevant work. Ninth city, district (county-level city) people's government should incorporate the management of village planning and construction into the rural revitalization assessment. Tenth people's governments at all levels and the competent departments of natural resources, housing and urban and rural construction, agriculture and rural areas should use various ways to enter the village to publicize the policies and regulations of village planning and construction, and strengthen the education and guidance of village planning and construction management. Chapter II Village Planning Article 11 Village planning is a statutory planning, which is a detailed planning of rural areas in the national spatial planning system, and it is the legal basis for carrying out national spatial development and protection activities, implementing land spatial use control, issuing planning permits for rural construction projects and carrying out various constructions in villages. Twelfth people's governments at all levels shall, according to the land spatial planning at the next higher level, comprehensively consider the actual situation of village construction land, reasonably determine the scale of village construction land, and ensure the needs of village infrastructure, public facilities construction and industrial development. Article 13 The preparation of village planning should be based on the land space planning, proceed from the reality of the village, link up with special plans such as water conservancy and forestry, make overall plans for village development goals, ecological protection and restoration, protection of cultivated land and permanent basic farmland, inheritance and protection of history and culture, layout of infrastructure and basic public service facilities, industrial development space, housing layout, village safety, disaster prevention and mitigation, etc., and define the projects to be implemented in the near future. Fourteenth village planning shall include:

(a) the village development goals;

(2) Building space, ecological space, agricultural space and their control lines;

(three) the scope of construction land, including industry, residential areas, infrastructure and public service facilities, village development reserve land layout and land scale;

(four) the facade, height and style of residential buildings, as well as the planning and control requirements of ventilation, lighting and traffic in the neighborhood;

(five) the requirements for the construction of public transportation, water supply, drainage, electricity, telecommunications, gas supply, public parking, environmental sanitation, sewage treatment, livestock and poultry breeding, education, tourism, cultural and sports activities, health, pension and other rural production and life, public services and infrastructure;

(six) the protection of historical and cultural heritage, disaster prevention and mitigation and other specific arrangements;

(seven) the recent construction plan;

(eight) other contents that should be included in the planning.
