222 Notice of Xichuan County People's Government on Strengthening Fishing Prohibition

In order to strengthen the fishing ban in the waters of our county and the fishing ban in conservation zone, the national aquatic germplasm of Danjiang endemic fish, strengthen the protection of fishery resources, severely crack down on all kinds of illegal acts that destroy fishery resources, and ensure that a reservoir of clean water will be sent to the north permanently, according to the relevant provisions of the Criminal Law of the People's Republic of China, the Fishery Law of the People's Republic of China and the actual situation of our county, the relevant matters concerning the fishing ban are hereby notified as follows: < p

II. Matters concerning prohibition of fishing

It is forbidden to fry fish, poison fish, electric fish and other acts that destroy fishery resources, and it is forbidden to use illegal fishing gear such as net lifting, ecstasy, shrimp array and nets below 8 cm. Without permission, exotic aquatic organisms are strictly prohibited from entering the waters of Danjiangkou reservoir area. Fishing operations and fishing are strictly prohibited in the no-fishing area and during the no-fishing period, and it is strictly forbidden to sell or purchase the caught fish.

III. Punishment for violating the law

1. Those who use methods such as fried fish, poisonous fish and electric fish to destroy fishery resources and violate the relevant provisions of the fishing ban shall, in accordance with the provisions of Article 38 of the Fisheries Law, confiscate their catches and illegal income and impose a fine of not more than 5, yuan; If the circumstances are serious, the fishing gear shall be confiscated and the fishing license shall be revoked; If the circumstances are particularly serious, the fishing boat may be confiscated; If a crime is constituted, criminal responsibility shall be investigated according to law. Whoever manufactures or sells prohibited fishing gear shall confiscate the illegally manufactured and sold fishing gear and illegal income, and shall also be fined not more than 1, yuan.

2. Anyone who, in violation of the laws and regulations on the protection of aquatic resources, catches aquatic products in a no-fishing area or during a no-fishing period, or uses prohibited tools and methods, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or a fine in accordance with the provisions of Article 34th of the Criminal Law.

3. Anyone who illegally catches aquatic products in conservation zone, a national aquatic germplasm of endemic fish in Danjiang, shall be convicted and punished for the crime of illegal fishing of aquatic products in accordance with the provisions of Article 34th of the Criminal Law:

Those who illegally catch aquatic products are more than 5 kilograms or more than 1, yuan;

illegal fishing of aquatic animal fry or brooding parents with important economic value or fishing of aquatic products of more than 5 kilograms or more than 1, yuan in conservation zone;

fishing in prohibited areas by prohibited methods that seriously damage fishery resources, such as electric fish, poisonous fish and fried fish;

fishing with prohibited tools specified by the Ministry of Agriculture and Rural Affairs in prohibited fishing areas;

other serious circumstances.

4. Whoever knowingly buys and sells aquatic products obtained by illegal fishing in conservation zone, a national aquatic germplasm of endemic fish in Danjiang, with a value of more than 1, yuan shall be convicted and punished in accordance with the provisions of Article 312 of the Criminal Law.

5. Fishing in Danjiangkou reservoir area is strictly prohibited. Once found, fishing tools and catches will be confiscated, and a fine from 2 yuan to 5 yuan will be imposed.

6. It is strictly forbidden to engage in illegal farming activities such as blocking nets and cages in Danjiangkou reservoir area. Otherwise, illegal facilities will be forcibly removed and confiscated, and a fine of less than 1, yuan will be imposed.

IV. Strict supervision and law enforcement

All towns and villages along the Yangtze River, along the river and along the reservoir should attach great importance to the protection of fishery resources and the ecological environment of the waters within their respective jurisdictions, and comprehensively strengthen the supervision and management of fishery producers, water surfaces and markets within their respective jurisdictions in accordance with the requirements of "territorial responsibility" and "river length system", so as to prevent the blocking of cages and branches of the reservoir from rebounding and ensure the safety of water quality. Relevant law enforcement departments should jointly enforce the law and strictly investigate all kinds of illegal activities, ban fishing gear and illegal farming.
