Article 1 In order to protect citizens' health and promote the construction of a civilized and hygienic city, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality.

Article 3 Smoking is prohibited in the following public places in the urban areas, tourist areas and airports of this Municipality:

(1) Waiting rooms, consulting rooms and wards of medical institutions;

(2) Nurseries and kindergartens;

(three) classrooms, dormitories and activity rooms in primary and secondary schools, and indoor teaching and research places in other schools;

(4) Meeting rooms (halls), auditoriums and auditoriums;

(5) Business halls of shopping malls, finance, posts and telecommunications;

(6) Audience halls of theaters, video halls and gymnasiums, exhibition halls, museums, art galleries, libraries (rooms), reading rooms, science and technology museums and archives;

(seven) all kinds of public transport, elevators, railway stations, long-distance bus stations, airport waiting rooms and ticket offices in urban areas;

(eight) other places as prescribed by laws and regulations and determined by the Municipal People's government.

Article 4 State organs, organizations, enterprises and institutions may, according to actual conditions, determine that smoking is prohibited in internal places other than those stipulated in Article 3 of these Regulations.

Article 6 The whole society should support the work of banning smoking in public places. Education, culture, health, news, radio and television departments should carry out publicity and education on smoking is harmful to health and smoking is prohibited in public places.

Article 7 Units that prohibit smoking in public places shall abide by the following provisions:

(a) to establish and improve the responsibility system for the prohibition of smoking;

(two) in public places where smoking is prohibited, set up obvious signs of no smoking, and no smoking utensils shall be placed;

(3) It is forbidden to set up tobacco advertisements in public places;

(four) do a good job in publicity and education of smoking in public places and smoking is harmful to health.

The public places specified in Item (3) of the preceding paragraph do not include shopping malls.

Eighth railway stations, long-distance bus stations, airport waiting rooms, theaters, gymnasiums and large shopping malls should be equipped with smoking rooms (areas) with obvious signs.

Ninth city patriotic health work management institutions shall set up inspectors in public places where smoking is prohibited. Inspectors shall be uniformly managed by the municipal patriotic health work management institution and issue inspection certificates.

Article 10 Citizens have the right to stop smokers from smoking in public places where smoking is prohibited.

Citizens have the right to require units that prohibit smoking in public places to perform the duties stipulated in these regulations, and have the right to report violations of these regulations to the municipal and district patriotic health work management institutions.

Eleventh smoking units in violation of the provisions of article seventh of these regulations, resulting in repeated smoking in public places, given a warning by the municipal and district patriotic health work management institutions, and ordered to make corrections within a time limit. If no correction is made within the time limit, a fine of more than 1,000 yuan and less than 3,000 yuan shall be imposed.

Inspectors who smoke in public places where smoking is prohibited in violation of the provisions of these regulations shall be ordered to make corrections and may be fined five yuan.

Twelfth laws, regulations and rules prohibit smoking in public places, and the administrative law enforcement departments with the power of administrative punishment shall exercise the power of punishment according to their respective functions and powers.

When a fine is imposed on a party, a receipt for the fine uniformly issued by the provincial finance department must be issued.

Thirteenth refuse or obstruct the patriotic health work management institutions of law enforcement officers and inspectors to perform official duties according to law, the public security organs shall be punished in accordance with the "Regulations of the people's Republic of China on administrative penalties for public security"; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 14 If the law enforcement officers of patriotic health work management institutions fail to perform their duties or engage in malpractices for selfish ends, the relevant units shall give criticism and education, and if the circumstances are serious, administrative sanctions shall be given; If the case constitutes a crime, criminal responsibility shall be investigated according to law; If the inspector fails to perform his duties and the circumstances are serious, the patriotic health work management institution shall cancel the qualification of the inspector and withdraw the inspection certificate.

Fifteenth if a party refuses to accept the decision on administrative punishment, it may apply for administrative reconsideration or bring an administrative lawsuit according to the Regulations on Administrative Reconsideration and the Administrative Procedure Law of the People's Republic of China.

If it fails to apply for reconsideration, bring an administrative lawsuit or perform the punishment decision within the time limit, the organ that made the decision on administrative punishment may apply to the people's court for compulsory execution.

Sixteenth counties (cities) where smoking is prohibited in public places can be implemented with reference to these regulations.

Article 17 These Regulations shall come into force as of September 6, 1998.
