Rule three. The term "urban outdoor advertising" as mentioned in these Measures refers to the commercial and public service advertisements that the administration, enterprises, institutions and individuals directly or indirectly publicize their goods and services through various outdoor carriers or forms at their own expense, including:

(a) the use of urban outdoor space set up all kinds of billboards, signs, signs, signs and windows, light boxes, neon lights, electronic screens, physical modeling and other advertisements;

(two) the use of cars, boats and other means of transportation and transportation facilities to set up, draw and post advertisements;

(3) Advertisements hung and drawn by balloons, parachutes, spaceships and other liftoff objects;

(four) the use of other forms of outdoor public welfare and commercial advertising. ?

Article 4 The municipal administrative department of urban management and the administrative department for industry and commerce are the supervisory and administrative organs of urban outdoor advertising. The administrative department for industry and commerce is responsible for the supervision and management of the establishment and registration of urban outdoor advertising operators, the release and registration of outdoor advertisements, and the investigation and punishment of illegal release of outdoor advertisements. The municipal administrative department of urban management is responsible for the preparation, approval and daily supervision and management of urban outdoor advertising planning. Urban management administrative law enforcement departments are responsible for investigating illegal outdoor advertisements.

Planning, public security, transportation, finance, price and other departments shall, in accordance with their respective responsibilities, coordinate the management of urban outdoor advertising. ?

Article 5? Urban outdoor advertising management should follow the principles of unified planning, unified examination and approval and unified management.

Article 6? The contents of urban outdoor advertisements must be legal, authentic and standardized, and meet the requirements of socialist spiritual civilization construction.

Urban outdoor advertising planning and technical specifications shall be formulated by the municipal administrative department of urban management.

Seventh city outdoor advertising management right is an important resource of the city, which belongs to the state. Outdoor advertisements in urban public places and municipal public facilities shall be auctioned by urban management, financial departments and urban construction investment institutions, and the proceeds from the auction shall be turned over to the municipal finance in full for urban construction. The buyer shall go through the examination and approval procedures for outdoor advertising with the confirmation of auction transaction. Other outdoor advertisements must be examined and approved by the municipal administrative department of urban management before they can be set up, and the charging standard shall be stipulated separately by the municipal price department.

Article 8? The setting of urban fixed outdoor advertisements must meet the requirements of the overall urban planning and design. The setting of all outdoor advertisements in the central city must be approved by the municipal administrative department of urban management.

Article 9? To apply for setting up outdoor advertisements, the following documents or materials shall be submitted to the municipal administrative department of urban management:

(a) the certificate of the right to use the site and facilities or the site lease contract;

(two) daytime advertising and night scene renderings;

(three) large-scale outdoor advertising must be approved by the planning department, and the qualified professional design department shall provide structural design drawings, construction instructions and a copy of the advertising business qualification certificate issued by the administrative department for Industry and commerce;

(four) to publish outdoor advertisements in the form of body advertisements, it shall submit the traffic safety certificate produced by the public security traffic police department;

(five) outdoor advertisements that should be examined by the relevant competent departments in accordance with laws and regulations shall provide the examination opinions issued by the relevant departments when registering.

Article 10 To apply for outdoor advertising registration, the following materials shall be submitted to the local administrative department for industry and commerce:

(1) An application form for outdoor advertising registration;

(2) Business licenses of advertisers and advertising agents or business qualification certificates with the same legal effect;

(3) outdoor advertising samples;

(four) the "outdoor advertising registration certificate" issued by the municipal administrative department of urban management;

(five) to publish outdoor advertisements in the form of body advertisements, it shall submit the traffic safety certificate produced by the public security traffic police department; ?

(six) outdoor advertisements that should be examined by the relevant competent departments in accordance with laws and regulations shall provide the examination opinions issued by the relevant departments at the time of registration;

(seven) other documents required by laws, regulations and rules.

Article 11? The administrative department of urban management and the administrative department for industry and commerce shall make a decision on whether to register outdoor advertisements within 7 working days from the date of accepting the application for registration. Upon examination, if it meets the prescribed conditions, the municipal administrative department of urban management shall issue the Outdoor Advertising Registration Certificate, and then the administrative department for industry and commerce shall issue the Outdoor Advertising Registration Certificate; Do not meet the prescribed conditions, a written reply to the applicant and return the relevant documents and materials. ?

Twelfth approved urban outdoor advertising shall be published in accordance with the contents, location, form, specifications and time of registration, and shall indicate the registration certificate number and the name of the advertising agent. ? Thirteenth outdoor advertising should be neat, firm and safe, and shall not hinder traffic, affect the city appearance or damage the city landscaping. For outdoor advertisements that are discolored, damaged, obsolete, unsightly and affect safety, advertisers must repair, renovate or dismantle them in time.

If improper outdoor advertising causes personal or property damage to others, advertisement publishers, advertising agents and advertisers shall compensate for the losses according to law.

Fourteenth approved outdoor advertising, advertising operators shall perform the following duties:

(a) to keep outdoor advertising clean and intact, and timely maintenance;

(two) to ensure the normal operation of lighting facilities, and open the lighting facilities in accordance with the relevant provisions of this Municipality;

(3) Regularly check the safety of outdoor advertisements, eliminate potential safety hazards in time, and take corresponding safety precautions in case of bad weather. Outdoor advertisements that need to be tested for safety shall be tested by quality testing institutions with legal qualifications every year. If the safety inspection is unqualified, the setter shall make timely rectification to meet the safety requirements;

(four) other duties as prescribed by laws, regulations and rules.
