Pingxiang City Gas Management Regulations

Chapter 1 General Provisions Article 1 In order to strengthen gas management, ensure the safety of citizens’ lives, property and public safety, and safeguard the legitimate rights and interests of gas operators and gas users, according to the “Urban Gas Management Regulations” of the State Council 》 and relevant laws and regulations, and combined with the actual situation of this city, these regulations are formulated. Article 2 The term “gas” as mentioned in these Regulations refers to gaseous fuels used as fuel and meeting certain requirements, including natural gas, liquefied petroleum gas, artificial coal gas, etc. Article 3 These regulations shall apply to gas development planning, gas facility construction and protection, gas operation and services, gas use and appliance management, gas safety emergency response and related management activities within the administrative region of this city.

This regulation does not apply to the production of natural gas and liquefied petroleum gas, the transmission of natural gas pipelines outside city gate stations, the use of gas as raw materials for industrial production, and the production and use of biogas and straw gas. Article 4: Gas work shall follow the principles of overall planning, supporting construction, safety and efficiency, standardized services, energy conservation and environmental protection. Article 5 Municipal and county (district) people's governments (including economic development zones, scenic spots, and industrial parks, the same below) shall strengthen leadership over gas work, incorporate gas work into the national economic and social development plan, and allocate gas management funds Include it in the fiscal budget at this level, and establish a gas work coordination mechanism, a gas emergency reserve system and a gas safety emergency response mechanism. Article 6: The construction administrative departments of the municipal and county (district) people's governments are the gas administrative departments within their respective administrative regions, and their affiliated gas management agencies are responsible for the specific work of gas management within their respective administrative regions.

Relevant departments such as development and reform, work safety supervision, land and resources, urban and rural planning, public security, market quality supervision, urban management, environmental protection, transportation, etc. shall perform their respective duties in accordance with the law and do a good job in gas management related work .

The gas authorities of the municipal and county (district) people’s governments shall perform the supervision and management responsibilities of gas safety work, and the gas operators shall fulfill the main responsibilities of gas safety work.

The township (town) people's government and sub-district offices assist relevant departments in the gas management work within their jurisdiction. Article 7 Municipal, county (district) people's governments and gas authorities shall regularly carry out publicity and education on gas laws and regulations, popularize gas safety knowledge, enhance the public's awareness of gas safety, and improve the ability to prevent and respond to gas accidents.

Gas operators should provide users with gas safety manuals and publicize common sense about gas safety use, appliance maintenance and emergency response.

Property service companies should cooperate with the gas authorities and gas operators to promote gas safety.

News media such as radio, television, newspapers, and the Internet should actively carry out public welfare publicity on safe gas use, gas conservation, and gas facility protection.

Schools should incorporate gas safety education into students’ safety knowledge education. Chapter 2 Gas Development Planning and Facility Construction Article 8 The gas competent departments of the municipal and county (district) people's governments shall, in accordance with the national economic and social development plan, overall land use plan, urban and rural planning, energy planning and the gas development plan of the next higher level, Organize the preparation of a gas development plan within the administrative region in conjunction with relevant departments, organize its implementation after approval by the people's government at the same level, and report it to the gas competent department at the next level for filing.

The approved gas development plan shall not be changed at will; if it is really necessary to modify it, it shall be submitted for review and approval and filed in accordance with the original preparation and approval procedures.

The approved gas development plan shall be announced to the public. Article 9 The construction of gas facilities shall comply with the gas development plan, and relevant permits shall be obtained during project construction.

When carrying out the construction of new areas and the renovation of old areas, supporting gas facilities should be constructed or land reserved for the construction of gas facilities in accordance with the city, county (district) urban and rural plans and gas development plans. The supporting gas facility construction project shall be designed, constructed, accepted, and handed over construction archives simultaneously with the main project. The construction costs shall be borne by the construction unit and included in the project construction cost. When applying for planning permission for a construction project, the construction unit shall submit the overall plan of the pipeline gas project and the gas pipeline line connection technical plan confirmed by the pipeline gas operator where the project is located. Article 10 It is prohibited to build new temporary gas supply devices such as community gasification stations, bottle group stations, and generator gas stations in areas already covered by the gas pipeline network. Temporary gas supply devices that have been built and are still in use should be gradually connected to the pipeline gas network.

In areas not yet covered by the gas pipeline network, the construction unit may construct temporary gas supply devices such as community gasification stations and bottle group stations in accordance with the provisions of this chapter, and shall entrust gas operators to provide gas supply and maintenance. ; Gas operators should regularly inspect temporary gas supply devices such as gasification stations and bottle stations to ensure the safe use of gas supply devices.

In old residential areas that have pipeline gas supply conditions but have not yet installed gas pipelines, the use of pipeline gas will be gradually promoted. Article 11 Construction projects of newly built, renovated or expanded facilities used for the production, storage, loading and unloading of gas shall undergo safety evaluation and be inspected and accepted in accordance with national safety evaluation standards.

For new, renovated, or expanded gas facility construction projects, when issuing site selection opinions in accordance with the law, the urban and rural planning authorities shall seek the opinions of the gas authorities on whether the construction of gas facilities complies with the gas development plan; no issuance is required. When issuing a construction land planning permit or a rural construction planning permit in accordance with the law, the urban and rural planning authority shall seek the opinions of the gas authority on whether the construction of gas facilities complies with the gas development plan.
