Chapter 1 General Provisions

Article 1 In order to strengthen the management, collection and arrangement of archives, This law is enacted to effectively protect and utilize archives for services.

Article 2: Archives as mentioned in this law refer to past and present state institutions, social organizations, and individuals engaged in politics, military, and economy. , scientific, technological, cultural, religious and other activities directly formed historical records in various forms such as texts, charts, audio and video that are valuable to the country and society (see Archives Office Article 2)

Article 3 All state agencies, armed forces, political parties, social groups, enterprises, institutions and citizens have the obligation to protect archives (see Article 6 of the Archives Office)

Article 4 People’s governments at all levels. The leadership of archives work should be strengthened and the construction of archives undertakings should be included in the national economic and social development plan (see Article 5 of the Archives Office)

Chapter 2 Archives Institutions and Their Responsibilities

Article 6 The national archives administration department is responsible for the national archives undertaking. The archives industry across the country implements overall planning, organization and coordination, unified systems, supervision and guidance.

The archives administrative departments of local people's governments at or above the county level are responsible for the archives industry within their own administrative regions and are responsible for their own administration. Chapter 3 Management of Archives

Article 10: Materials that are required to be archived by the state must be submitted to the unit regularly in accordance with regulations. The archives institutions or archives staff shall transfer and centrally manage the archives, and no individual may appropriate them for themselves.

Unauthorized archiving of materials that are prohibited by state regulations is prohibited. (See Article 10 of the Archives Office)

Article 11 Agencies, groups, enterprises, institutions and other organizations must regularly transfer files to the Archives Office in accordance with national regulations. (See Article 13 of the Archives Office)

Article 18: State-owned archives and archives specified in Article 16 of this Law, as well as copies of these archives, are prohibited from being carried out of the country without permission. (See Article 19 of the Archives Office)

Chapter 4 Utilization and Publication of Archives

Article 19 Archives kept by the National Archives shall generally be archived for three years from the date of formation. Open to the public for ten years. The period of opening to the public of economic, scientific, technological, cultural and other types of archives can be less than thirty years. The period of opening to the public of archives involving national security or major interests and other expired documents that should not be opened to the public can be longer than thirty years. The specific time limit shall be formulated by the national archives administrative department and submitted to the State Council for approval and implementation.

Archives should regularly publish catalogs of open archives, create conditions for the use of archives, simplify procedures, and provide convenience.

Article 20 Agencies, groups, enterprises, institutions and other organizations as well as citizens may, in accordance with the needs of economic construction, national defense construction, teaching and scientific research and other work, Relevant regulations require the use of unopened archives in archives and archives maintained by relevant agencies, groups, enterprises, institutions and other organizations.

Article 22 Archives owned by the state shall be published by archives or relevant agencies authorized by the state; no organization or individual has the right to publish them without the consent of the archives or relevant agencies.

The owners of collectively owned and individually owned files have the right to publish them, but they must abide by relevant national regulations and must not harm national security and interests, or infringe on the legitimate rights and interests of others. Article 23 Archives of all types and levels should be equipped with researchers to strengthen the research and organization of archives, organize the editing and publication of archival materials in a planned manner, and Released in different ranges.

Chapter 5 Legal Responsibilities

Anyone who uses the archives in the archives and commits illegal acts in Items 1, 2 and 3 of the preceding paragraph shall be given a warning by the archives administrative department of the people's government at or above the county level and may also be fined ;If any loss is caused, it shall be ordered to compensate for the loss.

Chapter 6 Supplementary Provisions

Article 26 The implementation measures for this law shall be formulated by the national archives administrative department and shall be submitted to the State Council for approval before they shall be implemented.

Article 27 This Law shall come into effect on January 1, 1988.
