Regulations of Xiamen Special Economic Zone on Optimizing Business Environment

Chapter I General Provisions Article 1 In order to continuously optimize the business environment, stimulate the vitality of market players, promote high-quality development, and build a modern international city with high quality and high value at a higher level, these Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the actual situation of Xiamen Special Economic Zone. Article 2 To optimize the business environment, we should adhere to the principles of marketization, rule of law and internationalization.

Optimizing the business environment should be guided by the needs of market participants, centered by the transformation of government functions, guided by digital empowerment and guaranteed by the rule of law. It is necessary to benchmark international high standards, reduce institutional transaction costs, safeguard the legitimate rights and interests of market players, and create a stable, fair, transparent and predictable business environment for all kinds of market players to invest and start businesses. Article 3 The municipal and district people's governments shall strengthen their leadership in optimizing the business environment and establish and improve the coordination mechanism for optimizing the business environment. The main person in charge of the government is the first person responsible for optimizing the business environment.

The development and reform department is the competent department in charge of optimizing the business environment, and is specifically responsible for the coordinated promotion, supervision and implementation, and evaluation of optimizing the business environment.

The relevant units shall, in accordance with their respective responsibilities, carry out relevant work to optimize the business environment. Article 4 An expert advisory committee for optimizing the business environment shall be established.

The organizational form and working rules of the expert advisory committee shall be formulated by the municipal development and reform department and promulgated and implemented after being approved by the Municipal People's government. Article 5 The municipal and district people's governments shall improve the incentive and performance evaluation mechanism for optimizing the business environment, take market players and public satisfaction as the guide, improve the evaluation criteria, commend units and individuals who have made outstanding achievements in their work in accordance with regulations, and hold accountable units and individuals who have been procrastinating in their work in accordance with regulations.

Implement a "good bad review" system for all government services, and incorporate the evaluation results into the assessment accountability content.

If the relevant units and individuals make mistakes or deviations in the reform and innovation of the business environment and meet the prescribed conditions, they may be exempted or relieved of their responsibilities. Article 6 The municipal and district people's governments shall report the work of optimizing the business environment to the Standing Committee of the people's congress at the same level and the deputies of the people's congress through special work reports, political briefings or other means.

The Standing Committee of the People's Congress may supervise the work of optimizing the business environment by listening to special work reports, law enforcement inspections, inquiries, inquiries or representative inspections. Chapter II Market Environment Article 7 The municipal and district people's governments and relevant departments shall promote the market-oriented reform of land use rights, human resources, capital, technology, data resources and other factors, improve the operating mechanism of the factor market, improve the factor trading rules and service system, promote the free flow of factors and improve the efficiency of factor allocation. Article 8 The municipal and district people's governments and relevant departments shall ensure that all kinds of market players receive equal treatment and participate in market competition on an equal footing according to law, and shall not formulate or implement discriminatory policies.

All kinds of market entities apply all policies and measures equally according to law, and enjoy the right to use human resources, capital, technology, data resources, land and other natural resources and public service resources such as water, electricity and electricity equally. Article 9 The municipal and district people's governments and relevant departments shall, in accordance with state regulations, implement a unified negative list system for market access. In areas other than the negative list of market access, all kinds of market entities can enter equally according to law.

Explore the implementation of commercial registration confirmation system and market quasi-business commitment system. Tenth unless otherwise stipulated by laws and regulations, the relevant departments shall take the following measures to simplify the registration procedures of market entities:

(a) the use of unified data standards, platform service interface, social credit code for registration management;

(2) Implementing the system of independent declaration of enterprise name, standardized registration of business scope, declaration commitment and notification commitment of residence and business premises;

(3) Allow multiple market entities to register the same address as their residence according to the regulations;

(four) the implementation of the whole process of online registration of market participants.

The municipal market supervision and management department shall, jointly with relevant departments, prepare a negative list of commercial registered residences and business premises, and specify the specific circumstances, addresses or areas where laws and regulations prohibit or restrict the use of residences and business premises. The relevant departments shall cooperate with the municipal market supervision and management department to make preparations. The negative list of commercial registered residences and business premises shall be dynamically managed by the Municipal People's Government and announced to the public. Eleventh public resources trading directory management, public trading directory, rules, procedures, results, supervision and credit information, to ensure that all kinds of market participants timely access to relevant information, equal participation in trading activities.

The Municipal People's Government shall establish a unified trading platform for public resources in the whole city, and promote the electronic trading of public resources in all fields and in the whole process. Article 12 Financial institutions are encouraged to take the following measures to reduce the credit cost of market participants:

(1) Optimize the loan term management of private enterprises, and carry out the unpaid loan extension business according to laws and regulations;

(two) for enterprises with good credit status, reasonably increase medium and long-term loans and credit loan support;

(3) Promote small and micro enterprise credit loans under the premise of controllable risks;

(4) On the premise of meeting regulatory requirements, appropriately increase the tolerance of non-performing loans of small and micro enterprises.

When an enterprise sets up a bank account, the bank can verify the willingness to open an account with the legal representative or person in charge of the enterprise through video, except that the legal representative or person in charge of the enterprise has dishonest behavior recognized by the relevant departments and disclosed according to law.
