The specific contents of the measures for the administration of lottery issuance and sales

Article 4 A lottery issuing institution shall, in accordance with the provisions of the Regulations and Detailed Rules for Implementation, submit an application to the Ministry of Civil Affairs or the State Sports General Administration for examination and approval, and organize implementation after examination and approval by the Ministry of Finance. Article 5 The issuance methods mentioned in Article 8 of the Regulations refer to the forms and means used to issue and sell lottery tickets, including physical store sales, telephone sales, Internet sales and self-service terminal sales. The scope of issuance as mentioned in Article 8 of the Regulations refers to the area covered by the issuance and sale of lottery tickets, which is divided into national regions, two or more provincial administrative regions and provincial administrative regions with provincial administrative regions as the unit. Article 6 The professional testing institutions mentioned in Article 12 of the Detailed Rules for Implementation refer to the units that have been approved to be established or set up, recognized by the relevant state departments and obtained relevant qualification certificates, and are engaged in testing, testing or evaluating computer systems and software, and have independent legal personality. Article 7 The examination and approval of changing lottery varieties mentioned in Article 12 of the Detailed Rules for Implementation involves major adjustments to the technical scheme, including the following situations: (1) adding new lottery games to the lottery issuance and sales system; (two) increase or decrease the prize level of lottery games; (3) Adjusting the lottery mode of lottery games; (4) Adding new lottery issuance methods; (5) Other matters for examination and approval of changing lottery varieties involve major adjustments to the technical scheme. Article 8 Before the lottery varieties opened and the lottery varieties with changed examination and approval items are put on the market for sale, the lottery issuing agency or lottery sales agency shall report the sales implementation plan to the finance department at the same level for approval. The sales implementation plan shall include the planned sales date, marketing plan and risk control measures. Article 9 If the lottery ticket is issued in the whole country, the sales implementation plan shall be submitted by the lottery issuing institution to the Ministry of Finance for approval. Where the scope of lottery issuance is two or more provincial administrative regions, the sales implementation plan shall be reported to the finance department at the same level for approval by the lottery issuing agency or lottery sales agency responsible for managing the lottery game prize pool and data collection, and other lottery sales agencies involved in sales shall report the approved sales implementation plan to the finance department at the same level for the record. Where the scope of lottery issuance is the provincial administrative region, the sales implementation plan shall be reported to the finance department at the same level for approval by the lottery sales organization. Tenth approved lottery varieties, lottery issuers and lottery sales agencies shall be listed and sold within 6 months from the date of approval. Lottery varieties that have been approved to change the examination and approval items shall be listed and sold within 4 months from the date of approval. If the lottery varieties opened and the lottery varieties that change the examination and approval items have been on the market for less than 6 months, they shall not be changed or stopped in principle. Article 11 The Ministry of Finance shall, in accordance with the principle of rationally planning the lottery market and the lottery variety structure and strictly controlling the lottery risks, comprehensively consider the lottery sales volume, the fund balance of the prize pool, the balance of the adjustment fund and the sales expenses of lottery issuance, and so on, and examine the application of lottery issuers to stop lottery varieties or lottery games. Lottery issuing agencies and lottery sales agencies shall make an announcement to the public within 2 months from the date of approval of the lottery varieties or lottery games that have been approved to stop. After 6 natural days from the date of announcement, lottery issuers and lottery sales agencies may stop selling. Article 12 Lottery issuing institutions and lottery sales institutions shall sign lottery sales contracts with lottery agents in accordance with the regulations, detailed rules for implementation and other lottery management regulations, as well as the requirements of the model text of lottery sales contracts. Lottery agents shall sell lottery tickets on an agent basis according to the stipulations of the lottery sales contract, and shall not entrust others to sell lottery tickets on an agent basis. Thirteenth lottery sales agencies and lottery agents shall, in accordance with the unified requirements of lottery issuers, build lottery sales places, set up lottery sales signs, post warning slogans, and highlight the public welfare of lottery tickets. Lottery issuing institutions and lottery sales institutions shall, according to the characteristics of different lottery varieties, formulate corresponding standards and management norms for the establishment of lottery sales places.

article 14 lottery issuers and lottery sales organizations can use business expenses, operating income and other funds to purchase goods or services to carry out promotional activities and give back to lottery buyers or lottery agents who meet certain conditions.

The funds needed to carry out lottery promotion activities shall be applied by lottery issuers and lottery sales organizations in the financial revenue and expenditure plans, and the expenses shall be arranged after being examined and approved by the financial department at the same level.

article 15 "awarding prizes" as mentioned in article 2 of the detailed rules for implementation refers to the establishment of special prizes through the regulation fund or general regulation fund of lottery games, so as to increase the winning amount of lottery winners who meet specific rules.

Article 16 Lottery issuing institutions and lottery sales institutions shall comply with the following provisions when conducting prize-giving activities:

(1) Lottery games with a sales cycle longer than one day (including one day) shall not be conducted more than once a year, and the prize-giving funds shall not be arranged for more than 4 periods;

(2) For lottery games with a sales cycle shorter than one day (excluding one day), prize-giving activities shall not be carried out more than twice a year, and the fund arrangement for each prize-giving shall not exceed five days;

(3) The prize-giving funds are limited to the regulation funds of lottery games or general regulation funds, and prize-giving activities shall not be carried out by using prize pool funds and business expenses.

(4) The prize amount of a single-note lottery ticket shall not exceed the prize amount or the cap limit of the corresponding prize level stipulated in the rules of the lottery game.

(5) If there is a balance in the last prize-giving activity, it will be postponed until the prize-giving bonus is used up. The prize-giving activity has not yet expired, but the adjustment fund and general adjustment fund of lottery games have been used up, and the prize-giving should be stopped.

article 17 lottery issuing institutions and lottery selling institutions shall apply to the finance department at the same level by the lottery issuing institutions or lottery selling institutions in charge of managing the lottery game prize pool, and organize the implementation after examination and approval.

the application materials for awarding prizes shall include the necessity analysis of launching the prize awarding activities, the prize awarding scheme, the estimated total amount of prize awarding, the source of prize awarding funds, etc.

article 18 the financial department shall, within 2 working days from the date of receiving the application materials, reply to the lottery issuing agency or lottery sales agency about the prize distribution scheme. The prize-giving scheme shall include the starting and ending period of prize-giving, the rules of prize-giving, the amount of prize-giving in a single period or the total amount of prize-giving, and the disposal of the balance of prize-giving in the last period of prize-giving activities or the fact that the prize-giving activities have not expired but the regulation fund and general regulation fund of lottery games have been used up.

the provincial financial department shall report the approval of the prize distribution plan of the lottery sales organization to the Ministry of Finance and the lottery issuing organization respectively for the record.

article 19 lottery issuing institutions and lottery sales institutions shall announce the prize distribution plan to the public five natural days before the prize distribution begins, and indicate the name and document number of the approval document of the financial department in the announcement.

Article 2 During the validity period of the redemption, the lottery winner requests the redemption, and after verification and confirmation, the lottery issuing agency, lottery sales agency or lottery agent shall pay it in time without delay. Article 21 Lottery varieties include traditional type, instant type, lottery type, digital type, quiz type, video type and Keno type.

The game rules of traditional and instant lottery tickets include the name, face value, rules of playing and the form of prizes. The rules of the lottery, digital lottery, quiz, video lottery and Keno lottery include general rules, betting, prize-setting, drawing, winning, redemption, supplementary rules, etc. The name is "China Welfare (Sports) Lottery Rules of the Game".

Article 22 A lottery ticket may have a fixed prize or a floating prize.

if there is a fixed prize, the prize amount of all prizes is a fixed amount. In case of floating prize, the prize amount of low prize level is fixed, and the prize amount of high prize level needs to be calculated and determined according to the factors such as accrued bonus, total winning amount of low prize level and winning notes of high prize level.

article 23 traditional and instant lottery tickets shall be uniformly printed by lottery issuers according to the needs of the lottery market. Lottery issuing institutions shall formulate printing standards and management norms for the format, specifications, production forms, anti-counterfeiting and packaging of traditional and instant lottery tickets.

article 24 the use period of traditional instant lottery tickets is 6 months from the date of completion of printing, and after the use period expires, the sales shall be stopped. It is strictly forbidden to sell traditional and instant lottery tickets that have exceeded the service life.

within 6 natural days before the expiration of the use period, the lottery issuing institution shall announce to the public the date when the sales of this batch of lottery tickets will stop, and the date when the use period expires. If it has not yet expired but needs to stop selling, the lottery issuing agency shall announce the date of stopping selling this batch of lottery tickets to the public at least 6 natural days in advance.

article 25 the traditional and instant lottery tickets shall be registered in and out of the warehouse, and a detailed account (ledger) of the lottery tickets in stock shall be established. The storage period of the warehousing record sheet shall not be less than 6 months.

lottery issuing institutions and lottery sales institutions shall regularly take stock of the lottery tickets in kind, and check the lottery tickets in kind with the inventory subsidiary ledger (ledger) and financial accounts to ensure that the accounts are consistent.

article 26 traditional and instant lottery tickets shall be transported by railway, highway, etc., with special person in charge to ensure safety.

article 27 invalid tickets, tail tickets of traditional instant lottery tickets and lottery tickets that have expired shall be destroyed in accordance with the provisions of articles 29 and 3 of the implementing rules.

before the destruction, the staff responsible for destroying the lottery tickets and supervising the destruction shall check the name, face value, quantity and amount of the approved lottery tickets with the lottery tickets to be destroyed on site, count the zero tickets and draw the whole promissory notes. After verification, issue a destruction confirmation form and sign and seal it. If problems are found in the check, the destruction shall be stopped immediately, and the reasons shall be found out and disposed of before being destroyed.

Article 28 Winners of traditional lottery tickets shall redeem their prizes within 6 natural days from the date of drawing. Winners of instant lottery tickets can redeem their prizes from the time of purchase, and the deadline for redemption is the 6th natural day from the date when the sales of the lottery tickets are stopped. Those who fail to win the prize within the time limit are deemed to have abandoned the prize. If the last day is a holiday for all citizens or the lottery market is closed, it shall be implemented in accordance with the provisions of Article 43 of the Implementation Rules.

Article 29 Lottery tickets of lottery type, digital type, quiz type and Keno type shall meet the following requirements:

(1) The number of bets on a single lottery ticket shall not exceed 1,;

(2) If multiple bets are set, the bet multiple of each lottery ticket shall not exceed 1 times;

(3) If floating prizes are implemented, the prize pool funds are only used for high prizes;

(4) If a fixed prize is set, the betting number or the limited betting number of betting options shall be set.

Article 3 Video lottery tickets shall meet the following requirements:

(1) The total amount of a single bet shall not exceed 1 yuan;

(2) The single-day recharge amount of special betting cards shall be subject to quota control;

(3) The operating hours of the sales hall shall be controlled by time period.

Article 31 For Keno lottery tickets and lottery and digital lottery tickets with a sales cycle shorter than one day (excluding one day), the lottery numbers shall be determined by special electronic lottery equipment.

for lottery and digital lottery tickets with a sales cycle longer than one day (including one day), the lottery number shall be determined by special lottery equipment. Before the lottery, the lottery number ball and lottery equipment must be inspected. The lottery shall be recorded in the whole process, and the storage period of the video shall not be less than 36 months. After the lottery, the lottery number ball shall be sealed and kept.

If the sports competition is advanced, postponed, interrupted, cancelled or deemed invalid for various reasons, the lottery results shall be determined according to the rules of the lottery game.

Article 32 Keno-type lottery tickets and lottery, digital and quiz-type lottery tickets with a sales cycle shorter than one day (excluding one day) shall automatically seal up the original data of lottery sales at the closing time of each sales period, and record the original data of lottery sales on an unwritten storage medium on a daily basis. The lottery retrieval is automatically completed by the lottery issuance and sales system according to the lottery number or lottery result.

article 33 lottery, digital and quiz lottery with a sales cycle longer than one day (including one day) shall seal up the original lottery sales data at the end of each sales period, and burn the original lottery sales data of the current period on the non-rewritable storage medium. Lottery retrieval should be synchronized in the sealed original lottery sales data and the burned backup storage medium, and the lottery announcement can be made only after the retrieval results are consistent. Thirty-fourth lottery issuing institutions and lottery sales institutions shall, in accordance with the relevant national standards, organize the construction of special computer rooms and disaster recovery computer rooms for lottery issuing and sales systems. The special computer room and disaster recovery computer room shall be equipped with dual backup servers for lottery issuance and sales system, special air conditioners for the computer room, uninterrupted power supply, generators, fire-fighting facilities and equipment, etc. Lottery issuing institutions and lottery sales institutions shall formulate a complete computer room management system, work log system and emergency response plan.

article 35 lottery issuing institutions and lottery selling institutions shall establish lottery issuing and selling systems, and be responsible for organizing and managing the development, integration, testing, maintenance and operation of the lottery issuing and selling systems. Lottery distribution and sales system should have perfect security measures such as data backup, data recovery, anti-virus and anti-intrusion to ensure the safe operation of the system.

article 36 lottery issuing institutions and lottery selling institutions shall separately manage the personnel in the positions of development, integration, testing, maintenance and operation of the lottery issuing and selling system to ensure safe operation.

the operation of the lottery issuance and sales system shall be directly responsible by the professional and technical personnel of the lottery issuing institutions and lottery sales institutions, and the development, integration, testing and maintenance personnel of the lottery issuance and sales system shall not participate in the operation in any way.

article 37 lottery issuing institutions and lottery sales institutions shall build special lottery drawing places and redemption service places, formulate lottery drawing operation procedures and redemption service processes, and uniformly purchase and directly manage lottery drawing equipment. Lottery places and prize-winning service places shall have perfect security measures and emergency response plans.

article 38 a lottery sales organization shall provide lottery agents with special lottery betting equipment. The special equipment for lottery betting belongs to the lottery sales organization, and the lottery agent shall not lend, lease or sell it.

the lottery agent shall pay the deposit or security deposit for the special equipment for lottery betting to the lottery sales organization according to the stipulations of the lottery agent contract.

article 39 traditional instant lottery tickets shall be stored in special warehouses. The special warehouse for storage shall be managed by a special person, with safety functions such as fire prevention, waterproof, theft prevention, moisture prevention and insect prevention, and shall not store articles unrelated to the lottery business.

Article 4 Lottery issuing institutions and lottery sales institutions shall set up service hotlines to handle public inquiries and complaints.

article 41 lottery issuing institutions and lottery sales institutions shall regularly carry out facilities and equipment such as special computer room for lottery sales data management and disaster recovery computer room, lottery issuance and sales system, lottery drawing place and redemption service place, lottery drawing equipment, and special warehouse for lottery storage.
