Chapter I General Provisions Article 1 In order to strengthen the management of construction waste, maintain the city appearance and environmental sanitation, protect and improve the ecological environment, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the disposal activities such as the discharge, transportation, consumption and comprehensive utilization of construction waste within the administrative area of this Municipality.

The term "construction waste" as mentioned in these Regulations refers to the dregs, wastes and other wastes generated by units and individuals in the activities of building, rebuilding, expanding and dismantling all kinds of buildings, structures, pipe networks, road construction and decoration of houses. Article 3 The municipal administrative department of city appearance and environmental sanitation is the administrative department in charge of construction waste management in this Municipality. The district and county administrative departments of city appearance and environmental sanitation shall be responsible for the management of construction waste within their respective jurisdictions.

Public security, urban management and law enforcement, planning, transportation, construction, urban reform, water affairs, land and resources, environmental protection, municipal utilities, prices and other departments shall, according to their respective responsibilities, do a good job in the management of construction waste.

Neighborhood offices and Township People's governments shall accept the guidance of the administrative department of city appearance and environmental sanitation, and supervise and inspect the construction waste disposal activities within their respective jurisdictions. Article 4 The principles of reduction, harmlessness, reuse, recycling and producer responsibility shall be followed in the disposal of construction waste. Article 5 The Municipal People's Government shall formulate preferential policies for comprehensive utilization of construction waste, support and develop comprehensive utilization projects of construction waste, strengthen research, development, transformation and application of comprehensive utilization of construction waste, and improve the comprehensive utilization level of construction waste. Sixth any unit or individual has the right to stop and report the illegal disposal of construction waste. Chapter II Discharge of Construction Waste Article 7 A construction waste discharger shall classify construction waste.

No unit or individual may mix construction waste with domestic waste and hazardous waste for disposal. Article 8 A construction waste discharger shall apply to the district or county administrative department of city appearance and environmental sanitation that produces construction waste for the Xi Construction Waste Disposal (Discharge) Certificate, and submit the following materials:

(a) the relevant documents issued by the relevant administrative departments to approve the construction;

Relevant information on construction waste discharge and accounting;

(3) Construction waste disposal plan: including the classification, discharge location, quantity, transportation route, disposal location, recycling and other matters of construction waste. Article 9 A construction waste discharger shall sign a construction waste transportation contract with a transportation unit that holds the Xi Construction Waste Disposal (Transportation) Certificate, and shall not hand over the construction waste to a transportation unit or individual that has not obtained the Xi Construction Waste Disposal (Transportation) Certificate. Tenth construction sites that discharge construction waste shall meet the following conditions:

Set up enclosure facilities that meet relevant technical specifications;

Restricted by the construction site, it is impossible to meet the conditions in Item (3) of the preceding paragraph, and other corresponding measures can be taken with the approval of the administrative department of city appearance and environmental sanitation of the district or county where it is located. Article 12 Where a construction waste discharger carries out pipeline laying, road excavation, pipeline cleaning and other construction operations on urban roads, he shall take effective cleaning measures, conduct isolation operations in accordance with municipal engineering enclosure standards, and complete the removal of construction waste within 24 hours after the completion of construction. Thirteenth because of emergency rescue, disaster relief and other special circumstances need emergency construction to discharge construction waste, the construction unit shall, within 24 hours after the danger and disaster are eliminated, report in writing to the district and county administrative department of city appearance and environmental sanitation. Community residents' committees, villagers' committees, realty service enterprises and other organizations shall accept the supervision and guidance of the administrative department of city appearance and environmental sanitation of the district or county where they are located, set up temporary dumping sites or collection containers for the decoration garbage of closed individual houses within their jurisdiction, and organize centralized removal. Fifteenth construction waste discharge and transportation to implement the deposit system, the specific measures shall be formulated by the Municipal People's government. Chapter III Transportation of Construction Waste Article 16 Construction waste transporters shall establish and improve standardized service systems such as vehicle safety management, driver training, vehicle removal and so on, strengthen vehicle maintenance and ensure transportation safety. Construction waste transporters shall apply to the municipal administrative department of city appearance and environmental sanitation for the "Xi Construction Waste Disposal (Transportation) Certificate" and submit the following materials:

(1) Having a legal road transport business license and industrial and commercial business license;

(two) the certificate that the total approved load of transport vehicles has reached more than 500 tons;

(3) Certification documents of vehicle parking places and maintenance places suitable for the business scale of the enterprise;

(4) Motor vehicle driving license and vehicle operation license of transport vehicles;

(5) Transport vehicles shall be equipped with fully enclosed transport mechanical devices or closed covering devices, traveling and loading and unloading recorders and corresponding classified transport equipment for construction waste.

Outside the new city, beilin district, Lianhu District, Yanta District, Baqiao District, weiyang district and Chang 'an District, construction waste transport enterprises in counties apply for the "Xi City Construction Waste Disposal (Transport) Certificate", which shall be handled by the municipal administrative department of city appearance and environmental sanitation.
