Regulations of Zhuhai Special Economic Zone on Work Safety

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the reality of Zhuhai Special Economic Zone in order to strengthen the work of production safety, prevent and reduce production safety accidents and ensure the safety of people's lives and property. Article 2 These Regulations shall apply to the safety production activities and related supervision and management activities of production and business units within the administrative area of this Municipality.

Where relevant laws and regulations have other provisions on fire safety, building safety, traffic safety, civil aviation safety, nuclear and radiation safety and special equipment safety, those provisions shall prevail. Article 3 Work safety shall adhere to the principles of people-oriented, safety first, prevention first, and comprehensive management, establish the mechanism of responsibility of production and business operation units, employee participation, government supervision, industry self-discipline and social supervision, and implement the main responsibility of production and business operation units. Article 4 The municipal and district people's governments (hereinafter referred to as municipal and district governments) shall strengthen their leadership over the work of production safety, support and urge all relevant departments to perform their duties of supervision and administration of production safety according to law.

The management institutions of Hengqin New District and Economic Functional Zone shall perform the management duties of the district government. Article 5 The municipal and district safety production committees shall co-ordinate and guide the work of safety production in the local area, coordinate and solve major problems of safety production, and organize special treatment of safety production. Article 6 The safety production supervision and management department (hereinafter referred to as the safety supervision department) shall carry out comprehensive supervision and management of the safety production work within its administrative area according to law.

Public security, construction, transportation, ports, industry, municipal administration, maritime affairs, marine agriculture, quality and technical supervision, tourism and other relevant administrative departments. Within the scope of their respective duties, supervise and manage the work of production safety in related industries and fields.

Safety supervision departments and departments that supervise and manage production safety in related industries and fields are collectively referred to as departments responsible for production safety supervision and management. Article 7 The municipal and district governments shall set up special funds for safety production, which shall be used for safety production training, publicity and education, emergency rescue, accident investigation and handling, equipped with necessary safety production supervision and management equipment and facilities, and incorporated into the fiscal budget at the same level. Article 8 Relevant trade associations shall strengthen industry self-discipline, provide safety information consultation, technical exchange, education and training and other services for production and business units in accordance with laws, regulations and articles of association, and play a self-discipline role. Article 9 The municipal, district governments and departments responsible for the supervision and administration of production safety shall adopt various forms to publicize and popularize the laws, regulations and knowledge of production safety, enhance the awareness of production safety of the whole society, and improve the ability of self-help and mutual rescue and accident prevention.

News, publishing, radio, film, television, internet and other media have the obligation to carry out public welfare publicity and education on production safety, and have the right to supervise by public opinion acts that violate laws and regulations on production safety. Article 10 The municipal and district governments shall encourage and support the popularization and application of advanced technologies in production safety, cultivate and develop safety industries such as safety evaluation, safety inspection and monitoring, safety facilities and equipment, and improve the level of production safety. Article 11 The municipal and district governments shall establish a safety production reward system to reward units and individuals that have made remarkable achievements in improving safety production conditions, preventing production safety accidents and participating in emergency rescue and other safety production work. Chapter II Supervision and Administration of Work Safety Article 12 The safety supervision department shall perform the following comprehensive supervision and administration duties:

(a) the preparation of safety production planning;

(two) to organize the implementation of comprehensive safety supervision and safety production responsibility system assessment;

(three) a comprehensive analysis of the situation of production safety in the region, the release of production safety information;

(four) regularly report to the people's government at the same level on work safety, and put forward opinions and suggestions on work safety;

(five) to supervise the investigation, handling and accountability of production safety accidents;

(six) other duties as prescribed by laws and regulations. Thirteenth departments that supervise and manage the work of production safety in related industries and fields shall perform the following duties of supervision and management:

(a) to supervise and manage the implementation of safety laws, regulations, national standards, industry standards and local standards by production and business units in this industry and field according to law;

(two) the establishment of production safety supervision and management and administrative law enforcement responsibility system;

(three) the preparation of safety production site inspection guide and list, clear inspection content, rectification opinions, implementation and other matters;

(four) to guide, supervise and inspect the production and business units to establish and implement the responsibility system for production safety, and to carry out the investigation of potential safety hazards and accident prevention;

(five) to investigate and deal with illegal activities in production safety, and urge the rectification of potential safety hazards;

(six) to organize and participate in the investigation and handling of production safety accidents;

(seven) other duties as prescribed by laws and regulations.

Safety supervision departments shall perform supervision and management duties in accordance with the relevant provisions of the preceding paragraph when implementing supervision and management of safety production in non-coal mines, dangerous chemicals and fireworks. Fourteenth town people's government, street offices and industrial park management agencies shall, according to the needs of safety production in this area, clarify the safety production institutions, and be equipped with safety production supervision and management personnel to perform the following duties:

(a) to strengthen the supervision and inspection of the production safety situation of production and business units, and assist the relevant departments of the people's governments at higher levels to perform their duties of supervision and management of production safety;

(two) found violations of production safety or major accidents, it shall promptly report to the district government departments responsible for the supervision and administration of production safety.
