Article 2 These regulations shall apply to elevator production (including manufacturing, installation, transformation, repair), operation, use, maintenance, inspection, safety assessment, supervision and management and other activities within the administrative area of ??this city.

The scope of the elevator is determined according to the special equipment catalog approved by the State Council. Article 3 The municipal and county (city, district) people's governments shall uniformly lead the elevator safety management work within their respective administrative regions, urge all relevant departments to perform their duties in accordance with the law, establish coordination and assessment mechanisms, and coordinate to solve problems existing in elevator safety management.

City and county (city, district) special equipment safety supervision and management departments are responsible for the safety supervision and management of elevators within their respective administrative regions.

Relevant departments such as housing construction, public security, fire protection, development and reform, education, planning, commerce, health and family planning, transportation, tourism, safety supervision, industry and commerce, economics, information technology, and sports should ensure elevator safety in accordance with their respective responsibilities. The township (town) people's government and sub-district offices should assist relevant departments in the supervision and management of elevator safety. Article 4 People's governments at all levels and relevant departments shall strengthen elevator safety publicity and education and popularize elevator safety knowledge.

Elevator production, operation, use, maintenance and other units should strengthen the publicity of elevator safety knowledge and guide the public to use elevators correctly.

Schools and kindergartens should regard elevator safety knowledge as an important part of safety education.

News media should carry out public welfare publicity on elevator safety laws, regulations and related knowledge. Article 5 The Elevator Industry Association shall strengthen industry self-discipline, promote the construction of a credit system, establish a price guidance system for elevator maintenance, assist the special equipment safety supervision and management department in establishing a quality grade evaluation system for maintenance units, and do a good job in elevator safety management. Article 6: Elevator production, use, maintenance and other units are encouraged to purchase elevator safety liability insurance.

Elevators used in public gathering places should be insured by elevator safety liability insurance. Article 7 It is prohibited to subcontract or subcontract the installation, modification, repair and maintenance services of elevators, and it is prohibited to transfer the corresponding activities to non-unit personnel in any form.

Elevator installation, modification, repair and maintenance personnel are prohibited from working in two or more units at the same time. Article 8 Elevator production, use, and maintenance units are encouraged to adopt advanced technologies and scientific means such as remote monitoring and information management to improve elevator safety performance and management level, and enhance accident prevention capabilities and emergency rescue capabilities. Chapter 2 Production and Operation Article 9 Elevator manufacturing units shall ensure that the elevators they produce meet the requirements of safety technical specifications and relevant standards, and shall be responsible for the safety performance of the elevators they produce; they shall provide instructions to the entrusted elevator installation, modification, and repair units and elevator The use and maintenance unit provides skills training and technical support. Article 10 The elevator modification unit shall obtain a manufacturing license in accordance with the law. If the elevator is not modified by the original elevator manufacturing unit, the elevator nameplate shall be replaced and the elevator manufacturing unit shall bear the responsibility. Article 11 The selection and configuration of elevators and the design and construction of machine rooms, shafts and other facilities must comply with elevator safety technical specifications and corresponding standards, and meet emergency rescue requirements.

If an existing building applies to install an elevator, it must be approved by the planning, housing and construction departments.

Construction units and construction units shall not use elevators for carrying construction materials, construction waste and other engineering construction operations. Article 12 Elevator installation, modification, and major repair construction units shall apply to the elevator inspection agency for supervision and inspection before construction. Article 13 Within thirty days after the elevator installation, modification, and major repairs are completed and passed the supervision and inspection, the construction unit of the elevator installation, modification, and major repairs shall submit the factory data, installation technical data, manufacturing unit calibration and debugging report, supervision and inspection Technical data such as reports are handed over to the user unit (copied and archived at the same time), and written handover procedures are completed. Before going through the handover procedures, effective measures should be taken to prevent the elevator from being used by non-elevator construction personnel.

Article 14 Elevator operating units shall sell and lease elevators that comply with laws, regulations, safety technical specifications and relevant standards, and assist in solving elevator manufacturing and installation quality problems.

In addition to complying with the provisions of the preceding paragraph, entities selling overseas-manufactured elevators must also be the clear domestic registered agents of overseas manufacturing enterprises and assume responsibility for elevator quality and safety. Chapter 3 Usage Management Article 15 The unit with the right to manage the use of elevators or the natural person with full capacity for civil conduct is the elevator user unit (hereinafter referred to as the user unit). The user unit shall be determined in accordance with the following provisions:

(1) If the elevator owner has not entrusted the management, the elevator owner shall be the user unit;

(2) If the elevator owner entrusts the management of the property service enterprise , the property service enterprise is the user unit;

(3) The elevator is owned by ***, and the *** owner should entrust the elevator manager in writing, and the elevator manager is the user unit;

(4) If the newly installed elevator has not been handed over to the owner, the construction unit shall be the user;

(5) The elevator is rented or loaned, and if the user has not been agreed in writing, the lessor or lender shall be the user.

If the user unit is unclear, it shall be determined through coordination with the township (town) people's government and sub-district office where the elevator is located. Elevators with undetermined user units shall not be put into use.
