Hebei Province Measurement Supervision and Management Regulations (2017 revision)

Chapter 1 General Provisions Article 1 is to strengthen measurement supervision and management, ensure the unity of the national measurement unit system and the accuracy and reliability of values, protect the legitimate rights and interests of users, consumers and operators, and maintain social and economic order. To promote national economic development and social progress, these regulations are formulated in accordance with the provisions of the "People's Republic of China and the National Metrology Law" and relevant laws and regulations, and in combination with the actual conditions of the province. Article 2 When engaging in metrological activities and conducting metrological supervision within the administrative region of this province, you must abide by these regulations.

Measurement activities as mentioned in these regulations refer to establishing measurement standard instruments, using measurement units, manufacturing, repairing, installing, modifying, selling, importing and exporting, and using measuring instruments, and conducting measurement certification, measurement verification, and testing. Or calibration, issuing measurement data, measuring and settling products, goods or services, etc. Article 3 The metrological administrative departments at or above the county level are responsible for the supervision and management of metrological activities within their respective administrative regions. Article 4 People's governments at all levels shall support metrological science and technology research and promote advanced metrological science and technology and management methods. Chapter 2 Use of Units of Measurement Article 5 The units of measurement of the International System of Units and other units of measurement selected by the state are the national statutory units of measurement. The names and symbols of national legal units of measurement shall be in accordance with relevant national regulations. Article 6 Those engaged in the following activities shall use national statutory measurement units:

(1) Preparing and issuing official documents, communiques, and statistical reports;

(2) Editing, broadcasting, and transmitting radio and television programs Information;

(3) Produce and publish advertisements;

(4) Formulate standards, verification procedures, and technical documents;

(5) Publish and distribute publications ;

(6) Print bills, tickets, and account books;

(7) Issue testing and inspection data;

(8) Produce and sell goods, and label them Product labeling and preparation of product instructions for use;

(9) Other activities that require the use of national legal units of measurement as stipulated by the state and the province. Article 7 The import and export of goods, the republication and publication of ancient books, literary works and other matters that require the use of non-national statutory measurement units shall be implemented in accordance with relevant national regulations. Chapter 3 Management of Measuring Instruments Article 8 Units and individuals who manufacture, repair, install, modify, sell, import and export, and use measuring instruments must ensure the accuracy and reliability of measuring instruments in accordance with the law. Article 9 Units and individuals that manufacture or repair measuring instruments shall obtain a "License for Manufacturing Measuring Instruments" or a "License for Repairing Measuring Instruments" in accordance with the law and accept annual review.

Forgery, fraudulent use, transfer, rental and lending of the "License for Manufacturing Measuring Instruments" and "License for Repairing Measuring Instruments" are prohibited. Article 10 Units and individuals that manufacture measuring instruments shall mark the license mark, serial number, factory name and address on the measuring instrument instructions, product nameplates and outer packaging. Units and individuals that repair measuring instruments shall mark the repair license mark and number on the measuring instrument repair certificate. Article 11 Units and individuals that manufacture measuring instruments shall not arbitrarily reduce the measurement performance of the original approved type of measuring instruments they manufacture; they shall not use other people's measuring instruments to apply for type appraisal or prototype testing.

Computer software used to process measurement data shall be certified for measurement functions by the provincial metrology administrative department. Article 12 Units and individuals engaged in the installation and modification business of measuring instruments must undergo a qualification review by the metrology administrative department at or above the districted city level and obtain a certificate of qualification before they can engage in the installation or modification business. If laws and administrative regulations provide otherwise, such provisions shall prevail. Article 13 It is prohibited to sell the following measuring instruments:

(1) Without the mark, serial number and factory certificate of the "License for Manufacturing Measuring Instruments";

(2) Forgery or counterfeiting Using the "License for Manufacturing Measuring Instruments" logo, serial number and factory name and address;

(3) Passing off fakes as genuine, old ones as new, or assembling and modifying with defective spare parts;

(4) The use is expressly prohibited by the state and this province.

Article 14 The following behaviors are prohibited when using measuring instruments:

(1) Destroying the accuracy of measuring instruments;

(2) Forging or destroying measurement verification marks and seals;

(3) Use measuring instruments that have not been calibrated, have exceeded the calibration cycle, or have failed calibration;

(4) Use measuring instruments that are expressly prohibited by the state or the province or have lost their due accuracy. ;

(5) Using measuring instruments with the purpose of deceiving consumers;

(6) Forging measurement data;

(7) Modifying compulsory verification at will Measuring instruments. Chapter 4 Metrology Verification and Metrology Certification Article 15 To carry out metrology verification, the following conditions must be met:

(1) Measuring standard instruments must be assessed and qualified by the metrological administrative department at or above the county level and obtain the corresponding certificate of qualification. ;

(2) Metrology verification personnel must pass the assessment;

(3) Work within the verification scope limited by the metrology administrative department at or above the county level;

(4) Implement corresponding metrological verification procedures. Article 16 To carry out metrological verification work to the public, it must be authorized by the metrological administrative department at or above the county level. Article 17 The metrological verification institution shall complete the verification work within fifteen days from the date of receipt of the measuring instruments under inspection; if the time needs to be extended under special circumstances, the verification institution shall negotiate with the unit that submitted it for inspection. Measuring instruments submitted for inspection shall be properly kept and shall not be damaged.
