The newly revised "Jiangsu Province Highway Regulations" (hereinafter referred to as the "Regulations") were discussed and adopted at the ninth meeting of the Standing Committee of the Twelfth People's Congress of Jiangsu Province on March 28, 2014. It will be officially implemented on August 1, 2014. The interpretation is as follows: Since the "Regulations" came into effect on March 1, 2003, they have better standardized the operation, management and services of highways in our province, promoted the rapid development of highways in our province, and improved the production and life of the people. , and played a positive role in promoting the social and economic development of our province. At present, the province's expressway mileage is nearly 4,400 kilometers, basically forming a network of expressway networks covering all cities and counties in the province. However, with the deepening of the reform of the national highway administrative system and the comprehensive network operation of highways in our province, many new situations and new problems have emerged. The society and the public have also put forward many new requirements for highway services and management, and there is an urgent need to timely The "Regulations" are revised to meet the growing travel needs of the broad masses of the people, mainly in the following aspects:

First, in order to comply with the requirements of higher-level laws, the relevant management entities set by the "Regulations" need to be adjusted. Before the revision of the Regulations, the provincial transportation department was the supervisory and administrative body for highway administration, maintenance, and operation in our province. The "Highway Safety Protection Regulations" of the State Council, which were implemented on July 1, 2011, while strengthening highway safety protection, authorized highway management agencies to be specifically responsible for the supervision and management of highway protection. Accordingly, the "Jiangsu Province Highway Regulations" were carried out in 2011. Revised, and authorizing provisions are made for the law enforcement entities of highway management agencies. In order to comply with the requirements of higher-level laws and connect with other highway management regulations in our province, it is necessary to make timely adjustments to the relevant management entities of the Regulations.

The second is the need to further strengthen safety guarantees to meet the people’s new and higher requirements for safe and orderly highway traffic. Ensuring highway safety and smooth flow has always been the primary goal of highway operation and management. Over the years, some new situations and problems involving safety hazards have emerged in the operation of highways, including the improvement of highway-related supporting facilities and how to innovate and optimize services and management measures, especially in traffic safety and traffic management. We are still facing a lot of pressure. On the one hand, we need to take practical and effective measures to address the existing prominent problems. On the other hand, we also need to constantly summarize the successful experience gained in practical work and clearly incorporate it into the "Regulations" and upgrade it to Regulations are stipulated in order to ensure the safety and smooth flow of highways in our province.

Third, it is necessary to adapt to the requirements of highway operation and management under the new situation, standardize and guide the comprehensive improvement of highway service quality and management level. As the mileage of highways in our province continues to increase and the road network continues to improve, how to improve the level of highway network operation, better serve the public's travel, and solve the outstanding problems of highways in a timely manner, especially the maintenance of highways, Business services, toll management, network dispatching, and the installation of advertising facilities along expressways are not only the focus of the work of transportation, public security and other management departments as well as expressway management units, but also hot spots of concern to the society and the public. They need to be further clarified through local legislation. and refine the responsibilities, scope, content and requirements related to highway service and management, etc., and continuously promote the improvement of highway service and management levels.

The revision of the "Regulations" has great significance and far-reaching impact on strengthening the management of highways in our province and ensuring the integrity, safety and smooth flow of highways. (1) About the highway management system

1. About the highway management entities and responsibilities. On February 26, 2014, the Provincial Department of Transportation established the Provincial Highway Administration (Provincial Highway Administration Corps) to perform the functions of highway administration, operation supervision, road network dispatching, and road transportation supervision and inspection.

In response to the problems that arise in the toll collection for troubleshooting, Article 50 of the "Regulations" stipulates that when the expressway operation and management unit performs troubleshooting and rescue on a vehicle, it shall tow the vehicle to the location agreed with the party; if the negotiation fails, it shall tow the vehicle to the nearest location. Tow the vehicle off the highway at the exit. If the state has other regulations on the clearance and rescue of accident vehicles, those regulations shall prevail. Debugger clearance and rescue charges shall comply with the standards approved by the provincial price department. No unit or individual may forcefully tow vehicles to designated locations for repairs.

2. Regarding expressway service area management. In order to standardize and strengthen the management of expressway service areas and improve the service level of service areas, the "Regulations" have added relevant content, and specifically stipulated in Articles 51 and 52 the conditions of expressway service areas and parking areas. Daily management and service requirements, in particular, clearly stipulate that goods or services provided in expressway service areas must be clearly priced, and the price must not be significantly higher than the market price of similar goods and services in the region.

(4) About the management of advertising facilities along expressways

The management of advertising facilities along expressways has always been a key area of ??expressway management. Through centralized rectification in the past few years, certain achievements have been made. effect. Starting from March 1, 2012, the "Measures for the Management of Advertising Facilities Along Highways in Jiangsu Province" was officially promulgated and implemented, becoming the first government regulation in the country to standardize the management of advertising facilities along highways. In order to ensure the coordination and unification of laws and regulations, Articles 20 and 22 of the "Regulations" clarify the relevant management requirements for advertising facilities. Among them, Article 20, paragraph 3, stipulates that buildings on both sides of the highway, The vertical projection of the structure shall not be within the highway construction control zone. Article 22 stipulates that areas such as highway toll stations, interchange areas, service areas, and areas within 100 meters from the outer edge of highway land (excluding building control areas) can be set up in accordance with the planning and relevant requirements for advertising facilities along the highway. When setting up advertising facilities, it is also clearly stipulated that the relevant approval procedures must be completed to set up advertising facilities, and the validity period of the license is clarified.

(5) Regarding ensuring highway traffic safety

1. Judging from the practice of highway operation and management over the years, there are two outstanding problems in highway traffic safety. First, The phenomenon of random and frequent lane changes on expressways is serious. Secondly, the phenomenon of illegal occupation of emergency lanes is quite prominent, which has caused great safety risks and also affected the passage of rescue and law enforcement vehicles. To this end, Articles 34 and 35 of the Regulations further clarify the above two situations respectively to ensure the order and safety of highway traffic. In addition, because some of the provisions in the traffic safety management chapter overlap with relevant laws and regulations, the original Articles 34 and 35 of the Regulations have also been merged and deleted.

2. Regarding the management of dangerous goods transport vehicles. In recent years, the number of dangerous goods transport vehicles traveling on highways has increased, which has brought great hidden dangers to the smooth flow and safety of highways. In order to strengthen the management of this type of special vehicles and avoid accidents that endanger highway traffic safety, in accordance with the provisions of relevant laws and combined with actual management needs, the "Regulations" stipulates in Article 42 that the transportation of flammable, explosive and highly toxic vehicles Vehicles carrying dangerous goods such as radioactive materials and other dangerous goods traveling on highways should hang clear signs and drive in the rightmost lane; bridges and tunnels crossing the Yangtze River through highways should comply with the relevant provisions of the State Council's "Highway Safety Protection Regulations" and follow the designated Time and speed travel.
